Three separate things are true at once. Emergency care cannot be refused to anyone on grounds of nationality or migration status, and the Constitutional Court has since read the statute as meaning that irregular status or the absence of a visa cannot block medical attention at all. Residents have a right to the health systems and to social security, and a foreigner holding an Ecuadorian identity card can enrol in the IESS voluntarily. But the immigration rules push in the other direction: a rentista, a pensioner or a remote worker must hold private or public health insurance covering Ecuador for the whole life of the visa before it is granted.

In detail
The court moved the line
The statute as written protects emergency care only. In judgment 13-17-IN/24, published in February 2025, the Constitutional Court declared article 52 constitutional on condition that it is read as meaning that irregular status or the absence of a visa cannot prevent medical attention by health institutions - a wider proposition than the emergency rule the article spells out. Insurance to get the visa, IESS once you have the card
The sequence matters. Private or foreign insurance covering Ecuador is what the visa application needs; the IESS is what you can join afterwards, because voluntary affiliation for a foreigner requires an identity card issued in Ecuador, and that comes from the cedulación order handed over with the visa. A retired foreigner joining voluntarily has a contribution base tied to the pension received in their country of origin, which the IESS says may in no case be lower than Ecuador's minimum wage.
Country-level policy
Ecuador does not put dollar figures in its immigration rules. It writes them as multiples of the Salario Básico Unificado, the monthly minimum wage, which the Ministerio del Trabajo fixes by ministerial agreement each December for the year ahead. The rentista and pension thresholds are three wages, the investor threshold is a hundred, the customs ceiling on work equipment is a hundred and sixty, the tourist extension fee is a third of one, and the overstay penalty is one. For 2026 the wage is USD 482, twelve dollars above 2025. Because Ecuador uses the US dollar, none of these figures drifts between settlements - which is the opposite of the position in Argentina, Colombia, Chile, Peru or Uruguay, where a dollar-denominated threshold moves with the exchange rate every day.
Since December 2023 a newcomer who has never been an Ecuadorian tax resident can elect a regime that taxes only Ecuadorian-source income for five years, and the same law attaches a five-year temporary residence visa to it instead of the ordinary two. The entry ticket is either USD 150,000 invested in Ecuadorian property or productive activity, held for five years, or proven non-Ecuadorian income of USD 2,500 a month together with enrolment in Ecuadorian social security for the whole stay. Both have to be in place within 120 days of first entering the country, which makes this a decision to take before arriving rather than after settling in.

Practical notes
The IESS frequently-asked-questions page is the only place we found that states the voluntary contribution rate, and it illustrates it with a minimum base of USD 400 described as the 2021 minimum wage. That example is stale - the 2026 wage is USD 482 - and we quote the page rather than recalculating it, because the page does not say whether the base tracks the wage automatically.
We did not read the IESS resolution that sets contribution rates, nor the Ley de Seguridad Social, so the rates here rest on the institute's own summary page and should not be treated as the instrument.
Nothing we read sets a waiting period before a voluntary affiliate can use health cover. Ecuadorian practice is widely reported to impose one; it is not on the pages named here, so we do not state it.
The public network run by the Ministerio de Salud Pública is not described here at all: we did not read a ministry page on entitlement, and the statute routes the question to 'la ley', which we have not followed.
