It answers only the questions actually referred to it. Sentenza 63/2026 disposed of the challenges brought by the Turin tribunal and no others, so 'upheld' means upheld against those arguments. Different arguments in later cases remain open, and practitioners continue to bring them.

Hearings are scheduled in advance and rulings are deposited weeks after decision - sentenza 63/2026 was decided 11 March, deposited 30 April, published 6 May. A pending referral therefore has a knowable window rather than an unknown one.
