Guatemala charges in quetzales but writes its migration fees in United States dollars. The fee schedule sets each amount in dollars and then authorises the migration institute to fix, once a quarter, the reference exchange rate at which those dollars are converted - an average of the Banco de Guatemala selling rate over the first twenty days of the last month of the previous quarter. So a residence permit has a fixed price in dollars and a price in quetzales that moves four times a year, and any quetzal figure quoted anywhere has a shelf life of three months.

A recurring condition in Guatemalan immigration practice has no equivalent in the other eleven countries covered here: for several of the routes a foreigner actually uses, a Guatemalan individual or a Guatemalan company has to register as a guarantor and take responsibility. It is needed for a consulted tourist visa, for employment-based temporary residence, for athletes, artists, researchers and academics, for permanent residence after five years as a temporary resident, and even for a foreigner's driving permit. The guarantor registers with the migration institute's Subdirección de Extranjería before the application is made, and has to prove income. Guatemala's own regulation says the detail lives in a separate rulebook on the ordinary-status register, which we have not read.

On 21 May 2025 the director of the migration institute issued three new regulations at once - on visas, on residence permits and on the register of ordinary migration status - and the National Migration Authority approved them two days later. In October the fee schedule was rewritten to match. The old visa and residency regulations, from 2022 and 2023, were repealed outright. Nothing written about Guatemalan immigration before the autumn of 2025 is describing the rules that now apply, and the practical consequences are real: the income thresholds for a foreign-employer worker and for a rentista, the hundred-thousand-dollar investor test and the separate Central American price for permanent residence all live in the new texts.

Guatemala treats nationals of its Central American neighbours differently at every stage, and the preferences are scattered across four instruments rather than gathered in one. At the border a Central American enters on a national identity card. After one year of temporary residence - not five - someone born in another Central American country can apply for permanent residence, and pays two hundred dollars less for it than anyone else. The labour code's rule that nine in ten employees must be Guatemalan can be relaxed where Central Americans by origin are concerned. And the Constitution goes further than any immigration rule could: a national by birth of a republic of the old Central American Federation who takes up domicile in Guatemala and says before the authorities that they wish to be Guatemalan is a Guatemalan of origin, keeping their first nationality.

Ninety days on arrival, one extension of the same length, and a hard ceiling of a hundred and eighty days counted from the day you entered. Whether you need a visa at all depends on which of three buckets your nationality sits in - exempt, consular visa, or a visa the consulate has to clear with the migration institute first - and the buckets are regional rather than Guatemalan: the four CA-4 countries agreed in 2005 to run one classification between them. Two shortcuts move people between buckets: a valid United States, Mexican, Canadian or Schengen visa, and three continuous years of residence in a visa-exempt country. The ninety days are regional too. They are granted once, at the first border post into the four-country area, and they run down whether you spend them in Guatemala, El Salvador, Honduras or Nicaragua.

Guatemala's route for someone living on income rather than work is the rentista permanent residence, and it is unusual in two ways. It is permanent from the first day - there is no probationary temporary stage to serve first - and it is closed to anyone who intends to earn here: the regulation's own words are that the applicant decides to stay "without engaging in any kind of paid activity". The income has to be generated outside Guatemala, has to be permanent and lawful, and the regulation sets a monthly floor with a smaller additional amount for each dependant. The rentista definition is a closed list of six kinds of income - foreign bank deposits and investments, foreign company holdings, remittances from real estate or religious or academic support, and three categories of securities - and income that is not on it is not rentista income.

A pensioner takes the same permanent residence as a rentista, under the same article and against the same monthly figure, but the definition is narrower and easier to prove: money received periodically by way of retirement, widowhood, orphanhood, incapacity or social security, from governments, international organisations or foreign private companies. There is no age condition anywhere in it. The status is permanent from the first grant, carries an indefinite term, and bars paid work in Guatemala. Every five years the holder has to show the pension is still arriving, and the regulation accepts a Guatemalan bank account, a certified statement from the paying institution, or a statement certified by the applicant's own embassy in Guatemala.

Two quite different people hold the same Guatemalan status. One has a Guatemalan employer, a job offer letter and a registered Guatemalan guarantor, and needs a separate work permit from the labour ministry within three months of the residence being granted. The other has a foreign employer, needs no Guatemalan guarantor and no job offer, and qualifies on bank statements showing a minimum monthly remuneration from abroad over the last year - more if dependants come too. Both are "migrant workers" under article 75 of the Migration Code, both get between one and five years, and both run into the labour code's quota: nine in ten employees of a Guatemalan business must be Guatemalan, and they must take at least eighty-five per cent of the payroll.

The investor residence is a temporary one of up to five years, and the test is a single amount: the applicant has to show membership of one or more commercial structures and/or investment in the acquisition of movable or immovable property, for an amount of a hundred thousand dollars. The regulation does not prescribe a particular vehicle. It takes registry certifications, title to securities, invoices for property, plant and equipment, evidence of where the funds came from, or anything else, and it asks for a notarised sworn statement describing the economic activity and how long the applicant expects to stay. Renewal needs only a further sworn statement that the activity has continued, with documents behind it.

The student residence is the one temporary status in Guatemala that is not capped at five years. Every other category has to convert to permanent residence to go past five; a student may keep renewing for as long as the studies last. The term granted matches the school cycle or the length of the university courses rather than being a number of years chosen by the applicant, and what has to be shown is an enrolment or acceptance letter from an officially recognised institution plus proof that someone - the student, a sponsor, a scholarship or an institutional funder - will pay for it. Children of someone applying for any temporary residence can get student status on a parent's declaration alone, and may attend school while it is being processed.

Guatemala has no residence category built on an ancestor's nationality in the way Italy or Spain do, and it does not need one at the first level: the Constitution makes the child of a Guatemalan father or mother a Guatemalan of origin wherever they were born, so that person does not apply for residence at all. Beyond that, what exists is a permanent residence for relatives of a Guatemalan "within the degrees of law", granted on documentary proof of the relationship with no waiting period and no prior temporary stage. The phrase that decides how far the route reaches - "dentro de los grados de ley" - is used by the Migration Code and by the residence regulation and defined by neither.

A year of registered marriage or declared de facto union with a Guatemalan is a ground for permanent residence outright - no temporary stage, no probationary renewals. Both the marriage and the union have to be entered in the national registry, and the Guatemalan spouse's birth certificate has to carry the annotation of it. Before that year is up the marriage still does something: six months of registered marriage moves a consular-visa nationality to visa-exempt and a consulted-visa nationality to consular. The spouse of a Guatemalan can also apply for a work permit in their own name rather than through an employer, and pays nothing for it. If the marriage ends, the status does not simply lapse - but it does have to be ratified, and ratification means qualifying for some other kind of permanent residence.

There is a regional residence route into Guatemala, but it is not the one people name. CA-4 is about movement: its convention says in terms that the single Central American visa does not carry residence with it, and its manual regulates the entry and stay of people who are not nationals of the four countries at all. What actually shortens a Central American's path to residence is Guatemalan domestic law. Someone born in another Central American country reaches permanent residence after one year of temporary residence instead of five, and pays two hundred dollars less for it. Entry is on a national identity card rather than a passport, on a reciprocity basis, and for CA-4 nationals the identity card has worked by air as well as by land since 1997.

Guatemala has two doors, and they are not the same door at different speeds. Naturalisation is the ordinary one, and the Constitution delegates its terms entirely to a statute - the conditions, the residence period and the procedure are not in the Constitution and are not in the Migration Code either. The other door is constitutional and far wider than any naturalisation: a national by birth of a republic of the old Central American Federation who takes up domicile in Guatemala and declares before a competent authority that they wish to be Guatemalan is a Guatemalan of origin, not a naturalised one, and may keep their first nationality. Residence itself carries the right to opt for nationality, and a resident who obtains it has to go back to the migration institute and cancel their residence.

Guatemala taxes territorially. Income tax reaches income obtained in the national territory, and the law's own catalogue of what counts is a catalogue of Guatemalan-source income - sales here, services between Guatemala and elsewhere, rent from property here, interest paid by residents here. Residence matters for how that income is taxed and for which chapter of the law applies, not for whether foreign income is swept in. The statute defines a tax resident by two tests, and the one we can quote is the centre of economic interests, which can be displaced by a tax-residence certificate from another country's tax authority. Separately from the tax law, holding a temporary residence carries an annual filing obligation of its own: residents have to produce a tax-compliance certificate every year.

Opening an account is written into Guatemalan law as a right of residence rather than as a procedure. The 2025 residence regulation lists it among the rights every temporary or permanent resident has, alongside staying lawfully, leaving and re-entering, acquiring property and taking a domicile. The Migration Code goes further for migrant workers and their families: they may bring their assets into the country and transfer money from accounts abroad into accounts duly accredited in the Guatemalan banking system, and no official may restrict that outside what the law already provides. What none of the instruments we read says is what a bank asks for at the counter, or whether a non-resident can open an account at all.

Two systems, and only one of them has a door a newcomer can walk through. Public health services rest on a constitutional right held by every inhabitant without discrimination, and the Migration Code reinforces it for particular groups - any migrant woman, documented or not, has equal access to sexual and reproductive and maternity services, and refugee applicants get access to health services from the moment they are placed in temporary residence. Contributory social security is the other system, run by the Instituto Guatemalteco de Seguridad Social, and it is reached through employment: the employer registers the worker, and a foreign worker must produce a copy of the labour ministry work permit to be registered. Nothing we read opens IGSS to a rentista, a pensioner or an investor who has no Guatemalan employer.

What a foreigner gets is a permiso de conducir, not a licence, and it is priced by the month rather than by the year. The traffic department issues it to someone who is at least in the process of applying for temporary residence, which makes it one of the few Guatemalan procedures open before a status is granted. The file is heavy in one particular way: it needs a Guatemalan by origin to stand as guarantor, to swear that they are not already guaranteeing another foreigner, and to accept responsibility for the damage the applicant causes while driving, backed by three months of bank statements showing a minimum closing balance. A current foreign licence is translated and accepted; an expired one or none at all means a theory and practical test at an approved academy.

Everything turns on one distinction the customs administration makes over and over: traveller's baggage, which is personal effects you could reasonably need for your own use or your trade during the trip, and goods other than baggage, which is everything else and pays tax. The administration's own examples are blunt - one laptop is baggage, the second and third are not; one phone is baggage, the four you are carrying for relatives are not. Every traveller arriving or leaving by air or sea, national or foreign, files the regional traveller's declaration, now electronic and fillable up to three days ahead. Baggage can travel separately within three months either side of the trip. What we did not find anywhere is a household-goods concession for someone moving to Guatemala: exemptions exist, but only where a specific law grants one.
