Six Months Before You May Buy In, Unless Your Status Is One of Four - and the Bill Falls Due Before the Month You Are Paying For

National Health Insurance is compulsory in Korea and article 109 of the National Health Insurance Act is the article that decides how a foreigner gets into it. Employment is the easy route: a foreigner working at a covered workplace becomes an employee-insured person automatically, with no waiting period, provided they are on the resident register, have reported a domestic place of residence as an overseas Korean, or have completed alien registration under article 31 of the Immigration Act. Everyone else has to qualify as a self-employed insured person under article 109(3), and that is where the waiting period lives. The Act does not state it: it delegates both the period and the grounds to a Ministry of Health and Welfare ordinance, and article 61-2(1) of the Enforcement Rules fills in six months or more - or, instead of the six months, one of four statuses that are taken as evidence of continuous residence from the start: permanent residence under article 10(2) of the Immigration Act, non-professional employment E-9, marriage migration, and whichever study or general training statuses the Minister designates by notice. A second table, Attached Table 9 of the same Rules, lists the statuses that can be self-employed insured at all - the D, E, F, H families, plus G-1 limited to humanitarian-stay permission holders and persons the Service designates. Since 2 January 2024 a dependent of an employee-insured foreigner has had to meet the same residence test, with the spouse and children under nineteen excepted by name. Two things then apply to a foreign self-employed insured person and to nobody else: the contribution is due by the 25th of the month before the month it covers, where everyone else pays by the 10th of the month after; and arrears stop benefits from the day of the arrears until the debt is cleared, with the reliefs other debtors get switched off. The Constitutional Court found that last rule incompatible with the Constitution on 26 September 2023, and the statute carries the amendment that followed, dated 22 October 2024, in a note under the article.

At a glance

Waiting period before a foreigner may be a self-employed insured person
Six months or more of residence in Korea

Article 61-2(1) of the Enforcement Rules of the National Health Insurance Act, which fills in the period article 109(3)1 of the Act leaves to a ministerial ordinance.

Statuses that skip the six months
Permanent residence, non-professional employment E-9, marriage migration, and the study or general training statuses the Minister designates by notice

The four grounds in article 61-2(1)1 to 4 of the Enforcement Rules. They are drafted as alternatives to the period, not exemptions from the insurance.

Employee insured
No waiting period at all

Article 109(2) of the National Health Insurance Act. It imposes registration conditions and no period of residence.

Dependants of an employee-insured foreigner
Must meet the same residence test, except the spouse and children under 19

Article 109(4)3 of the Act, added on 2 January 2024. The exception names the employee's spouse and children under nineteen, including the spouse's children.

When the contribution falls due for a foreign self-employed insured person
By the 25th of the preceding month

Article 109(8) of the Act. Article 78(1) puts everyone else's contribution for a month on the 10th of the month after it, so the foreign subscriber pays about sixteen days before the month begins and everyone else ten days after it ends.

Effect of arrears on a foreign self-employed insured person
No benefits from the day of the arrears until the arrears are paid in full

Article 109(10) of the Act. The sentence then disapplies the proviso to article 53(3) and the whole of article 53(5) and (6), which are the instalment and retrospective-recognition reliefs available to other debtors.

Constitutional Court
Article 109(10) was held incompatible with the Constitution on 26 September 2023 and amended on 22 October 2024

The note printed under article 109 in the state's consolidated text says so, and the same amendment added paragraph 11 allowing a Presidential Decree to provide differently in the light of a person's status and period of stay.

Statuses eligible for the self-employed route
The D, E, F and H families, with G-1 limited to humanitarian-stay permission holders and persons the Service designates

Attached Table 9 of the Enforcement Rules of the National Health Insurance Act, as amended on 4 October 2024. B and C statuses - the visitor statuses - do not appear.

Opting out
Possible only where equivalent cover exists under foreign law, foreign insurance or a contract with the employer, and only on an application

Article 109(5)2 of the Act. The application is made by the employer or the insured person under a ministerial ordinance, not granted automatically.

Requirements

  • Alien registration under article 31 of the Immigration Act, a domestic place-of-residence report as an overseas Korean, or resident registration
  • Employment at a covered workplace - which makes you employee-insured with no waiting period
  • or six months of residence in Korea, or one of the four statuses the Enforcement Rules treat as proof of continuous residence
  • and a status of residence listed in Attached Table 9 of the Enforcement Rules, for the self-employed route
  • No exclusion request on file from you or your employer on the basis of equivalent foreign cover

In detail

The waiting period is not in the Act

Article 109(3)1 of the National Health Insurance Act says a foreigner qualifies as a self-employed insured person if they have resided in Korea for the period prescribed by Decree of the Ministry of Health and Welfare, or fall within grounds prescribed by the same Decree for expecting continuous residence. Both halves are blank in the statute. The number - six months or more - is in article 61-2(1) of the Enforcement Rules, which a reader of the Act alone will never see, and the four grounds that replace it are in the same sentence. That is also where a change would happen: a ministerial ordinance moves faster than an Act, and the period has moved before.

What the four alternative grounds have in common

Permanent residence, E-9 non-professional employment, marriage migration and the designated study statuses are not exemptions from insurance - they are ways of proving at the outset what six months of residence would otherwise prove. Each is a status that in practice means the holder is staying. The effect is that the people most likely to need cover early, including workers brought in under the employment permit system and spouses of Korean nationals, are insured from the start, while a self-funded resident on another status waits half a year.

Two rules that apply to foreigners and to nobody else

Article 78(1) puts a month's contribution on the 10th of the following month. Article 109(8) moves a foreign self-employed subscriber's to the 25th of the preceding month - paying in advance rather than in arrears, a difference of about five weeks in working capital. Article 109(10) then removes the cushion: arrears stop benefits from the day they arise until they are cleared, and the instalment arrangement and the retrospective recognition of treatment received during a suspension, both available under article 53 to a Korean debtor, are switched off by name. The statute itself records that this was taken to the Constitutional Court and lost: a note under the article says the paragraph was amended on 22 October 2024 to give effect to a finding of unconstitutionality made on 26 September 2023, and a new paragraph 11 now lets a Presidential Decree soften it according to status and length of stay. That Decree was not read for this record.

Visitors are not in the table

Attached Table 9 of the Enforcement Rules lists which statuses may hold self-employed insured status at all, and the list begins at D-1 and runs through the E, F and H families, with G-1 cut down to holders of humanitarian-stay permission under the Refugee Act and persons the Service designates. Nothing in the B or C families appears, so a visitor admitted under a visa exemption or for tourism has no route into National Health Insurance however long they stay - which is consistent with those statuses being capped at 90 days in the first place.

Exceptions by origin

No exceptions recorded

Nothing we have read treats any nationality differently for this topic. The rule above applies to everyone.

It cannot be cited as the text of a Korean statute; the Korean at law.go.kr is. Four divergences were found in a single country's reading and all four change the rule: the English of 소득세법 제1조의2(1)1 attaches 183 days to both the domicile and the residence limb where the Korean attaches it only to the second; the English of 소득세법 시행령 제4조(3)1 says "exceeds 183 days" where the Korean says 183일 이상, 183 or more; the English of 출입국관리법 제18조(1) says a status entitling the holder to "job-seeking activities" where the Korean says 취업활동, employment activity, job-seeking being a different status in the same table; and the English of 재외동포법 제5조(2) makes the military-service bar lapse automatically from 1 January of the year the man turns 41, where the Korean makes it a discretion the Minister of Justice may exercise from that date. **It also lags.** Each translation states the Act it renders: the Immigration Act is translated at Act No. 20677 of 21 January 2025 while the Korean in force on 2 October 2026 is Act No. 21857, and the Enforcement Decree of the Immigration Act is at Presidential Decree No. 35540 of 27 May 2025 against No. 36728 in force. **It does not carry the attached tables** - every Appendix is referred to and none is reproduced - so the status-of-residence lists exist only in Korean. **No translation exists at all for 출입국관리법 시행규칙**, the Enforcement Rules, which carry the stay-period table and the marriage-visa criteria. **Its pages are English with Korean furniture**: the string 법령보기 화면 is printed as a table caption before every article, hundreds of times per document, so a reading from this publisher is a Latin text carrying a non-Latin script in place and `audit:readings` flags every quotation taken near one.

Practical notes

No contribution rate or amount is stated here. The Act fixes rates through a separate Presidential Decree and the Service's own schedules, and neither was read.

The Minister's notice designating which study or general training statuses count under article 61-2(1)4 of the Enforcement Rules was not located or read, so which D-2 and D-4 holders skip the six months is not established here.

The Presidential Decree made under article 109(11), which may provide differently for arrears according to status and length of stay, was not read. Until it is, what the post-2024 position actually is for a particular status cannot be stated from this record.

Constitutional Court decision 2019헌마1165 and the other cases behind the 26 September 2023 finding were not read; what is recorded here is the publisher's note printed under article 109.

Nothing published by the National Health Insurance Service was read. Everything here is from the Act, its Enforcement Rules and the attached table, with the Korea Legislation Research Institute's English translation of the Act shown beside the Korean.

NATIONAL HEALTH INSURANCE ACT - Statutes of the Republic of Korea

    Korea Legislation Research Institute

    About this source

The state-funded research institute that produces and hosts the English translations of Korean statutes, at elaw.klri.re.kr under the title Statutes of the Republic of Korea. Its own statistics page counts 3,070 current translations - 1,593 statutes, 1,389 enforcement decrees, 3 enforcement rules and 83 others - against 21,044 former ones. Two addresses matter: /eng_service/lawView.do?hseq=<N>&lang=ENG is the frame, which carries the disclaimer and nothing else, and /eng_service/lawViewContent.do?hseq=<N>&lang=ENG is the text. The hseq identifies a particular translated version of a particular statute, so it behaves like a pinned address. Its own search is broken for an ordinary client: /eng_service/lawTotalSearch.do, /eng_service/lawAllSearch.do and /eng_service/lawTotalSearchList.do?type=abc all answer HTTP 500 with a Java NullPointerException. **The route that works is a POST to /eng_service/lawNameList.do with page=1, searchType1=korean and searchValue=<the Korean statute name>**, which returns the Korean and English titles with their hseq. A session cookie from /eng_service/main.do is required for anything on the site.

    Standing: Reports, establishes nothing

Cannot be cited for: **Its translations are not law and it says so on every statute page**: "* Translations provided here are for reference only, and are neither official nor legally effective. * The links provided by an automatic program for the convenience of users may have some errors." It cannot be cited as the text of a Korean statute; the Korean at law.go.kr is.
