Chapter IV of the Constitution and the Guyana Citizenship Act between them give a closed list: you are a citizen by birth in Guyana, by birth abroad to a Guyanese parent, by entitlement on marriage to a citizen, by registration, or by naturalisation. Registration is for Commonwealth citizens and citizens of Ireland after five years of ordinary residence or government service; naturalisation is for everyone else and asks for twelve months in Guyana immediately before the application plus five years in the preceding seven. Neither asks about money, a language or a test. What they do have is section 7(2), which says the Minister need give no reason for refusing and that no exercise of the power may be appealed or reviewed in any court - an ouster of unusual breadth. The Ministry of Home Affairs adds requirements of its own: four sworn recommendations from Guyanese of good standing, a notice of your intention published in two separate issues of a local newspaper, a tax liability statement and a social-insurance compliance statement.

In detail

Two routes, chosen by your present nationality

Guyana sorts applicants by what passport they already hold. A Commonwealth citizen or a citizen of Ireland uses section 4(1) of the Citizenship Act and needs five years of ordinary residence or Government service. Everyone else is an alien for the Act's purposes and uses section 9 and the Second Schedule, which is stricter in shape though not in length: twelve months in the country immediately before applying, and five years in the aggregate in the seven years before that twelve-month period. The Minister may relax every limb of the Second Schedule, including by counting residence anywhere in the Commonwealth, which means the two routes converge in practice far more than they do on paper.

The discretion, and the absence of review

Section 7(2) is the provision to read before anything else. It says the Minister is not required to give a reason for registering, naturalising or certifying citizenship, and that no exercise of any such power is subject to appeal or review in any court. Ouster clauses of that breadth are rare in the countries covered here, and they change what the residence periods mean: meeting them creates no entitlement. The one place where an entitlement does exist is article 45 of the Constitution, on marriage to a citizen, which says a person "shall be entitled" to be registered. That is a constitutional right rather than a statutory discretion, and the difference is the whole of it.

What the counter adds

The Act asks for residence, good character and an intention to reside. The Ministry of Home Affairs asks for four stamped recommendations from Guyanese nationals of good standing, with copies of their identity documents; a notice of the intention to apply published in two separate issues of a newspaper circulating in the applicant's district; an income tax liability statement; and a National Insurance compliance statement. The newspaper notice is the kind of requirement that used to appear in the Act itself in Commonwealth nationality statutes, and here it does not: the Citizenship Regulations prescribe forms, not publication. A reader who plans from the Act alone will be surprised by it.

No investment route, and the closed list that shows it

Guyana is a CARICOM member, is not an OECS member, and runs no citizenship-by-investment programme. The grounds for citizenship are exhaustively set out: articles 41 to 45 of the Constitution for continuation, birth, descent and marriage, and article 48 letting Parliament provide for acquisition by those who do not qualify under the Chapter. What Parliament provided is the Citizenship Act, whose operative grants are registration under sections 4 and 5 and naturalisation under section 9 and the Second Schedule. Not one of those provisions refers to a payment, a contribution, a fund, a bond or a property purchase.

Country-level policy

The law portal serves two editions of the Laws of Guyana at the same time

Guyana's statute book is published under the Law Revision Act, which establishes a Law Revision Commission chaired by the Attorney-General, lets it publish in loose-leaf or any other form it determines, and makes every authorised page bear the number of the Law Revision Order that put it there. Section 9 then says those pages are, in all courts and for all purposes, the sole and proper Statute Book of Guyana for the law in force on the relevant revision date. The authority is therefore the L.R.O. number printed at the foot of every page, and on mola.gov.gy two different numbers are in circulation. The first three volumes carry L.R.O. 1/2022; everything from volume four onwards carries L.R.O. 1/2012, which the Attorney General told the National Assembly in June 2026 shows the law as it stood on 31 December 2012. Immigration, citizenship, aliens, the CARICOM Acts, income tax, customs and road traffic are all in the older half.

Practical notes

The arrangement of sections in the Citizenship Act jumps from 11 to 13, but section 12 is printed in the body of the Act. The omission is in the arrangement, not in the text.

On 2026-10-06, 52 of its 461 chapter entries carried L.R.O. 1/2022 - volumes 1 and 2 and part of volume 3 - and the remaining 409 carried L.R.O. 1/2012. The Attorney General told the National Assembly in June 2026 that 1/2012 shows the law as at 31 December 2012 and 1/2022 all laws enacted to 31 December 2022, so the L.R.O. number at the foot of each page is the only way to tell which edition you are reading. Everything that matters for migration - the Immigration Act, the Guyana Citizenship Act, the Aliens Act, all five CARICOM chapters, the Income Tax Act, the Customs Act, the Motor Vehicles and Road Traffic Act - is still in the 2012 half. It must never be cited for what the law is now: the Income Tax Act it publishes prints a flat 33 1/3 per cent and has no section 36A, while the Revenue Authority charges 25 and 35 per cent under a section 36A. It publishes no amending Acts and no statutory instruments at all, so there is nothing on the site to check a Chapter against. Several chapters omit their own subsidiary legislation or schedules and say so in a note. Filenames carry a volume label and a unix timestamp, so a chapter's URL cannot be guessed and changes when the file is replaced.
