Insurance Is Compulsory and Nationality Is Not a Condition

Answer

The general rule applies to you

No exception is recorded for citizens of Ireland on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Ireland to Japan · Access to healthcare

Japan has no residence test for health insurance and no waiting period. Article 5 of the National Health Insurance Act says that a person who has an address in a prefecture is an insured person of that prefecture's National Health Insurance, and article 6 lists the people it does not cover - which turns out to be everyone already covered by something else, principally employees under the Health Insurance Act. Between them, the two leave almost nobody out. Nationality is not mentioned in either. What does the work for a foreign national is the municipal register: a person given a status of residence for more than three months is a mid-to-long-term resident, gets a residence card, has to register an address, and is therefore a person with an address in a prefecture. The patient pays three tenths of the cost at the counter.

At a glance

Who is insured under National Health Insurance
A person with an address in the prefecture

都道府県の区域内に住所を有する者, article 5 of the National Health Insurance Act. Nationality is not a condition and appears nowhere in the article.

Waiting period
None in article 5 or article 6 of the National Health Insurance Act

Article 5 makes cover follow the address. Article 6, read in full, lists eleven exclusions and none of them is a period of time since arrival.

Enrolment
Not optional

The Act states who is an insured person; it does not create a choice. Article 6 excludes a person covered by another scheme, which is how an employee is kept out of the municipal one.

Threshold a foreign national has to cross
A period of stay of more than three months

Article 19-3 of the Immigration Control and Refugee Recognition Act: a person given a period of stay of three months or less, or Temporary Visitor, Diplomat or Official status, is not a mid-to-long-term resident and gets no residence card.

Patient's share of the cost
Three tenths

十分の三 in article 42(1)(i) of the National Health Insurance Act, for a person from the first 1 April after their sixth birthday to the month containing their seventieth.

Patient's share for a child under school age
Two tenths

Article 42(1)(ii): up to the first 31 March after the sixth birthday.

Patient's share from seventy
Two tenths, or three tenths on a higher income

Article 42(1)(iii) and (iv). The income level that moves it is left to Cabinet Order.

Employees
Covered by the Health Insurance Act instead

Article 3 of the Health Insurance Act makes a person employed at a covered establishment an insured person, subject to exclusions for day labourers, short fixed terms, seasonal and temporary work.

Requirements

  • An address in a Japanese municipality, registered under the Basic Resident Registration Act
  • A status of residence giving a period of stay of more than three months, other than Temporary Visitor, Diplomat or Official
  • Not already covered by one of the employee schemes, the seamen's scheme, a mutual aid association, the scheme for private school staff, or the scheme for people aged seventy-five and over
  • For an employee: employment at a covered establishment, which brings Health Insurance Act cover instead and automatically

In detail

The threshold is immigration law, not health law

Neither health insurance Act mentions foreigners. The National Health Insurance Act insures whoever has an address in the prefecture; the Health Insurance Act insures whoever works at a covered establishment. What decides whether a foreign national has an address is the Basic Resident Registration Act, and what decides whether that Act reaches them is article 19-3 of the immigration Act, which makes a residence card depend on a period of stay longer than three months. So the answer to 'when do I get Japanese health cover' is the same as the answer to 'when do I get a residence card', and the three months is an immigration line that the health system inherits.

Article 6 is a list of other schemes, not a list of excluded people

Read on its own, article 5 looks too wide: it would insure everybody. Article 6 is what makes the system work, and every one of its eleven items takes out a person who is already covered somewhere else - employees, seamen, national and local public servants, private school staff, dependants of each of those, people aged seventy-five and over, members of an occupational insurance society - or a household receiving public assistance. Read the two together and the design is clear: everyone is insured, and the municipal scheme is the residual one.

Three tenths at the counter

Japan does not have free treatment at the point of use. The insured person pays a fraction of the cost of whatever was done, set by article 42 at three tenths for working-age adults, two tenths for children before school age and for most people over seventy, and three tenths again for an older person with a high income. The fraction is the same whether the treatment costs a thousand yen or a million, which is why the separate ceiling on monthly costs matters so much - and that ceiling was not read for this record.

What applies to you

Nothing changes for a citizen of Ireland

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

Article 5 A person who has an address within the area of a prefecture is an insured person of the National Health Insurance operated by that prefecture together with the municipalities within it.

Ours. One sentence, no nationality, no qualifying period, and no application: having the address is the whole of the test.

The Japanese government's own consolidated statute book, run by the Digital Agency. It is the only place that publishes Japanese law as it currently stands: each law page states the date the displayed text came into force, the amending instrument that produced it, and a Law RevisionID of the form <lawid>_<yyyymmdd>_<amending-id> which identifies that exact version. A page also warns 未施行あり where amendments are enacted but not yet in force. The text is Japanese and there is no English anywhere on it; each page links out to the Ministry of Justice translation where one exists, which is how the two publishers are related. Renders through Firecrawl without difficulty despite being a single-page application.

Standing: Maintains the text in force

Cannot be cited for: Japanese only. It publishes the consolidated law and not the amending acts, so an article number here is the article of the resulting law and the instrument that put it there has to be read from the header. It carries no commentary, no notification (告示) and no ministerial guidance, and a great deal of Japanese immigration practice lives in 告示 made by the Minister of Justice which this site does not hold. It must not be cited for anything the Immigration Services Agency decides administratively, and it must not be cited for English: the English on the law pages is a link, not a text.

Ours, and the opening with the first item. The article runs to eleven items and every one of them is a person covered by another scheme or in receipt of public assistance. None of them is about nationality, status of residence or length of stay.

Practical notes

Articles 5 and 6 of the National Health Insurance Act were read in full, which is what bounds the statement that there is no nationality condition and no waiting period in them.

The high-cost medical expense benefit, which caps what a patient actually pays in a month, is a separate provision of both Acts and was not read.

Premiums are not recorded here. National Health Insurance premiums are set by each municipality within a statutory frame, so there is no national figure, and the Health Insurance Act premium rate is set by the insurer.

Dependants of an employee are covered under the Health Insurance Act's 被扶養者 provisions, which were not read. Since 2020 those provisions have carried a residence-in-Japan condition which this record does not describe because the provision was not read.

No English translation was used. The Ministry of Justice's translation database has no current translation of either health insurance Act.
