Ten Years, a Language Test and Release From Your Old Passport - And the Investment Programme That Lapsed on 31 December 2022 Without Ever Being Repealed

Answer

The general rule applies to you

No exception is recorded for citizens of Lithuania on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Lithuania to Montenegro · Becoming a citizen

Ordinary naturalisation is article 8 of the Zakon o crnogorskom drzavljanstvu and it is demanding. The applicant must be in accordance with the interests of Montenegro, be 18, hold a release from the citizenship of the other state, have resided in Montenegro lawfully and continuously for ten years before the application, have accommodation and a permanent source of income giving material and social security, have no final unconditional sentence over one year at home or abroad for an offence prosecuted ex officio, know Montenegrin to an extent allowing basic communication, present no security or defence obstacle, and have settled tax and other statutory obligations. The release is excused only for a stateless person or for one who shows he will lose his citizenship by being admitted to Montenegro's. Two shorter routes sit beside it: article 10 gives a Montenegrin emigrant and a family member to the third degree in the direct line two years, and article 11 gives a spouse of at least three years who has resided lawfully and continuously for five years a route without the language test, the ten years or the release, extended since 2010 to a widow or widower of a three-year marriage and since 3 August 2026 to a partner in a same-sex life partnership. And then there is article 12, the discretion the economic programme was built on: an adult - since December 2019 simply a person - whose admission is of particular importance for the state, scientific, economic, cultural, sporting or other interest of Montenegro may exceptionally acquire citizenship even without meeting article 8 at all, with the Ministry deciding on the opinion of the sector authority and, for the state and other interest, on a proposal from the President, the Speaker or the Prime Minister. The criteria are a Government decision made under article 17, whose article 3 names investing capital by founding a company, directly investing capital or donating funds, and being a top proven expert or investor of indisputable international standing; article 3a, added in 2016, allows that investment or donation to be made through a special investment programme. That programme was the citizenship-by-investment scheme. The decision setting it up was made on 22 November 2018 and its article 18 said in terms that it would apply from 1 January 2019 to 31 December 2021, with no more than 2,000 applications granted. On 30 December 2021 the Government extended it by exactly one year, substituting 31 December 2022 for 31 December 2021. Nothing extended it again. It was never repealed either - the gazette still records it as in force - and the June 2023 decision that kept the intermediary and suitability agents' licences alive did so only until decisions are taken on applications lodged by 31 December 2022. The enabling criteria in article 3 and article 3a survive, and the Government was still moving responsibility for them between ministries in November 2025, so the discretion remains; the programme built on it does not.

The official gazette of Montenegro, published by the public institution JU Sluzbeni list Crne Gore, which also runs the country's legal information system (PIS). Everything the Montenegrin state enacts appears here and only here as an authentic text: Acts of the Skupstina with the President's promulgating decree printed above them, Government decrees and decisions, ministerial rulebooks, Constitutional Court decisions, and separate series for municipal regulations, international treaties and the predecessor Sluzbeni list Republike Crne Gore up to 2006. Each instrument has a record page at https://www.sluzbenilist.me/propisi/<id> which is server-rendered and carries, in plain text, the date of publication, the gazette issue, the registry number, the issuing body, the date of entry into force and often the date of first application, the EU negotiating chapter it belongs to, and the status Vazeci or Nevazeci - in force or no longer in force. The same page cross-links the instruments this one amends, the instruments that amend it, the constitutional provisions it was made under and the subordinate acts made under it, which is the cheapest way in existence to assemble a Montenegrin amendment chain. The text itself is a PDF at https://www.sluzbenilist.me/propisi/<id>/download, one file per instrument rather than one per issue. Issues are indexed by year at https://www.sluzbenilist.me/registri?type=0&year=<year> with type 0 for Sluzbeni list Crne Gore and type 3 for the pre-2006 Republican series, and each issue page lists every instrument in it with a link. Article 13 of the Constitution puts the Cyrillic and Latin scripts on an equal footing and the gazette uses both: some Acts of 2010 and 2011 and some Government decisions are printed wholly in Cyrillic, and a /cyr/ mirror of the site exists. Amending Acts are published as free-standing instruments in the classic civil-law form - 'in article N, paragraph M is replaced and reads' - and are never consolidated into the parent Act here, so the current text of a provision has to be assembled from the base Act and every amendment that touched it.

Standing: Issues the instrument

Cannot be cited for: It publishes instruments and it does not consolidate them. There is no consolidated text of any Act on this site: the regis.sluzbenilist.me legal information system that would give one is an Angular application that returns a 6 KB shell to any fetcher, and its own feature table reads as a subscription product, so it is not reachable by any tool this project has. Assembling the law in force therefore means reading the base Act plus every amending Act, and the site's own cross-reference list cannot be relied on to be complete - the record for the Zakon o crnogorskom drzavljanstvu lists four of its seven amending Acts, the record for the Zakon o porezu na dohodak fizickih lica lists ten of at least sixteen, and the record for the citizenship-by-investment decision lists none at all because the record is classified 'Neklasifikovan'. The site search is client-side only: the search box on /propisi is an Alpine.js model and a searchTerm query parameter is ignored by the server, which returns a generic list, so an instrument is found through the issue index, through a cross-link on a related record, or through an external search engine. Some record identifiers are UUIDs rather than numbers and those do not answer at /download. Two of its own PDFs are defective and must not be quoted from: the Zakon o bezbjednosti saobracaja na putevima (33/2012) extracts with a broken character map - Cyrillic a, e and o standing inside Latin words, C-circumflex for C-caron, t-cedilla for z-caron - through the body of the Act while the penalty articles come out clean, and downloading the file directly or passing it through the extraction service makes no difference. It must not be cited for anything the state has not enacted: it carries no guidance, no fee a ministry charges in practice, no processing time, no country list maintained outside a decree, and nothing at all about how an authority applies the text it prints. The status field is a useful signal and not a legal conclusion: the citizenship-by-investment decision is still marked Vazeci although its own article 18 stopped applying on 31 December 2022.

An adult person whose admission to Montenegrin citizenship is of particular importance for the state, scientific, economic, cultural, financial, sporting or other interest of Montenegro may, exceptionally, acquire Montenegrin citizenship by naturalisation even if he does not meet the conditions of article 8 of this Act. Admission to Montenegrin citizenship under paragraph 1 of this article is decided by the Ministry of the Interior and Public Administration with the opinion of the administrative authority responsible for the field referred to in paragraph 1 of this article.

'Punoljetno lice' was replaced by 'lice' - adult person by person - by article 1 of the amending Act of 23 December 2019 (Sluzbeni list CG 73/19), and the reference to the Ministry by name was replaced by a reference to the state administration body responsible for internal affairs by the amending Act of 30 July 2016.

Admission to Montenegrin citizenship for the state and other interest of Montenegro is decided by the Ministry of the Interior and Public Administration on the basis of a proposal of the President of Montenegro, the Speaker of the Parliament of Montenegro or the Prime Minister of Montenegro.

This amending Act was published in the Cyrillic script, which article 13 of the Constitution puts on an equal footing with the Latin script. The gazette's own line breaks fall inside words, and the hyphenation in this quotation is the publisher's.

About this source

Practical notes

The question whether the programme was repealed or lapsed is not academic. It lapsed: its own article 18 fixed a period of application, that period was extended once by a year, and the gazette still records both the decision and its amendments as in force. Nothing was struck from the statute book, so the text reads as live law to anyone who opens it and does not read to the end.

The discretion survives the programme. Article 12 of the Act and article 3 of the criteria decision are untouched, article 3a still allows investment or donation through a special investment programme, and in November 2025 the Government was still reassigning which ministry opines on economic interest. What does not exist is a programme, a price or a procedure under it.

Three instruments in this chain are published in Cyrillic and two of them are quoted here in that script. The Constitution puts the two scripts on an equal footing, so this is the publisher's text and not a defect in our reading.

Figures reported for the programme while it ran - the payment to less developed municipalities, the minimum investment in a development project, the 1,000,000 euro bank guarantee, the 100,000 euro innovation payment and the 50,000 euro cost for a child born during the programme - are in articles 10, 11 and 13 of the decision and its amendments, which we read. They are not stated as key facts here because no one can apply for the programme.
