Pensioners Are a Category in the Lottery, Not a Route of Their Own

Answer

The general rule applies to you

No exception is recorded for citizens of Austria on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Austria to Liechtenstein · Residency as a retiree

Liechtenstein has no retirement visa. A pensioner from an EEA state applies on exactly the terms anyone without work applies on - means enough not to need social assistance and sickness insurance covering every risk - and the ordinance then names them explicitly as part of the group drawn in the lottery for people not in gainful activity. That group shares the 0.5 per cent quota the EEA Agreement provides for the non-active, and the agency puts the number drawn at eight a year. What does exist, and is worth separating from the route in, is a right to stay on: an EEA national who reaches pension age while employed in Liechtenstein, having worked there the last twelve months and lived there three years, is entitled to a permanent residence permit before the usual five years are up. A third-country pensioner has no corresponding route at all, only the special-interest permit of article 20 of the aliens act.

At a glance

A dedicated retirement route
None. Pensioners are named inside the non-active group in PFZV article 23(2)(b), and the aliens act has no retirement category at all

We read PFZG articles 15 to 28, PFZV articles 23 to 31 and AuG articles 13 to 22. The only non-working route for a third-country national in the aliens act is the special-interest permit of article 20.

Test for an EEA pensioner settling
Means enough to avoid social assistance, and sickness insurance for all risks

PFZG article 22(1)(b) and (c). No amount is stated.

Permanent residence on retiring in Liechtenstein
Before the five-year rule, on reaching pension age with twelve months’ work in Liechtenstein and three years’ residence

PFZG article 25(1)(a). Article 25(4) counts employment completed in another EEA state or in Switzerland as if completed in Liechtenstein.

Permanent residence on becoming permanently unfit for work
After two years’ uninterrupted residence, or immediately where the incapacity is from a work accident or occupational disease giving a right to a Liechtenstein pension

PFZG article 25(1)(b) and (c).

Spouse of a Liechtenstein national
The right to remain applies regardless of how long the residence or employment lasted

PFZG article 25(2), which also covers a spouse who lost Liechtenstein citizenship by the marriage.

Requirements

  • EEA or Swiss nationality for the ordinary route - means enough that no social assistance is drawn, and comprehensive sickness insurance covering all risks in Liechtenstein
  • In practice a place in the draw for the group of persons not in gainful activity, in which pensioners are named
  • For the right to remain after retiring in Liechtenstein: pension age under Liechtenstein law or early retirement, employment in Liechtenstein over the last twelve months, and three years of uninterrupted residence on a valid residence permit

What applies to you

Nothing changes for a citizen of Austria

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

What the law says

«Auslosungsverfahren werden für folgende Bewerbergruppen durchgeführt: a) erwerbstätige Personen (unselbständig und selbständig Erwerbstätige); b) nicht erwerbstätige Personen (erwerbslose Wohnsitznahme, Rentner).»

Our translation - not official

Draws are held for the following groups of applicants: a) persons in gainful activity (employed and self-employed); b) persons not in gainful activity (settling without work, pensioners).

This is the whole of Liechtenstein’s law on retirees moving in: they are the second half of a two-item list in the lottery ordinance.

EEA nationals with a residence permit for pursuing a gainful activity in Liechtenstein have a right to the grant of a permanent residence permit before the expiry of the period in article 24(1) where they: a) at the time they give up their employment have reached the age prescribed by Liechtenstein legislation for claiming an old-age pension, or end their employed activity under an early retirement scheme, and were in gainful activity in Liechtenstein in the last twelve months and have resided uninterruptedly in Liechtenstein for at least three years on a valid residence permit; b) have given up employment as a result of permanent incapacity for work and have resided uninterruptedly in Liechtenstein for at least the last two years; c) have become permanently incapable of work because of an accident at work or an occupational disease and therefore have a right to a pension from a Liechtenstein insurance institution; or d) after three years of uninterrupted gainful activity and uninterrupted residence in Liechtenstein pursue an employed or self-employed activity in another EEA member state but retain their residence in Liechtenstein and return there as a rule every day or at least once a week.

A right to remain, not a right to arrive. It is the Union’s right to remain after employment, carried into Liechtenstein law.

The same provision a non-working person of any age relies on. There is nothing in it about age.

Practical notes

The absence of a retirement route is recorded from the two statutes themselves: the free-movement act names pensioners only in the ordinance’s list of draw groups and in the right-to-remain article, and the aliens act contains no category for a person living on a pension.

The eight permits a year drawn for people not in work cover pensioners and other non-active applicants together. The agency does not break the figure down.
