Opening a Bank Account in Guatemala

Opening an account is written into Guatemalan law as a right of residence rather than as a procedure. The 2025 residence regulation lists it among the rights every temporary or permanent resident has, alongside staying lawfully, leaving and re-entering, acquiring property and taking a domicile. The Migration Code goes further for migrant workers and their families: they may bring their assets into the country and transfer money from accounts abroad into accounts duly accredited in the Guatemalan banking system, and no official may restrict that outside what the law already provides. What none of the instruments we read says is what a bank asks for at the counter, or whether a non-resident can open an account at all.

Requirements

  • A residence status, which is what the regulation attaches the right to an account to
  • In practice, the Documento Personal de Identificación issued to a domiciled foreigner, which the national persons registry issues off the migration institute's permanent-resident register
  • For a rentista or pensioner, a Guatemalan account is one of three accepted ways of proving every five years that the income continues

In detail

A right, not a procedure

Guatemala is unusual in naming bank accounts in an immigration instrument at all. Article 45 of the residence regulation lists nine rights of residence and the seventh is opening bank accounts in the country; article 32 of the Migration Code gives migrant workers and their families the right to move money in and out through authorised banking procedures and tells officials not to obstruct it. Both are statements about what the state may not prevent. Neither is a statement about what a bank must accept, and a bank's own account-opening conditions are a fact about that bank rather than about Guatemalan law.

What we could not establish

We did not find a Guatemalan primary source setting out the identification a bank must collect from a foreign customer. The Ley de Bancos y Grupos Financieros, read at the central bank's own publication of it, authorises banks to take deposits and says nothing about customer onboarding; the know-your-customer rules live in the anti-money-laundering legislation and its regulations, which we did not read. So the practical question - can a tourist open an account, and what does a resident have to bring - is open in our record, and a confident answer to it would have to come from the banking supervisor or from the anti-money-laundering regulation rather than from anything here.

The article's limits are health, judicial proceedings preventing the assets leaving, and asset-forfeiture procedures; it closes by saying no official may burden or limit the right beyond what has already been established by legislative or administrative provision or by court order.

Practical notes

The negative claim here is bounded: it rests on the Reglamento de Residencias Guatemaltecas articles 1 to 60, the Migration Code articles 1 to 246, and the Ley de Bancos y Grupos Financieros as published by the Banco de Guatemala. It does not rest on a reading of the anti-money-laundering law, Decreto 67-2001, or its regulations, which is where customer identification rules would be.

A rentista or pensioner has a reason to open a Guatemalan account that goes beyond convenience: statements from one are the first of the three ways article 46 lets them prove their income continues, and the only one that does not require certification abroad or at an embassy.

A permanent resident's identity document is issued by the Registro Nacional de las Personas from the migration institute's register, under article 80 of the Migration Code. That is the document a bank is likely to key off, and it is a foreigner's document rather than evidence of nationality.
