Buying a Flat Really Does Get You Residence - And Since 17 January 2026 the Flat Has to Be Assessed at 150,000 Euros

The thing Montenegro is marketed for is in the Act in terms. Article 38(1)(8) of the Zakon o strancima makes 'using and disposing of a right to immovable property which he owns in Montenegro' a ground of temporary residence, and article 56 is the permit: it may be issued to a foreigner who meets the general conditions of article 43 and, as proof that the application is justified, attaches a land-register extract or another proof under the cadastre law confirming ownership of that property. Article 56(3) names what counts as immovable property - family houses, holiday houses, villas, flats, catering premises, mixed residential and business buildings and business premises. Since January 2019 a co-owner of at least one half qualifies. What the route grants is small and the rest is the general law: a temporary residence permit under article 63 runs for up to one year and is renewed a year at a time, the Ministry decides within 40 days of a complete application, and the permit lapses if the holder spends more than 30 consecutive days outside Montenegro, or more than 90 even with the police told in advance. It does count towards something: article 86 lets a permanent residence permit be issued after five years of continuous lawful residence on an approved temporary residence, with absences of up to ten months in total or one of up to six months not breaking the chain, and article 88 adds a Montenegrin language test at a level allowing basic communication. And since 17 January 2026 the route has a price. Article 24 of the amending Act of 31 December 2025 added to article 56(1) a requirement to produce proof of the property's value, and defined it: a property-transfer-tax assessment issued by the local tax authority whose taxable base is not less than 150,000 euros. Nationals of European Union member states, of Iceland, Liechtenstein, Norway and Switzerland, and their family members, do not have to produce it. There is no separate investor-by-capital category anywhere in article 38; the nearest thing is a work permit, where article 70(4) now lets an entrepreneur or an executive director who owns a company outright or holds more than 51 per cent of it renew indefinitely on proof of at least 5,000 euros of tax and contributions a year.

Country-level policy

Large Parts of the Foreigners Act Are Enacted and Dormant, and Only Article 221 Tells You Which

Montenegro legislates ahead of its accession to the European Union, and the Zakon o strancima carries the result. Chapter IX, articles 150 to 178b, is a full transposition of the free-movement directive for nationals of EU member states and their family members, rewritten almost entirely by the amending Act of 31 December 2025 and touched again in March 2026. Article 1, as amended in 2026, even says that those articles govern the entry, exit, movement, residence and work of EU nationals and that the rest of the Act applies to them only where it expressly says so. None of it is in application. Article 221(1), unchanged since 2018, defers articles 150 to 203 and six other provisions to the day Montenegro accedes to the Union, and the 2026 Act added article 221b deferring a further list - electronic visa applications, agency posting of workers, several grounds of permit refusal - to the same day. For a reader the practical effect is a trap: the chapter reads as live law, it was amended twice in 2026, and the sentence that makes it dormant sits two hundred articles later under a heading about transitional provisions. An EU national today needs a ground under article 38 like anyone else, and the only EU-specific right that is in force is the exemption in article 56(5) from the property-value proof, which the 2026 Act wrote into the body of the Act rather than into the deferred chapter.

A Temporary Residence Permit Dies After Thirty Days Out of the Country Unless You Tell the Police First

Montenegro attaches a presence rule to every temporary residence permit and it is stricter than almost anything a reader will have met. Article 65(1)(3) of the Zakon o strancima says the permit ceases to be valid if, during the temporary residence, the foreigner stays outside Montenegro for more than 30 days. Article 65(2) softens it on one condition only: a foreigner who is outside Montenegro for up to 90 days for justified reasons does not lose the permit if he notifies the police of the departure and of its reasons beforehand. Beyond 90 days there is no relief at all, except for holders of a permit on the residual ground in article 38 point 13, who are exempt from the rule entirely by article 65(4). This is a continuous-absence rule rather than a quota of presence, so it bites on one long trip and not on many short ones - and it sits oddly beside article 86(3), which allows absences of up to ten months in total, or one of up to six months, across the five years that lead to permanent residence. A person who takes the six-month absence article 86 permits would lose the permit that is accumulating the five years under article 65.

The 150,000 Euro Floor on the Property Route Does Not Apply to You

Why this applies to you

When the amending Act of 31 December 2025 put a value floor under the property route, it exempted one group in the same breath. Article 56(5) of the Zakon o strancima says the obligation to supply proof of the value of the immovable property does not apply to nationals of the member states of the European Union or to members of their families, whether or not those family members are themselves nationals of member states, nor to nationals of Iceland, Liechtenstein, Norway and Switzerland. Everything else about the route is unchanged for them: ownership proved by a land-register extract or another cadastre proof, co-ownership of at least one half, the general conditions of article 43, a permit of up to one year renewed a year at a time, and five years of continuous lawful residence before permanent residence. The exemption was written into the ordinary chapter of the Act rather than into the chapter of EU free-movement rights that article 221 defers to accession, so unlike that chapter it is in force now.

  • Ownership, or co-ownership of at least one half, of immovable property in Montenegro
  • No property-transfer-tax assessment and no 150,000 euro taxable base
  • The general conditions of article 43, which apply as to everyone else

A temporary residence permit for the purpose of using and disposing of a right to immovable property which a foreigner owns in Montenegro may be issued to a foreigner who meets the conditions of article 43 of this Act and who, as proof that the application is justified, attaches a land-register extract or another proof under the law governing the cadastre of immovable property confirming ownership of that property. Immovable property within the meaning of paragraph 1 of this article means family houses, holiday houses, villas, flats, catering premises, mixed residential and business buildings and business premises.

This is the text as enacted. A new paragraph 2 was inserted in 2019 and two further paragraphs in 2026; both are quoted separately on this record.

Each instrument has a record page at https://www.sluzbenilist.me/propisi/<id> which is server-rendered and carries, in plain text, the date of publication, the gazette issue, the registry number, the issuing body, the date of entry into force and often the date of first application, the EU negotiating chapter it belongs to, and the status Vazeci or Nevazeci - in force or no longer in force. The same page cross-links the instruments this one amends, the instruments that amend it, the constitutional provisions it was made under and the subordinate acts made under it, which is the cheapest way in existence to assemble a Montenegrin amendment chain. The text itself is a PDF at https://www.sluzbenilist.me/propisi/<id>/download, one file per instrument rather than one per issue. Issues are indexed by year at https://www.sluzbenilist.me/registri?type=0&year=<year> with type 0 for Sluzbeni list Crne Gore and type 3 for the pre-2006 Republican series, and each issue page lists every instrument in it with a link. Article 13 of the Constitution puts the Cyrillic and Latin scripts on an equal footing and the gazette uses both: some Acts of 2010 and 2011 and some Government decisions are printed wholly in Cyrillic, and a /cyr/ mirror of the site exists. Amending Acts are published as free-standing instruments in the classic civil-law form - 'in article N, paragraph M is replaced and reads' - and are never consolidated into the parent Act here, so the current text of a provision has to be assembled from the base Act and every amendment that touched it.

Assembling the law in force therefore means reading the base Act plus every amending Act, and the site's own cross-reference list cannot be relied on to be complete - the record for the Zakon o crnogorskom drzavljanstvu lists four of its seven amending Acts, the record for the Zakon o porezu na dohodak fizickih lica lists ten of at least sixteen, and the record for the citizenship-by-investment decision lists none at all because the record is classified 'Neklasifikovan'. The site search is client-side only: the search box on /propisi is an Alpine.js model and a searchTerm query parameter is ignored by the server, which returns a generic list, so an instrument is found through the issue index, through a cross-link on a related record, or through an external search engine. Some record identifiers are UUIDs rather than numbers and those do not answer at /download. Two of its own PDFs are defective and must not be quoted from: the Zakon o bezbjednosti saobracaja na putevima (33/2012) extracts with a broken character map - Cyrillic a, e and o standing inside Latin words, C-circumflex for C-caron, t-cedilla for z-caron - through the body of the Act while the penalty articles come out clean, and downloading the file directly or passing it through the extraction service makes no difference. It must not be cited for anything the state has not enacted: it carries no guidance, no fee a ministry charges in practice, no processing time, no country list maintained outside a decree, and nothing at all about how an authority applies the text it prints. The status field is a useful signal and not a legal conclusion: the citizenship-by-investment decision is still marked Vazeci although its own article 18 stopped applying on 31 December 2022.

Standing: Issues the instrument

Cannot be cited for: It publishes instruments and it does not consolidate them. There is no consolidated text of any Act on this site: the regis.sluzbenilist.me legal information system that would give one is an Angular application that returns a 6 KB shell to any fetcher, and its own feature table reads as a subscription product, so it is not reachable by any tool this project has.

A permanent residence permit may be issued to a foreigner who until the day of lodging the application has lawfully and continuously resided in Montenegro for five years on the basis of: an approved temporary residence; recognised refugee status or granted additional protection under the Asylum Act, or granted asylum or subsidiary protection under the law governing international and temporary protection of foreigners. Exceptionally, a permanent residence permit may be issued to a foreigner who until the day of lodging the application had an approved temporary residence in Montenegro for less than five years continuously, where reasons of humanity so require or it is in the interest of Montenegro. A foreigner is deemed to have resided in Montenegro continuously even where within the period of five years he was absent from Montenegro several times for up to ten months in total or once for up to six months.

Practical notes

The 150,000 euro figure is not a purchase price and the Act does not say it is. It is the taxable base of the property-transfer-tax assessment issued by the municipality, which is the municipality's valuation of the property for tax. A sale contract showing a different number is not what article 56(4) asks for.

The claim that Montenegro has no investor-by-capital residence category rests on article 38(1) of the Zakon o strancima, the Act's own closed list of grounds, and on the chapter of individual permits that follows it. We read every article from 44 to 60a. The 2026 amending Act added an IT-sector employment permit and an agency-posting regime, not an investment one.

Nothing was read from an agency page, a law firm or a brochure. Every figure here is in one of the gazette instruments quoted on this record.
