Nicaraguan health law is written around persons rather than citizens. The General Health Law protects the right of every person to enjoy, keep and recover their health, guarantees coverage to the whole population, and nowhere makes nationality or migration status a condition. Free treatment is a narrower promise: it is guaranteed for the vulnerable population, defined as those without the resources to meet their minimum needs for human development, with priority to mothers and children, older people and the disabled. Emergency care is owed by any establishment, public or private, for as long as a grave risk to life or health lasts. The contributory layer is separate: social-security cover through INSS is compulsory for employed resident foreigners and open voluntarily to the self-employed.

In detail

Need, not nationality

The General Health Law never asks who you are. Its object is the right of every person to enjoy, keep and recover their health; its principle of universality guarantees coverage to the whole population; and the sixteen rights in article 8 belong to users of the health sector, public and private, with a non-discrimination clause that lists race, social class, sex, economic position, ideology, political or trade-union affiliation, type of illness and any other condition. The line that does the rationing is drawn by need instead: free treatment in the public sector is guaranteed for the vulnerable, and vulnerable means those without the resources to meet their minimum needs for human development. A newly arrived foreigner with money is outside that definition, and so is a Nicaraguan with money.

Emergencies are owed by private hospitals too

Numeral 15 of article 8 obliges any health establishment, public or private, to give emergency medical and surgical care while the grave risk to life or health persists. It is one of the few places in the law where a duty falls squarely on a private provider, and the article says the regulation sets both the criteria for classifying an emergency and the terms on which the establishment gets paid. The duty is to stabilise, not to treat indefinitely: it lasts as long as the grave risk does.

The contributory layer turns on residence

Social security is a separate system with its own membership rule, and the rule names residence. Article 5 of the Social Security Law makes insurance compulsory for nationals and resident foreigners in an employment relationship, however the engagement is framed and whatever the size of the employer, and extends it to Nicaraguans and resident foreigners working in diplomatic missions and accredited international organisations. A foreigner working without residence is outside it, which is a consequence of their migration status rather than of anything in the social-security law. Article 6 opens a voluntary scheme to professionals, the self-employed, employers and former compulsory members, and does not restrict it by nationality.

Country-level policy

Since the Digesto Jurídico laws of 2017 onwards, Nicaragua republishes its statutes as consolidated texts, subject by subject, each approved on a date and published in La Gaceta later. The consolidation date is a hard edge: everything enacted after it is simply not in the text, and the page gives no sign of what has happened since. The migration law's consolidated text was closed on 28 February 2023 and published on 18 January 2024, which is why it still defines the pensioner category by reference to a law repealed in August 2024. The same service carries superseded consolidations alongside current ones - the Constitution has a March 2024 consolidation and a February 2025 integral text at different addresses, with different article numbers for nationality.

Practical notes

The statement that the health law contains no nationality test rests on reading its articles 1 to 9 and searching the consolidated text for extranjero: the two hits are about coordinating foreign organisations' health activities and about donations from foreign institutions, neither about patients.

Nothing here says what a hospital will in fact charge a foreign visitor. The law's free-provision rule is written around need, and we have not read a tariff.
