There is no route into Nicaragua on passive income any more. The one that existed - residente rentista, for someone with a stable income generated abroad of at least a thousand two hundred and fifty dollars a month - was created by Ley 694 in 2009 and repealed outright by article 38 of the tourism law of 2 August 2024, which put nothing in its place. The migration law still lists the category among its permanent-residence subcategories and still defines it by reference to Ley 694, so the shell survives in the statute while the law that filled it is gone. What remains for someone living on money from outside Nicaragua is the ordinary immigrant subcategory, which asks for documentation of economic means but names no threshold, and the independent-worker subcategory, which requires a registered business rather than an income.

In detail

A tourism law closed a residence route

Article 38 of Ley 1210, the General Tourism Law published on 2 August 2024, lists six instruments it repeals. The fourth is Ley 694, the law that created the pensioned-resident and income-resident categories. Nothing in the tourism law or in its October 2024 regulation replaces them: searched end to end, the words pensionado and rentista appear in the tourism law exactly once, in that repeal. The assembly's own page for Ley 694 carries a note at the foot saying the same thing - and then goes on publishing the full text above it, thresholds and all, which is why every guide still quotes figures from a statute that has not been in force since 2024.

The category outlived the law that defined it

The migration law was consolidated to 28 February 2023 and published in January 2024, months before the repeal. It therefore still lists residente pensionado o residente rentista as the third subcategory of permanent residence and still defines it, in article 31, by reference to Ley 694. The regulation still requires an INTUR technical-committee resolution for it. So the route exists as a name in two instruments and as nothing at all in the law that gave it content. The migration directorate's own permanent-residence page is the quiet confirmation: it sets out specific requirements for the investor subcategory and for the family-link subcategory, and says nothing about pensioners or rentiers.

What is left for someone living on money from outside

Two subcategories come closest, and neither is an income route. The ordinary immigrant, article 30 numeral 1 of the law, must satisfy the directorate that they and their family can live decently in the country - a judgement with no number attached to it, which cuts both ways. The independent worker, a temporary subcategory, must produce a merchant's declaration, a municipal trading licence and tax registration, which is to say a business in Nicaragua rather than money from elsewhere. Someone whose income arrives from abroad and who intends to trade with nobody here falls between the two.

Country-level policy

A tourism law repealed the residence law for retirees, and three instruments have not caught up

On 2 August 2024 the General Tourism Law repealed six instruments, and the fourth of them was Ley 694, the statute that created the pensioned-resident and income-resident categories and the tax concessions attached to them. Nothing replaced it. The migration law and its regulation still name the categories, because the migration law's consolidated text was closed in February 2023, and the National Assembly's own page still serves the full repealed text with the repeal noted only at the foot. The practical effect runs wider than two residence routes: it reaches the household-goods franchise, the vehicle tax exemption and the building-materials concession, all of which lived in the repealed law.

A foreign resident needs an exit visa every time they leave by an outer border

Leaving Nicaragua is a procedure for a foreign resident in a way it is not for a Nicaraguan. Article 111 of the migration law says that residents leaving by the outer borders require an exit visa, on top of a valid passport and a valid residence card; the regulation makes it a form and a fee, obtainable in advance or at the border post on production of the travel document and the card. A non-resident whose stay has expired needs one too, with a fine attached. Giving up residence altogether produces a definitive exit visa. None of this is widely written down outside the instruments, and it is a recurring cost and an extra counter for anyone who travels regularly.

Every residence applicant lodges a deposit worth a return ticket

Nicaragua asks residence applicants to deposit, in cash, the real value of a return ticket to their country of origin or last residence, to cover the cost of a deportation that may never happen. The deposit is lodged once the residence is approved, is held in a Treasury account the migration directorate administers, earns the depositor no interest and is not revalued for inflation, though the directorate updates the amounts annually against air fares. It comes back on a claim made within sixty days of leaving the country for good or of acquiring Nicaraguan nationality. Several things forfeit it, including ninety days of irregular stay. Three groups are exempt: close relatives of Nicaraguans, minors, and nationals of countries with a ratified instrument and reciprocity.

Since the Digesto Jurídico laws of 2017 onwards, Nicaragua republishes its statutes as consolidated texts, subject by subject, each approved on a date and published in La Gaceta later. The consolidation date is a hard edge: everything enacted after it is simply not in the text, and the page gives no sign of what has happened since. The migration law's consolidated text was closed on 28 February 2023 and published on 18 January 2024, which is why it still defines the pensioner category by reference to a law repealed in August 2024. The same service carries superseded consolidations alongside current ones - the Constitution has a March 2024 consolidation and a February 2025 integral text at different addresses, with different article numbers for nationality.

The statement that no income route remains in force rests on four readings: the tourism law of August 2024 and its October 2024 regulation, read end to end for any replacement; the consolidated migration law; and its regulation. It is not a claim that no ministerial accord has since created an administrative route, and the migration directorate publishes no accords we have found.
