The Bank Checks Your Alien Registration Card, and the Foreign Exchange Act Decides at Six Months Whether You Count as Living Here

Two statutes decide what a foreigner can do with a Korean bank, and neither mentions a visa category. The Act on Real Name Financial Transactions and Confidentiality requires a financial company to deal only in a customer's real name, and article 3(4) of its Enforcement Decree says what a foreigner's real name is: the name and registration number on the alien registration record kept under the Immigration Act, or - where no alien registration card has been issued - the name and number on a passport or identity document. That proviso matters, because it means the Act itself does not make alien registration a precondition for an account; it makes it the ordinary form of identification and names the fallback. The second statute is the Foreign Exchange Transactions Act, which runs its own residence test and gets a different answer from the tax law. Article 3(1)14 defines a resident as an individual with a domicile or a place of residence in Korea, and article 10(1)4 of the Enforcement Decree then deems a foreigner to be one if they are engaged in business activity in Korea or have been staying here for six months or more - not the 183 days the Income Tax Act counts, and not counted the same way. Going the other way, article 10(2)6(c) turns a foreigner who was a resident into a non-resident once they have been abroad for three months. Resident or non-resident is what decides which accounts, which transfers and which reporting duties apply, and the Overseas Koreans Act gives holders of F-4 with a domestic residence report the rights of a Korean national who is a resident under the Foreign Exchange Transactions Act - except for the capital-transaction reporting in article 18 of that Act, which is carved out by name.

What a bank must verify
The customer's real name, as defined for a foreigner by the alien registration record or, failing that, a passport or identity document

Article 3(1) of the Act on Real Name Financial Transactions and Confidentiality and article 3(4) of its Enforcement Decree.

Immigration status as a condition of an account
None stated in the Act on Real Name Financial Transactions and Confidentiality or its Enforcement Decree

Article 3(4) of the Enforcement Decree names the alien registration record first and a passport or identity document as the fallback where no card has been issued. Neither instrument refers to a status of residence.

When a foreigner becomes a resident for foreign exchange
On engaging in business activity in Korea, or after six months of stay

Article 10(1)4 of the Enforcement Decree of the Foreign Exchange Transactions Act.

When a foreign resident becomes a non-resident again
After three months abroad

Article 10(2)6(c) of the Enforcement Decree of the Foreign Exchange Transactions Act.

How that compares with the tax test
Six months of stay here, against 183 days in the Income Tax Act

Article 10(1)4 of the Enforcement Decree of the Foreign Exchange Transactions Act against article 1-2(1)1 of the Income Tax Act. The two statutes run separate residence tests and a person can be resident for one and not the other.

Overseas Koreans with a domestic residence report
Treated as a Korean national who is a resident, except for capital-transaction reporting

Article 12 of the Act on the Immigration and Legal Status of Overseas Koreans, which carves out article 18 of the Foreign Exchange Transactions Act.

Family members
Classified as the person whose income mainly supports them

Article 10(3) of the Enforcement Decree of the Foreign Exchange Transactions Act.

Requirements

  • Identification in your real name: the alien registration record, or a passport or identity document where no alien registration card has been issued
  • Classification as a resident or a non-resident under the Foreign Exchange Transactions Act, which follows from business activity in Korea or six months of stay

In detail

Two residence tests, two different answers

Korea runs a residence test in the Income Tax Act and another in the Foreign Exchange Transactions Act, and they do not agree. The tax test turns on a domicile, or on 183 days of residence counted from the day after entry and capable of being met across two tax years. The foreign exchange test turns on a domicile or place of residence, which the Enforcement Decree then deems present for a foreigner engaged in business activity in Korea or staying six months or more. A foreigner who arrives in October and leaves in April is resident for tax and not for foreign exchange; a foreigner who starts work on arrival is resident for foreign exchange on day one and not for tax until the 183rd day. Nothing in either statute reconciles them, and the classification that governs a bank transfer is the second one.

The real-name rule names a card and then names the alternative

Article 3(4) of the Enforcement Decree of the real-name Act identifies a foreigner by the registered-foreigner record kept under the Immigration Act, which is the alien registration card in practice. The proviso that follows is what a short-stay reader needs: where no alien registration card has been issued, the real name is the name and number on a passport or identity document. So the statute does not make the card a condition of a financial transaction. What a particular bank asks for beyond the statute is a matter for that bank, and no bank's terms were read for this record.

Practical notes

No bank's account-opening conditions were read. Everything here is from the two statutes and their Enforcement Decrees, and a bank's own requirements are a fact about that bank rather than about Korean law.

The 외국환거래규정, the Minister's regulation made under the Foreign Exchange Transactions Act that sets out the account types available to a resident and a non-resident, was not located or read. It is where the practical difference between the two classifications is written.

Article 18 of the Foreign Exchange Transactions Act, the capital-transaction reporting the Overseas Koreans Act carves out, was not read in full.

The Act on Reporting and Using Specified Financial Transaction Information, which carries the anti-money-laundering identification duties banks apply alongside the real-name rule, was not read.

Three address shapes matter and only the third serves text. https://www.law.go.kr/법령/<name> is a 1.2 KB iframe shell; /LSW/lsInfoP.do?lsiSeq=<N>&chrClsCd=010202&urlMode=lsInfoP&efYd=<YYYYMMDD>&ancYnChk=0 is a second shell with the chrome but no articles; THE BODY IS AT /LSW/lsInfoR.do?lsiSeq=<N>&chrClsCd=010202&efYd=<YYYYMMDD>&ancYnChk=0, which answers an ordinary request and was read for this corpus with `pnpm sources:fetch --direct`. The lsiSeq is version-specific, so an address taken this way is pinned to the consolidation it was read from, which is why every citation of it carries a cut-off. Attached tables (별표) are not in the body: /LSW/lsBylContentsInfoR.do?bylSeq=<B>&lsiSeq=<N> returns hanFlSeq and pdfFlSeq, and https://www.law.go.kr/LSW/flDownload.do?flSeq=<pdfFlSeq> is the table as a PDF with a text layer. The site also carries the government's English translations at /LSW/eng/engLsInfoR.do?lsiSeq=<N>, keyed to the English version's own lsiSeq rather than the Korean one.
