A Spouse Has a Right to the Permit, and Then Three Separate Gates Stand in Front of It: 24 Years Old, 3.2 G of Income, and for Some Sponsors Four Years of Work or Study

Answer

The general rule applies to you

No exception is recorded for citizens of Croatia on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Croatia to Norway · Residency through marriage

Section 40 of the Immigration Act gives the spouse of a qualifying sponsor a right to a residence permit - the sponsor being a Norwegian or Nordic citizen resident or about to settle here, a foreign national with permanent residence, or one whose permit can lead to permanent residence. A cohabiting partner of two years has the same right under section 41, as does a partner with a child in common. Three further conditions sit on top. Both parties must be 18, and where the relationship was formed after the sponsor arrived in Norway, both must be 24. The sponsor must show future income of at least 3.2 times the National Insurance basic amount - 136,549 kroner from 1 May 2026, so 436,956.80 kroner for a year. And a sponsor whose own status comes from asylum, resettlement, collective protection, humanitarian grounds or family immigration must additionally have worked or studied in Norway for four years. The permit can be refused outright where the main purpose of the marriage appears to have been to establish a basis for residence.

At a glance

Status of a qualifying spouse
A right to the permit

Utlendingsloven § 40 first paragraph: har rett til oppholdstillatelse.

Cohabitation that qualifies
At least two years, fixed and established

Utlendingsloven § 41 first paragraph. A couple with a child in common qualifies without the two years, under the second paragraph.

Minimum age
18, or 24 for family establishment

Utlendingsloven § 40 second paragraph and § 41 a. The 24-year rule does not apply where the marriage or cohabitation predates the sponsor's entry to Norway, or was formed in Norway while both held a permit or Norwegian or Nordic citizenship.

Income the sponsor must show
At least 3.2 times the National Insurance basic amount

Utlendingsforskriften § 10-8 first paragraph, for the period the application covers.

What that is in kroner
436,956.80 kroner a yearCALC (calculated by us, not published)as of 2026-05-01

3.2 multiplied by the basic amount of 136,549 kroner set by forskrift 22. mai 2026 nr. 869 § 1. The arithmetic is ours; neither instrument prints the product.

Extra condition on some sponsors
Four years of work or education in Norway

Utlendingsloven § 40 a, for a sponsor holding asylum, resettlement, collective protection, a humanitarian permit, a family permit, or permanent residence built on any of those.

Marriage of convenience
A ground for refusal where it appears most likely that the main purpose was residence

Utlendingsloven § 40 fourth paragraph.

Living together
A condition, unless particular circumstances indicate otherwise

Utlendingsloven § 40 third paragraph.

Figures marked CALC are our arithmetic, not a figure in any instrument. Where the law states a threshold as a multiple of something else, the amount shown is that multiple applied - and it moves when the underlying figure does.

Requirements

  • Marriage, or two years of established cohabitation, or a child in common
  • A sponsor who is a Norwegian or Nordic citizen, has permanent residence, or holds a permit that can lead to it
  • Both parties aged 18, or 24 where the relationship began after the sponsor came to Norway
  • An intention to live together
  • Future income for the sponsor of at least 3.2 times the National Insurance basic amount
  • Four years of work or study in Norway, where the sponsor's own status is protection, humanitarian or family-based

In detail

The number is not in the immigration rules

Section 10-8 of the Immigration Regulation states a multiple, not an amount: 3.2 times the basic amount in the National Insurance scheme. The amount itself lives in a different instrument from a different ministry, reset by royal decree every May - 136,549 kroner from 1 May 2026. The krone figure a reader needs is therefore the product of two instruments and belongs to neither, and it moves on a date the immigration rules say nothing about.

Three gates, and only one of them is about the couple

The 24-year rule in section 41 a is about when the relationship was formed: it bites on family establishment, not on a couple who were already together before the sponsor came to Norway. The four-year rule in section 40 a is about who the sponsor is, and it reaches only sponsors whose own status rests on protection, humanitarian grounds or family immigration - a sponsor on a skilled-worker permit is outside it. The income rule in section 10-8 applies to all of them.

What applies to you

Nothing changes for a citizen of Croatia

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

Practical notes

The 436,956.80 kroner figure is our multiplication of 3.2 by the basic amount. No instrument prints the product, and the basic amount changes each 1 May, so the figure is good only for the period the current decree covers.

Section 10-9 of the regulation adds a requirement about the sponsor's past income and section 10-11 lists exemptions from the maintenance requirement. Both were in the reading and are not written up here.

Chapter 6 of the Act runs to section 53 and includes routes for children, for a parent with access to a Norwegian child, and for a single parent with a child over 18 in Norway. Only the spouse and cohabitant provisions are covered by this record.
