A pensioner takes the same permanent residence as a rentista, under the same article and against the same monthly figure, but the definition is narrower and easier to prove: money received periodically by way of retirement, widowhood, orphanhood, incapacity or social security, from governments, international organisations or foreign private companies. There is no age condition anywhere in it. The status is permanent from the first grant, carries an indefinite term, and bars paid work in Guatemala. Every five years the holder has to show the pension is still arriving, and the regulation accepts a Guatemalan bank account, a certified statement from the paying institution, or a statement certified by the applicant's own embassy in Guatemala.

In detail
Narrower than it looks, and wider than it looks
The definition is narrower than "anyone retired": the money must be periodic and must come from a government, an international organisation or a foreign private company, so an individual drawing down their own savings is a rentista rather than a pensioner and has to meet the rentista definition instead. It is also wider than "anyone old": widowhood, orphanhood and incapacity pensions are expressly in, and no article states a minimum age. The regulation separates rentistas and pensioners in the definitions and then applies the same monthly figure to both.
The five-year proof is designed around pensions
Article 46 gives three alternatives for the five-yearly evidence, and all three are shaped for someone drawing a foreign pension: statements from a Guatemalan bank account into which the social-security or other income is paid; a printed social-security statement or a bank statement from the country of origin certified by the paying institution; or such a statement certified by the applicant's embassy in Guatemala together with a sworn declaration that it is a true copy. The first of these is the reason many pensioners open a Guatemalan account whether or not they need one.
Country-level policy
Guatemala charges in quetzales but writes its migration fees in United States dollars. The fee schedule sets each amount in dollars and then authorises the migration institute to fix, once a quarter, the reference exchange rate at which those dollars are converted - an average of the Banco de Guatemala selling rate over the first twenty days of the last month of the previous quarter. So a residence permit has a fixed price in dollars and a price in quetzales that moves four times a year, and any quetzal figure quoted anywhere has a shelf life of three months.
On 21 May 2025 the director of the migration institute issued three new regulations at once - on visas, on residence permits and on the register of ordinary migration status - and the National Migration Authority approved them two days later. In October the fee schedule was rewritten to match. The old visa and residency regulations, from 2022 and 2023, were repealed outright. Nothing written about Guatemalan immigration before the autumn of 2025 is describing the rules that now apply, and the practical consequences are real: the income thresholds for a foreign-employer worker and for a rentista, the hundred-thousand-dollar investor test and the separate Central American price for permanent residence all live in the new texts.

This is one of the five grounds for permanent residence in article 78. The income has to come from abroad; the regulation adds that the holder may not take up paid work in Guatemala.

It is understood, as a special rule for the rentier or pensioner permanent resident status, that all the benefits and exemptions regulated in the specific regulation for these cases shall be applicable to Guatemalans by origin who have naturalised in other countries and who return as pensioners or retirees of governments or private entities.

Practical notes
No instrument we read sets an age for this status. If an agency applies one in practice, it is not in the Migration Code or in the 2025 residence regulation.
The exemptions promised to returning Guatemalans by article 78 are not quantified anywhere we read. The article delegates them to a specific regulation for rentistas and pensioners, and the 2025 residence regulation does not contain a schedule of them.
A pensioner may not take paid work in Guatemala on this status. Someone who wants to work has to change residence type under article 50, which means meeting the requirements of the new category from scratch.
