Eight Years of the Last Eleven, Unless You Earn Enough - Then Six - and the Section That Used to Demand You Give Up Your Other Passport Now Holds the Shortcut

This replaces the general rule for you

Only One Condition Falls Away, and the Eight Years Is Not It

Section 14 of the Nationality Act is narrower than it looks. For an applicant with a right of residence under chapter 13 of the Immigration Act it disapplies the condition in section 7 first paragraph letter d - meeting the conditions for permanent residence under section 62 of the Immigration Act - and substitutes a requirement of having been in the realm for the last three years with a right of residence under sections 112 to 116. It does not touch letter e, so the eight years out of the last eleven still has to be satisfied, and nor does it touch the language and citizenship-test requirement. What it removes is the separate permanent-residence test with its own self-support and social-studies conditions, which a person exercising a Union right would otherwise have to pass on top of their own right.

Section 7 of the Nationality Act gives a right to Norwegian citizenship on application: identity established, twelve years old, resident and intending to remain, meeting the conditions for permanent residence under section 62 of the Immigration Act, eight years in the realm out of the last eleven on permits of at least a year each, Norwegian speech at level B1 with the citizenship test passed, and no criminal penalty or waiting period running. Four groups count differently. A spouse or cohabiting partner of a Norwegian needs five years of the last ten, with residence and marriage together making at least seven. A Nordic citizen needs only to have been in the realm for the last two years and is excused the permanent-residence condition. Someone with a right of residence under the EEA chapter needs the last three years. And since 2022 an applicant with sufficient income in the last assessed tax year is excused the eight-year rule and needs six of the last ten instead. What is not in the Act is any requirement to give up another citizenship: section 10 used to carry one, it was repealed with effect from 1 January 2020, and the number now holds the income shortcut.

At a glance

Ordinary residence requirement
Eight years in the realm within the last eleven

Statsborgerloven § 7 first paragraph letter e. The permits must each have been for at least one year.

With sufficient income in the last assessed tax year
Six years within the last ten

Statsborgerloven § 10, in force since 1 January 2022. What counts as sufficient income is left to regulation.

Married to or cohabiting with a Norwegian citizen
Five years within the last ten, with residence and marriage together making at least seven

Statsborgerloven § 12 first paragraph. Residence time and time married may be accrued at the same time.

Nordic citizens
Residence in the realm for the last two years

Statsborgerloven § 13. The permanent-residence condition in § 7 first paragraph letter d does not apply to them either.

EEA and EFTA nationals with a right of residence
The last three years, under sections 112 to 116 of the Immigration Act

Statsborgerloven § 14. Only the permanent-residence condition falls away; the eight-year rule does not.

Language and knowledge test
Level B1 in spoken Norwegian and a pass in the citizenship test, for applicants aged 18 to 67

Statsborgerloven § 8 first paragraph. The age is measured at the time of application.

Giving up another citizenship
Not required. Section 10 of the Act, which used to require release from another citizenship, was repealed with effect from 1 January 2020

Lovdata's amendment note under the present § 10 records the repeal and the later insertion of the income rule in its place. Section 21 gives a right to reacquire Norwegian citizenship by notification to anyone who lost it by acquiring another.

Minimum age to apply in your own right
Twelve

Statsborgerloven § 7 first paragraph letter b. Children may also acquire citizenship as secondary persons under § 17.

Loss for a Norwegian born abroad
At 22, if not resident two years in Norway or seven in the Nordic countries together

Statsborgerloven § 24 first paragraph. An application to keep it must be made before turning 22.

Permanent residence first
Three years on a permit that can lead to it, with no more than seven months abroad, a pass in spoken Norwegian and in social studies, and self-support for the last twelve months

Utlendingsloven § 62 first paragraph, letters a to f. Five years and ten months abroad for protection and humanitarian permits, under the second paragraph.

In detail

The repealed section that still shapes the answer

Until 1 January 2020 Norwegian law required an applicant to be released from any other citizenship, and refused naturalisation to anyone whose other state would not let them go. That provision was section 10 of the Nationality Act. It was repealed, and in 2022 the same number was filled with something quite different - the income shortcut that cuts the residence requirement from eight years to six. A reader working from an older guide will find a section 10 that exists and says the opposite of what they expect. Section 21 is the other half of the change: anyone who lost Norwegian citizenship under the old rule has a right to get it back by notification.

Four clocks, and only one of them is the eight years

Sections 10 to 14 each disapply one or two of the conditions in section 7 and substitute their own residence period: six of ten on income, five of ten plus seven years of marriage for a spouse, the last two years for a Nordic citizen, the last three for someone with an EEA right of residence. The Nordic and EEA provisions also remove the permanent-residence condition, which matters because permanent residence is a separate three-year test of its own with its own language and self-support requirements. For an EEA national the eight-year rule is not removed at all - section 14 takes away only the permanent-residence condition - so the three years in that section are additional to, not instead of, the eight.

Country-level policy

Svalbard Is Part of Norway, and the Immigration Act Says in Four Words That It Does Not Apply There

Section 6 of the Immigration Act ends a paragraph with the sentence Loven gjelder ikke for Svalbard - the Act does not apply to Svalbard. There is no visa for Svalbard, no residence permit, no work permit and no quota, because the statute that would create them stops at the mainland. Svalbard is also outside Schengen: article 14 of the 1999 agreement associating Norway with the Schengen acquis says the agreement does not apply to Svalbard, and the 1957 Nordic passport agreement printed at the back of the Immigration Act defines a Nordic state as Norway except Svalbard and Jan Mayen. What governs entry instead is a five-section regulation of 1995 on rejection and expulsion, under which the Governor may turn away a person who cannot support themselves or look after themselves, and a 2022 regulation under which a traveller must present a passport valid for entry to Norway when the Governor asks. None of that is a permit, and the Svalbard Treaty gives nationals of the contracting parties an equal right of access and residence subject to local law. What the archipelago does not carry is the rest of the welfare state: the National Insurance Act lets an existing member keep membership on moving there and admits a non-member only through work for a Norwegian employer, and the Patient and User Rights Act has not been extended to Svalbard at all.

  • Nationality of a state party to the EEA Agreement or the EFTA Convention
  • A right of residence under chapter 13 of the Immigration Act for the last three years
  • Everything else in section 7 of the Nationality Act, including the eight years out of eleven

Forskrift 21. juni 1994 nr. 644, made under section 4 of the Norsk Lovtidend Act, authorises the Ministry to contract with stiftelsen Lovdata for the use of Lovdata's statute and regulation databases, and gives the State a right to take those databases over if the foundation is wound up - so the databases are the foundation's, held under an arrangement with the State. The 1992 circular on publication in Norsk Lovtidend instructs ministries to send material for publication to Norsk Lovtidend, c/o Lovdata. Four kinds of address matter and they are different documents. /dokument/NL/lov/<date>-<nr> and /dokument/SF/forskrift/<date>-<nr> are Lovdata's consolidated texts of Acts and central regulations; appending /* to either serves the whole instrument, and without it the address returns only a table of contents and an editorial blurb. /dokument/<...>/KAPITTEL_n serves one chapter. /LTI/lov/<date>-<nr> is the instrument as published in Norsk Lovtidend, which is the official text. /dokument/NLE/ and /dokument/SFE/ are unofficial English translations. The free-text search at /sok?q= is readable by the extraction service and is the practical way to find an instrument whose number is unknown; /referanse/hjemmel?dokID=NL/lov/<date>-<nr> lists every regulation made under a given Act. The treaty register at /traktat/<date>-<nr>, which Lovdata administers for the Ministry of Foreign Affairs, carries Norwegian texts of treaties with metadata naming the authentic language.

Cannot be cited for: **The consolidated texts are not the official text.** Norsk Lovtidend is what lov 19. juni 1969 nr. 53 § 1 requires to be published for public account, and section 3 of that Act ties an Act's commencement to the date of the issue of Norsk Lovtidend that announced it. Where it matters, the as-promulgated text is at the /LTI/ address and should be read instead. **No consolidation carries a sweep date.** The metadata block prints Sist endret with the last amending Act folded in, and a Rettet line recording editorial corrections, and neither is a statement that the text was checked as at a day - so no consolidatedAsOf can honestly be taken from a Lovdata page. **The amendment notes are Lovdata's, not the legislature's**: the small numbered blocks under each section are the foundation's apparatus and must not be quoted as enacted text, though they are the only readable record of what a repealed section used to say. **The consolidation prints provisions not yet in force beside those in force**, marked only by a note saying Endres ved forskrift ... i kraft <date>; section 10-1 of the Driving Licence Regulation carries one for 1 January 2027. **The English translations at /dokument/NLE/ and /dokument/SFE/ are not the instrument and must never be quoted as one**: Lovdata's own page states that the translations are not official, that they are provided for information purposes only, and that in the event of any inconsistency the Norwegian version shall prevail; the translations are produced by ministries rather than by Lovdata. **The bare /dokument/NL/lov/<date>-<nr> address is not the law**: it serves a table of contents and a Kort om loven blurb written by Lovdata, and a reading taken from it contains no section text at all - the Immigration Act at that address is 38,290 characters of navigation, against 431,640 at the same address with /* appended. **It cannot be cited for anything an agency does.** The skilled-worker quota, what counts as pay for a work permit, what counts as sufficient means, the Svalbard tax rates and the student tuition levels are all left by the instruments to a directorate, a ministry or the Storting, and none of those decisions is published here.

Practical notes

What counts as sufficient income under section 10 is left to regulation by the third paragraph of that section. The regulation was not read, so no amount is given here.

The Nationality Regulation of 30 June 2006 nr. 756 was not read for this record. Exemptions from the language and citizenship-test requirements are made by regulation under section 8 second paragraph and are not in the Act.

The Act's own amendment notes are Lovdata's editorial apparatus, not the enacted text. The repeal of the old section 10 is stated there and the repealing Act itself, lov 20 December 2018 nr. 121, was not read.
