Guyana has no residence route for people with Guyanese roots, because for the first generation it does not need one: article 44 of the Constitution makes a person born outside Guyana a citizen at birth if either parent was a citizen at that date, and either parent means either, with no requirement that the parent was born in Guyana. What article 44 also says is that the parent must be a citizen "otherwise than by virtue of this article", which stops the chain dead at one generation: a grandchild of a Guyanese, born abroad to a parent who was also born abroad, is not a citizen and has no claim. There is no registration route for a grandchild either. The practical consequence is binary. If a parent was Guyanese you are already Guyanese and the question is documentary; if only a grandparent was, you are in the same position as anyone else and your route is the ordinary permit followed by naturalisation.

In detail

Either parent, one generation

Article 44 is unusually clean for a Caribbean descent provision. It names the father or the mother with no priority between them, it dates from the 1980 Constitution rather than from a later amendment, and it imposes no condition that the transmitting parent was born in Guyana. Compare Barbados, where the second limb added in 2000 requires the parent to have been born on the island. What article 44 does share with its neighbours is the closing phrase: the parent must be a citizen otherwise than by virtue of the same article, which means a parent who acquired citizenship by descent abroad has nothing to pass on. Two generations abroad ends the line.

Nothing fills the gap below

Several countries in this comparison soften that cut-off with a registration route for grandchildren or with an ancestry visa. Guyana has neither. Chapter IV of the Constitution offers registration only to a person married to a citizen or, before 1980, married to one of those who continued as citizens. The Citizenship Act offers registration to a Commonwealth citizen or an Irish citizen after five years of ordinary residence, to the stateless on narrow grounds, and to minor children of citizens; it offers naturalisation to aliens on residence. None of those has a descent limb. A grandchild of a Guyanese arriving to reconnect with the country arrives as a foreigner.

What the first generation actually has to do

A person within article 44 is already a citizen and does not apply for citizenship; they apply for the documents that prove it. The revenue authority's re-migration policy puts it plainly from the other direction when it notes that Guyana recognises as citizens by descent the children of Guyanese by birth wherever those children are born. The practical work is therefore the parent's birth certificate and proof of the parent's citizenship, and a passport application rather than a naturalisation application.

Practical notes

Article 46 lets the President deprive a citizen of citizenship who has voluntarily acquired another citizenship by registration, naturalisation or another formal act, expressly excluding marriage. It is a discretion rather than an automatic loss, and we did not find any instrument or policy saying how or whether it is used. Anyone naturalising elsewhere should treat this as live rather than dead.
