Svalbard Is Part of Norway, and the Immigration Act Says in Four Words That It Does Not Apply There

Section 6 of the Immigration Act ends a paragraph with the sentence Loven gjelder ikke for Svalbard - the Act does not apply to Svalbard. There is no visa for Svalbard, no residence permit, no work permit and no quota, because the statute that would create them stops at the mainland. Svalbard is also outside Schengen: article 14 of the 1999 agreement associating Norway with the Schengen acquis says the agreement does not apply to Svalbard, and the 1957 Nordic passport agreement printed at the back of the Immigration Act defines a Nordic state as Norway except Svalbard and Jan Mayen. What governs entry instead is a five-section regulation of 1995 on rejection and expulsion, under which the Governor may turn away a person who cannot support themselves or look after themselves, and a 2022 regulation under which a traveller must present a passport valid for entry to Norway when the Governor asks. None of that is a permit, and the Svalbard Treaty gives nationals of the contracting parties an equal right of access and residence subject to local law. What the archipelago does not carry is the rest of the welfare state: the National Insurance Act lets an existing member keep membership on moving there and admits a non-member only through work for a Norwegian employer, and the Patient and User Rights Act has not been extended to Svalbard at all.

Topics it changes

What it requires

  • A passport valid for entry to Norway, to be presented on the Governor's demand
  • Enough money to support yourself, or you may be turned away
  • A Schengen visa for the mainland, if your nationality needs one, because reaching Svalbard means crossing a Schengen external border
  • Membership of the National Insurance scheme before you go, or employment by a Norwegian employer there, if you want health cover

At a glance

Where the Immigration Act applies
Not on Svalbard

Utlendingsloven § 6 fourth paragraph. The King may make rules on control of travellers to and from Svalbard, and has.

Residence permit or visa for Svalbard
Neither exists. The 1995 regulation on rejection and expulsion is the whole of the entry regime and creates no permission

Forskrift 3. februar 1995 nr. 96, sections 1 to 5, read in full.

Schengen
Does not apply. Article 14 of the 1999 association agreement excludes Svalbard by name

And the 1957 Nordic passport agreement defines a Nordic state as Norway except Svalbard and Jan Mayen.

What can get you turned away
Among seven grounds: no sufficient means or no lawful way of supporting yourself there, and being unable to look after yourself

Forskrift 1995 nr. 96 § 1 first paragraph letters a and c. Letters b, d, e, f and g cover a standing expulsion, suspicion or conviction for offences, failing to show a passport, and public health or public order.

Minimum period of an expulsion
Two years

Forskrift 1995 nr. 96 § 2 second paragraph. The ban may be permanent or time-limited but not shorter than two years.

Document required of a traveller
A passport valid for entry to Norway, as defined in the Immigration Regulation

Forskrift 29. april 2022 nr. 643 § 4 second paragraph, which borrows the mainland regulation's passport conditions.

How Norwegian law reaches Svalbard at all
Private law, criminal law and procedure apply; everything else only where specifically provided

Svalbardloven § 2. It is the rule that explains every other entry here.

National Insurance
An existing member keeps membership on settling there; a non-member becomes one only by taking work for a Norwegian employer operating there

Folketrygdloven § 2-3. Residence on Svalbard does not by itself make anyone a member.

Patient rights
The Patient and User Rights Act has not been extended to Svalbard. What exists is a duty on Helse Nord RHF to provide emergency preparedness and other health services so far as necessary and appropriate given local conditions

Forskrift 22. juni 2015 nr. 747 § 3 first paragraph, read against its sections 2 and 3 which list the health legislation that does apply.

Tax
A separate Act, with rates the Storting sets each budget term, and residence from the start of a stay of at least twelve months

Svalbardskatteloven § 1-1, § 1-2 and § 2-1. The mainland 270-day residence test is disapplied for a person resident on Svalbard.

Nationality law
Applies. The Nationality Act says so in its own section 1

Statsborgerloven § 1 second paragraph. Its residence condition in § 7 first paragraph letter e counts residence held on residence permits, and Svalbard issues none.

What the instruments do and do not say

They say there is no permit, no visa and no quota, and that the Governor may turn a person away on seven stated grounds, of which the first is not having the means to stay or a lawful way of supporting themselves. They say a traveller must show a passport valid for entry to Norway when asked. They say nothing at all about how long a person may remain, and no provision read for this record sets a maximum period of stay. What they also do not answer is the question most people arrive with - whether a person may simply go and settle - because the texts regulate removal rather than admission, and a right not to be removed is not the same as a right to be there. The Treaty's article 3 gives nationals of the contracting parties an equal right of access and residence subject to the local laws and regulations, and the local laws and regulations are the 1995 regulation.

Getting there crosses a Schengen border

Svalbard is outside Schengen but the flights go through Tromso or Oslo, which are not. A traveller whose nationality requires a Schengen visa needs one to reach the mainland airport, and on the way back from Svalbard enters the Schengen area afresh. The archipelago's openness is therefore real in law and conditional in practice on being able to get to it, which is a distinction no summary of the Treaty makes.

The parts of the state that did not follow

Svalbardloven section 2 says other statutory provisions do not apply unless specifically provided, and the consequence is visible across this record. The National Insurance Act does extend there, and in a shape that keeps an existing member covered and admits a newcomer only through a Norwegian employer. The Patient and User Rights Act does not extend there at all; what the 2015 health regulation creates is a duty on a regional health authority measured against local conditions. The Tax Act gives way to a separate Svalbard Tax Act. The Nationality Act does extend, but counts residence held on residence permits, which Svalbard does not issue.

The Union's legal database. Publishes each act as adopted in the Official Journal and, separately, a consolidated version carrying every amendment to a stated date, identified as 0YYYYRNNNN-YYYYMMDD. The consolidated text marks each amended passage with the instrument that changed it.

Standing: Maintains the text in force

Cannot be cited for: A consolidated text is explicitly not authentic - EUR-Lex says so on the document - and only the Official Journal version has legal force. It also says nothing about how any member state applies the act: a regulation is directly applicable but the border practice, the evidence an officer may ask for and the national exceptions are in national law, which is published elsewhere.

About this source

Norway's legal information service, and the body that physically produces Norsk Lovtidend, the official gazette. Lovdata is not a ministry: it is a private foundation, established on 1 July 1981 by the Ministry of Justice and the Faculty of Law at the University of Oslo, and its own English page says so. Forskrift 21. juni 1994 nr. 644, made under section 4 of the Norsk Lovtidend Act, authorises the Ministry to contract with stiftelsen Lovdata for the use of Lovdata's statute and regulation databases, and gives the State a right to take those databases over if the foundation is wound up - so the databases are the foundation's, held under an arrangement with the State. The 1992 circular on publication in Norsk Lovtidend instructs ministries to send material for publication to Norsk Lovtidend, c/o Lovdata. Four kinds of address matter and they are different documents. /dokument/NL/lov/<date>-<nr> and /dokument/SF/forskrift/<date>-<nr> are Lovdata's consolidated texts of Acts and central regulations; appending /* to either serves the whole instrument, and without it the address returns only a table of contents and an editorial blurb. /dokument/<...>/KAPITTEL_n serves one chapter. /LTI/lov/<date>-<nr> is the instrument as published in Norsk Lovtidend, which is the official text. /dokument/NLE/ and /dokument/SFE/ are unofficial English translations. The free-text search at /sok?q= is readable by the extraction service and is the practical way to find an instrument whose number is unknown; /referanse/hjemmel?dokID=NL/lov/<date>-<nr> lists every regulation made under a given Act. The treaty register at /traktat/<date>-<nr>, which Lovdata administers for the Ministry of Foreign Affairs, carries Norwegian texts of treaties with metadata naming the authentic language.

Standing: Maintains the text in force

Cannot be cited for: **The consolidated texts are not the official text.** Norsk Lovtidend is what lov 19. juni 1969 nr. 53 § 1 requires to be published for public account, and section 3 of that Act ties an Act's commencement to the date of the issue of Norsk Lovtidend that announced it. A consolidation under /dokument/NL/ or /dokument/SF/ is the foundation's editorial product: reliable, universally used, and not the enacted words. Where it matters, the as-promulgated text is at the /LTI/ address and should be read instead. **No consolidation carries a sweep date.** The metadata block prints Sist endret with the last amending Act folded in, and a Rettet line recording editorial corrections, and neither is a statement that the text was checked as at a day - so no consolidatedAsOf can honestly be taken from a Lovdata page. **The amendment notes are Lovdata's, not the legislature's**: the small numbered blocks under each section are the foundation's apparatus and must not be quoted as enacted text, though they are the only readable record of what a repealed section used to say. **The consolidation prints provisions not yet in force beside those in force**, marked only by a note saying Endres ved forskrift ... i kraft <date>; section 10-1 of the Driving Licence Regulation carries one for 1 January 2027. **The English translations at /dokument/NLE/ and /dokument/SFE/ are not the instrument and must never be quoted as one**: Lovdata's own page states that the translations are not official, that they are provided for information purposes only, and that in the event of any inconsistency the Norwegian version shall prevail; the translations are produced by ministries rather than by Lovdata. **The bare /dokument/NL/lov/<date>-<nr> address is not the law**: it serves a table of contents and a Kort om loven blurb written by Lovdata, and a reading taken from it contains no section text at all - the Immigration Act at that address is 38,290 characters of navigation, against 431,640 at the same address with /* appended. **It cannot be cited for anything an agency does.** The skilled-worker quota, what counts as pay for a work permit, what counts as sufficient means, the Svalbard tax rates and the student tuition levels are all left by the instruments to a directorate, a ministry or the Storting, and none of those decisions is published here.

The Act also applies to Svalbard and Jan Mayen.

Nationality law reaches Svalbard where immigration law does not. Its residence condition counts time held on residence permits, and no residence permit exists there.

Practical notes

The Svalbard Treaty is quoted here from the Norwegian text in the Ministry of Foreign Affairs' treaty register, administered by Lovdata. The register's own metadata gives the original title as Traité concernant le Spitsberg, so the authentic text is French and the Norwegian is a rendering. The French text was not read.

Whether a person may go and stay indefinitely is not answered by any instrument read for this record. The 1995 regulation creates grounds for removal and no permission; no provision setting a maximum stay was found, and the absence of one is not the same as a stated right to remain.

The Governor's own guidance and the local Longyearbyen residence rules were not read. Anything the administration does beyond the regulations quoted here is not visible from these texts.

The rate of Svalbard tax is not given. Section 1-2 of the Svalbard Tax Act leaves it to the Storting's decision for each budget term, and that decision is published in Norsk Lovtidend rather than as a regulation in Lovdata's free database.
