Portugal builds every temporary residence permit on one list. Article 77 asks for ten things at once, and the first is a valid residence visa granted for one of the purposes the Act names, or a job-seeker visa - so the permit is the second step, not the first. The rest are the absence of anything that should have stopped the visa, presence in Portugal, means of subsistence as fixed by ministerial order, accommodation, social security registration where applicable, no conviction for a crime punishable here by more than a year, no live entry ban, and no alert in either of two information systems. The employed route then adds two: a contract made under the law and registration with social security. What it also carries is unusually generous - the holder may change employer by notifying the agency, and may move to self-employment by replacing the title.

«Sem prejuízo das condições especiais aplicáveis, para a concessão da autorização de residência deve o requerente satisfazer os seguintes requisitos cumulativos: a) Posse de visto de residência válido, concedido para uma das finalidades previstas na presente lei para a concessão de autorização de residência, ou posse de visto para procura de trabalho; b) Inexistência de qualquer facto que, se fosse conhecido pelas autoridades competentes, devesse obstar à concessão do visto; c) Presença em território português, sem prejuízo do disposto no n.º 6 do artigo 58.º; d) Posse de meios de subsistência, tal como definidos pela portaria a que se refere a alínea d) do n.º 1 do artigo 52.º; e) Alojamento; f) Inscrição na segurança social, sempre que aplicável; g) Ausência de condenação por crime que em Portugal seja punível com pena privativa de liberdade de duração superior a um ano; h) Não se encontrar no período de interdição de entrada e de permanência em território nacional, subsequente a uma medida de afastamento; i) Ausência de indicação no SIS; j) Ausência de indicação no SII UCFE para efeitos de recusa de entrada e de permanência ou de regresso, nos termos dos artigos 33.º e 33.º-A.»

«Para além dos requisitos gerais estabelecidos no artigo 77.º, só é concedida autorização de residência para exercício de actividade profissional subordinada a nacionais de Estados terceiros que tenham contrato de trabalho celebrado nos termos da lei e estejam inscritos na segurança social. 2 - (Revogado.) 3 - (Revogado.) 4 - A concessão de autorização de residência nos termos dos números anteriores é comunicada pela AIMA, I. P., por via eletrónica, à Inspeção-Geral do Trabalho ou, nas regiões autónomas, à respetiva secretaria regional, de modo que estas entidades possam fiscalizar o cumprimento de todas as obrigações legais da entidade patronal para com o titular da autorização de residência, bem como à administração fiscal e aos serviços competentes da segurança social.»

Practical notes

This is the ordinary employed route. Portugal has separate articles for self-employment and entrepreneurs, teaching and highly qualified activity, investment, students, researchers, trainees and volunteers, and none of them is read here.

The Act has been amended repeatedly and recently - the articles quoted carry changes down to Lei n.º 61/2025 - and the agency that administers it, AIMA, replaced its predecessor in 2023. Volatility is set to active-story for that reason.
