Italy splits health care in two and writes both halves into the immigration Act. Foreigners lawfully staying who work, are self-employed or are registered as seeking work must enrol in the National Health Service, and so must those holding or renewing a permit for work, family, asylum, subsidiary protection, special cases, special protection, medical treatment, an asylum claim, pending adoption, fostering or the acquisition of citizenship - and unaccompanied foreign minors, even before a permit is issued. Enrolment carries equal treatment with Italian citizens. For foreigners present without lawful status, article 35 guarantees urgent or in any case essential outpatient and hospital care, continuing care included, at public and accredited facilities, and extends preventive medicine programmes to them.

«Hanno l'obbligo di iscrizione al Servizio sanitario nazionale e hanno parita' di trattamento e piena uguaglianza di diritti e doveri rispetto ai cittadini italiani per quanto attiene all'obbligo contributivo, all'assistenza erogata in Italia dal Servizio sanitario nazionale e alla sua validita' temporale: a) gli stranieri regolarmente soggiornanti che abbiano in corso regolari attivita' di lavoro subordinato o di lavoro autonomo o siano iscritti nelle liste di collocamento; b) gli stranieri regolarmente soggiornanti o che abbiano chiesto il rinnovo del titolo di soggiorno, per lavoro subordinato, per lavoro autonomo, per motivi familiari, per asilo, per protezione sussidiaria, per casi speciali, per protezione speciale, per cure mediche ai sensi dell'articolo 19, comma 2, lettera d-bis), per richiesta di asilo, per attesa adozione, per affidamento, per acquisto della cittadinanza. b-bis) i minori stranieri non accompagnati, anche nelle more del rilascio del permesso di soggiorno, a seguito delle segnalazioni di legge dopo il loro ritrovamento nel territorio nazionale.»Who is enrolled, and that enrolment is an obligation rather than an option. «Per le prestazioni sanitarie erogate ai cittadini stranieri non iscritti al Servizio sanitario nazionale devono essere corrisposte, dai soggetti tenuti al pagamento di tali prestazioni, le tariffe determinate dalle regioni e province autonome ai sensi dell' articolo 8, commi 5 e 7, del decreto legislativo 30 dicembre 1992, n. 502 , e successive modificazioni. 2. Restano salve le norme che disciplinano l'assistenza sanitaria ai cittadini stranieri in Italia in base a trattati e accordi internazionali bilaterali o multilaterali di reciprocita' sottoscritti dall'Italia. 3. Ai cittadini stranieri presenti sul territorio nazionale, non in regola con le norme relative all'ingresso ed al soggiorno, sono assicurate, nei presidi pubblici ed accreditati, le cure ambulatoriali ed ospedaliere urgenti o comunque essenziali, ancorche' continuative, per malattia ed infortunio e sono estesi i programmi di medicina preventiva a salvaguardia della salute individuale e collettiva.»The tariff for the unenrolled, and the guarantee for people with no status at all.
