Trabajador Residency for Employees and Contractors

Answer

The general rule applies to you

No exception is recorded for citizens of Guyana on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

81 exceptions recorded across 33 countries · none match Guyana to Peru · Residency through work

One year of renewable residency for a foreigner with a job in Peru. What gates the application is the contract: it must already be approved by the labour authority, be for a year or more, and be no more than 30 days old when you file. A contract with a probation period or a shorter term does not fail - it is redirected to the temporary worker status instead. Unusually for the region, the same category covers the self-employed: a services contract plus an active tax registration is enough, with no employer at all.

At a glance

Length of permission
365 days, renewable
Minimum contract term
1 year
Contract age limit at filing
30 calendar days

Migraciones states this twice and differently: 30 días calendario on the change-of-status page, 30 días hábiles on the visa page. Calendar days is the shorter of the two and the safer assumption.

Labour authority approval
Required before the migration application
Self-employment accepted
Yes, on a services contract plus an active RUC
Fee - visa from abroad

Stated on Migraciones' change-of-status page, paid under code 07568.

Shorter or probationary contract
Goes to temporary worker status instead

Requirements

  • For employees: an employment contract approved by the administrative labour authority, for a term of one year or more
  • The contract must be no more than 30 calendar days old at the point of filing
  • The hiring company must appear as active and locatable on SUNAT's taxpayer register
  • A sworn declaration from the company's legal representative naming you, with the registry entry proving the signatory may hire staff
  • For the self-employed: a services contract of a year or more and an active, locatable RUC tax registration in your own name
  • No police, criminal or judicial record in your country of origin or in countries you lived in over the previous five years
  • Applying as a visa from abroad requires you to be outside Peru; changing status from inside requires a regular migration situation
  • If the contract was signed in Peru you must already hold a status that permits it, or a special permit to sign documents

In detail

The employer test is light by regional standards

Colombia asks the employer to show average monthly income of a hundred minimum wages over four months and to justify in writing why a Colombian is not doing the job. Argentina requires the employer to be registered in RENURE before the application can even be filed. Peru asks that the company be active and locatable at SUNAT and that whoever signed the contract had authority to do so. The weight sits on the contract's form - approved, at least a year, under 30 days old - rather than on the company's size or on a labour-market test.

Freelancers are inside the category, not outside it

The same status covers someone on a services contract with an active RUC in their own name. That makes Peru the only one of the four countries covered here where independent work has a straightforward residence route rather than being pushed towards an investor, income or business category. The services contract still has to run for a year or more, and the tax registration still has to be active and locatable, so this is a documented arrangement rather than an absence of one.

Country-level policy

How Leaving Peru Ends Your Residency

Every Peruvian residence status, including the indefinite ones, is lost by a long enough absence - and the test is continuous absence, not a quota of days you must spend here. More than 183 consecutive days out of the country in a 365-day period, counted from your first departure, ends the status. There is a permit that suspends the rule, and it has to be applied for before the 183 days are up, which is the part that is usually discovered too late.

The Interpol Record Check and the Rulings About It

Most changes of migration status from inside Peru, and every naturalisation application, require a Ficha de Canje Internacional - a record check issued by Interpol's Lima office, valid for six months. Peru's competition authority twice declared it an illegal bureaucratic barrier, and a Lima court then suspended those rulings at the interior ministry's request. Migraciones has been asking for it again since June 2024. The practical lesson is that Peruvian procedure requirements can be removed and reinstated by bodies other than the one running the procedure.

What applies to you

Nothing changes for a citizen of Guyana

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

What the law says

«Permite al extranjero a realizar actividades lucrativas de forma subordinada o independiente para los sectores públicos o privados, en virtud de un contrato de trabajo, relación administrativa o contrato de prestación de servicios.»

Our translation - not official

Allows the foreigner to carry out profit-making activities in a subordinate or independent capacity for the public or private sectors, by virtue of an employment contract, an administrative relationship or a services contract.

'Independiente' and 'contrato de prestación de servicios' are the words that make this category cover freelancers. Argentina and Colombia both route the employed and the self-employed differently.

Our translation - not official

It is granted by virtue of an employment contract previously approved by the Ministry of Labour.

'Previamente' is the sequencing rule: the labour ministry approves the contract before Migraciones sees the file, so the migration application is the second step, not the first.

Our translation - not official

In the case of an independent worker, the foreign person must hold an active and locatable Single Taxpayer Register (RUC) number.

'Habido' is a SUNAT status meaning the taxpayer can be found at the address on file. It is checkable online, and it is the condition most likely to be quietly failing.

Grants and adjudicates migration status and naturalisation, and publishes the procedure pages with fees, channels and decision times.

Standing: Applies the rule

Cannot be cited for: Not the text of the law - its pages are the agency's restatement and routinely disagree with both the legislative decree and its regulation on tourist extensions and on family permit duration. It carries thresholds that exist nowhere else and therefore cannot be corroborated; treat those as claims by the agency. Its two pages on the same regional agreement give different nationality lists, so no single page is safe as the list.

«Si el contrato contempla periodos de prueba o el plazo sea inferior a 1 año, corresponde su evaluación como un procedimiento administrativo de solicitud de calidad migratoria trabajador temporal.»

Our translation - not official

If the contract contains probation periods or its term is less than 1 year, it is to be assessed as an administrative procedure for temporary worker migration status.

A probation clause alone is enough to move the file, regardless of the contract's overall length - a detail that costs an application if the employer's standard template includes one.

Practical notes

Migraciones publishes two procedures with different requirement lists: a visa applied for from outside Peru and a change of status from inside. The change of status also requires an Interpol record check and is the more document-heavy of the two.

The change-of-status page states that the procedure is personal and does not admit a representative, while the visa procedure does admit one on the terms of Decreto Supremo 002-2021-IN.

Renewal is by extension for the same period, applied for through the same digital agency.

For holders of a student or religious status there is a separate instrument - the extraordinary work permit - rather than a change of category; it is described under the student topic.
