One Movement Regime Reaches Belgium, and the Act Gives It a Chapter of Its Own
Answer
The general rule applies to you
No exception is recorded for citizens of Haiti on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.
116 exceptions recorded across 45 countries · none match Haiti to Belgium · Residency under a regional treaty
Title II, chapter I of the Act of 15 December 1980 is a separate statute inside the statute. A Union citizen may stay three months with no condition or formality beyond the document named in article 41, and may stay longer if they work or are looking for work with a real chance of being engaged, or have resources sufficient not to become a burden on social assistance together with sickness cover, or are enrolled in an educational establishment. The resources are not a figure: the Act pegs them to the level below which a person would qualify for social assistance, judged on the individual's own circumstances. No treaty gives nationals of any Latin American or Caribbean state a right to enter and stay in Belgium on nationality. What the Union decides for a reader of this corpus is the visa at the border, and nothing after it.
At a glance
- A regional movement treaty that reaches the Americas
- None in the Act of 15 December 1980, whose only movement chapter is the Union one
Title II, chapter I of the Act is the Union regime; the Act has no other chapter conferring a right of entry on nationality.
- Who the Union chapter covers
- Nationals of a member state of the European Union, and their family members
Article 40, § 2, of the Act of 15 December 1980.
- Short stay for a Union citizen
- Three months, with no condition or formality beyond the document in article 41
Article 40, § 3.
- Longer than three months
- Work, job-seeking with a real chance of being engaged, sufficient resources with sickness cover, or enrolment in study
Article 40, § 4, first paragraph.
- How much is sufficient
- At least the level below which the person would qualify for social assistance, judged on their own circumstances
Article 40, § 4, second paragraph. The Act states a test rather than an amount.
- What is decided at Union level for everyone else
- The visa, the customs relief on a move, and the floor under the right to a basic account
What applies to you
Nothing changes for a citizen of Haiti
We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.
What the law says
«Pour l'application de la présente loi, un citoyen de l'Union est un étranger»The definition, and it is nationality of a member state and nothing else.

Belgium's consolidated federal legislation, served from the Moniteur belge site at two stable address forms: an ELI of the shape /eli/<type>/<yyyy>/<mm>/<dd>/<numac>/justel, and the older /cgi_loi/change_lg.pl query carrying the dossier number. Each record prints the date the consolidation is updated to, lists its archived versions, and marks in the body which amending Act inserted which words, with the Act identified in footnotes under the article.
Standing: Maintains the text in force
Cannot be cited for: The site is behind a web application firewall. A direct request from this project is answered with a JavaScript challenge page and a support ID, never the document, and the Bright Data proxy is refused at the CONNECT stage; only the extraction service returns text, and even then it refused two records outright - the French text of the Wetboek van economisch recht and the Code des impôts sur les revenus by its dossier number - while serving the Dutch and ELI forms of the same instruments. It may not be cited for the income tax code at all: the record for the Code des impôts sur les revenus 1992 states that updating was suspended in 2002, shows the text as at 9 April 2010, and carries no text of the Code. Dutch and French are both authentic and a Justel record serves one of them; a quotation from one says nothing about the wording of the other. Several instruments are printed as parallel regional versions of the same article - federal, Flemish, Walloon, Brussels, German-speaking Community - so an article number alone does not identify a text. The consolidations are unofficial: the Moniteur belge as published governs. Nothing regional is here: decrees and ordinances of the Regions and Communities, which decide work authorisations and self-employment, are published elsewhere.

The Union's legal database. Publishes each act as adopted in the Official Journal and, separately, a consolidated version carrying every amendment to a stated date, identified as 0YYYYRNNNN-YYYYMMDD. The consolidated text marks each amended passage with the instrument that changed it.
Standing: Maintains the text in force
Cannot be cited for: A consolidated text is explicitly not authentic - EUR-Lex says so on the document - and only the Official Journal version has legal force. It also says nothing about how any member state applies the act: a regulation is directly applicable but the border practice, the evidence an officer may ask for and the national exceptions are in national law, which is published elsewhere.

Practical notes
This record says what is not there. The movement answer for a reader of this corpus is on the entry, work and family records.
Belgium has bilateral social security agreements with several states of the region. Those belong to the topic they govern and none was read here.
