An Obligation to Insure, Pinned to Another Act Entirely

Answer

The general rule applies to you

No exception is recorded for citizens of Ecuador on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

116 exceptions recorded across 45 countries · none match Ecuador to Netherlands · Access to healthcare

Dutch health cover is not a public service you qualify for; it is a private insurance you are obliged to buy. Article 2 of the Health Insurance Act says that whoever is insured by operation of law under the Long-term Care Act must take out, or have taken out, a health insurance against the risk the Act describes. Nationality appears nowhere in it. Who is insured under the other Act is the question that actually decides the answer, and this Act does not answer it.

At a glance

What it is
A compulsory private insurance, not an entitlement to a service
What it follows
Insurance under the Wet langdurige zorg, which this Act does not define
Nationality
Not mentioned in article 2 of the Zorgverzekeringswet, which is the provision creating the obligation
Where the real test lives
In the Wet langdurige zorg, which has not been read for this record

Requirements

  • Insurance by operation of law under the Wet langdurige zorg
  • A health insurance policy against the risk in article 10

What applies to you

Nothing changes for a citizen of Ecuador

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

What the law says

Text layer - verbatim verifiedZorgverzekeringswet · Article 2(1)
«1 Degene die ingevolge de Wet langdurige zorg en de daarop gebaseerde regelgeving van rechtswege verzekerd is, is verplicht zich krachtens een zorgverzekering te verzekeren of te laten verzekeren tegen het in artikel 10 bedoelde risico.»

Our translation - not official

A person who is insured by operation of law under the Long-term Care Act and the regulations based on it is obliged to insure themselves, or have themselves insured, under a health insurance against the risk referred to in article 10.

A duty defined entirely by reference to another statute. The second paragraph then lists who is not subject to it, and was not read.

About this source

The consolidated text of every Dutch regulation, each at a stable BWBR identifier and served whole as HTML. A date may be appended to the address to ask for the text as it stood on that day, and the page states the period the version it serves was in force.

Standing: Maintains the text in force

Cannot be cited for: The authentic text is Dutch. The English renderings that exist elsewhere are translations and may not be quoted as the instrument. Much of what decides a Dutch application is not here as law: the Vreemdelingencirculaire 2000 is a policy circular of the State Secretary, and the IND's own pages are an agency describing the law it applies. The reach of each instrument also differs inside the Kingdom - the Vreemdelingenwet 2000 governs the European Netherlands, the Caribbean Netherlands has its own admission Act, and Aruba, Curacao and Sint Maarten legislate their own admission entirely, while the Rijkswet op het Nederlanderschap is a Kingdom Act and applies across all of it.

Practical notes

The chain matters to a new arrival, because the obligation begins when the other Act's insurance does and being late carries consequences this record does not cover.

Only article 2(1) was read. The exclusions in article 2(2) and the position of people who are here but not insured under the other Act are open.
