Honduran social security runs on employment. The social security institute is a compulsory public service, and the duty that makes it work sits on the employer: every employer must register every worker who enters its service. The constitutional architecture is the same - the State, employers and workers all contribute, and the system is to be introduced gradually and progressively, by risk covered, by geography and by category of worker. That last phrase is not decorative: the law's own list of people brought in by special and progressive affiliation includes the self-employed, domestic workers, pensioners and students, and makes each one conditional on actuarial studies. A resident who is not employed in Honduras has no route into the institute that we found in writing. The right to health protection is recognised separately in the Constitution and is not the same thing as cover.

Cover follows a job

The institute is compulsory and the compulsion is on employers: every employer must register every worker who enters its service, and must report the worker leaving as soon as possible. The employee gets an identification document and a statement of contributions. For a foreigner on a work-based permit this is automatic in the sense that it is someone else's duty, and the migration file already requires the employer to prove it is in good standing with the labour ministry. What is harder to find in writing is the route for anyone else. The law's own category for voluntary continuation, self-employment, domestic work and retirement sits in the article on special regimes and progressive affiliation, and every one of those categories is made conditional on actuarial and feasibility studies rather than granted outright.

The right to health is not the right to be insured

Article 145 of the Constitution recognises the right to the protection of health; article 142 makes the social security institute the body that provides social security services; article 143 says the regime shall be introduced gradually and progressively, by risk, by geographical area and by category of worker protected. Those are three different promises and they are often read as one. A resident foreigner who is not employed in Honduras has the constitutional right to health protection, which is addressed to the State's health system, and no entitlement to the institute that we found in any instrument we read.

The Instruments Name an Agency That No Longer Exists, and the New One Publishes Nothing

Every procedure in the Honduran migration law and its regulation is addressed to the Dirección General de Migración y Extranjería, under the Secretaría de Gobernación y Justicia. Neither name is current: migration control is now exercised through the Instituto Nacional de Migración under the Secretaría de Gobernación, Justicia y Descentralización, as a 2025 ministerial instrument recites. That would be a cosmetic problem if the new institute published requirement sheets. It does not. Its site was relaunched on 30 September 2026 and its alien affairs page lists the kinds of procedure it handles without stating a single requirement for any of them. The 2003 law and its 2004 regulation are therefore the only public statement of what Honduras asks.

Honduran Migration Law Prices Everything in Dollars

The currency of Honduras is the lempira, and almost nothing in its migration law is stated in lempiras. The income thresholds are in United States dollars, the investment threshold is in dollars, the guarantee deposit is in dollars, and the whole fee schedule of the regulation - residences, naturalisations, permits, passports, extensions, the land entry fee - is in dollars with a single lempira line at the end for certificates. The law allows payment in the equivalent in national currency, so the dollar is the unit of account rather than the means of payment. The practical effect is that these figures do not quietly erode with the exchange rate, which is why thresholds set in 2003 are still the thresholds today.

Practical notes

This record does not state who falls inside the compulsory regime, and that is a gap rather than a finding. Article 3 of the law lists them, and the list did not survive extraction from the gazette: the article appears in our reading as five empty lettered stubs. Anyone relying on that article should read a clean copy of La Gaceta no. 29,503 of 14 June 2001.

The statement that no route into the institute exists for a non-working resident is bounded by what we read: the Constitution's social security and health chapters and Decreto 80-2001, which rewrote seventy-two articles of the 1959 social security law. We did not read the board's own regulations, which article 3 says fix the conditions, nor any instrument of the health ministry.

We did not read anything about private medical insurance, about what a residence application requires by way of health cover, or about charges to foreigners in public hospitals.
