A Skilled Worker Has a Right to the Permit, and Not One Krone of a Salary Floor Is Written Anywhere in the Act or the Regulation
This replaces the general rule for you
The Quota, the Labour-Market Test and the Collective-Agreement Wage Rule Are Not Yours: One Right Covers Residence and Work Together
Nothing in chapter 6 of the Immigration Regulation applies to you. Section 109 second paragraph of the Immigration Act says a right of residence under chapter 13 carries the right to take up residence and to take work or carry on a business throughout the realm, so there is no separate work permission to obtain and no employer to apply on your behalf. The skilled-worker quota, the labour-market test, the requirement of a full-time offer from one employer and the collective-agreement wage condition all belong to the route a third-country national takes. What replaces them is a registration: a stay over three months must be registered within three months of entry, and the certificate is issued immediately once the documents are shown. Five years of that gives a permanent right of residence which survives the conditions ceasing to be met.
Outside the EEA, work in Norway runs through section 23 of the Immigration Act and chapter 6 of the Immigration Regulation. The central provision is section 6-1: a worker trained to at least upper secondary vocational level, holding a trade certificate, holding a university or college qualification, or having special qualifications, has a right to a residence permit - the word is right, not may - where the competence is relevant to the post, any statutory professional authorisation is in place, and the worker falls within the skilled-worker quota. The conditions in the Act are an age of 18, a concrete full-time offer from one employer, and pay and working conditions no worse than the applicable collective agreement, or where there is none, no worse than what is normal for that place and occupation. That last phrase is the entire wage rule. There is no salary threshold in the Act, none in the regulation, and section 6-10 says in one sentence that what counts as pay is determined by the Directorate of Immigration. A skilled worker who does not need a visa can also come first and look: section 6-29a gives a six-month permit to search for skilled work.
At a glance
- Minimum age
- 18
Utlendingsloven § 23 first paragraph letter a.
- Salary floor stated in the Act or the regulation
- None. Utlendingsloven § 23 first paragraph letter b sets the floor as the applicable collective agreement, or what is normal for the place and occupation where there is none
Utlendingsforskriften § 6-10 is the whole of the subordinate rule on pay and says only that what counts as pay is determined by the Directorate of Immigration.
- Status of a qualifying skilled worker
- A right to the permit, not a discretion
Utlendingsforskriften § 6-1 first paragraph: har rett til oppholdstillatelse.
- Labour-market test
- Waived inside the skilled-worker quota; applied where no quota is set or the quota is full
Utlendingsforskriften § 6-1 fourth paragraph and § 6-12, which puts the annual quota in the hands of the ministry and the test in the hands of the Labour and Welfare Service.
- Looking for work before applying
- Six months, for a skilled worker who does not need a visa
Utlendingsforskriften § 6-29a. The permit must be applied for within three months of entry and does not count towards permanent residence.
- Renewing the job-search permit
- After one year spent outside Norway
Utlendingsforskriften § 6-29a third paragraph.
- Posted workers and self-employed contractors
- No path to permanent residence
Utlendingsloven § 24, last paragraph, in terms.
- Skilled-worker permit and permanent residence
- Counts towards it
Utlendingsforskriften § 6-1 sixth paragraph, last sentence.
Requirements
- Eighteen years of age
- A concrete offer, as a rule of full-time work for one employer
- Training to at least upper secondary vocational level, a trade certificate, a higher education qualification, or special qualifications relevant to the post
- Professional authorisation where the occupation requires one by law
- Pay and conditions no worse than the applicable collective agreement, or than what is normal for the place and occupation
- A place within the annual skilled-worker quota, or a post that cannot be filled from Norway, the EEA or EFTA
In detail
The wage rule is relative, and that is a design choice
Denmark runs a Pay Limit Scheme with a krone figure in it; Finland carries two salary floors, one of 1,134 euros a month borrowed from its Unemployment Security Act and one of 1,600 set by government decree. Norway does neither. Section 23 first paragraph letter b of the Act ties the permit to the collective agreement for the industry, and where there is no agreement, to what is normal for that place and that occupation. Section 6-10 of the regulation, the only provision in chapter 6 headed Pay conditions, is one sentence long and hands the definition of pay to the Directorate of Immigration. The consequence for a reader is that the number they want is not in the law at all, and no quotation from the law can supply it.
A right, a quota, and a labour-market test that only bites when the quota runs out
Section 6-1 gives a qualifying skilled worker a right to the permit, and takes the labour-market test off the table for anyone inside the quota. The quota is set annually by the ministry under section 6-12, and only when there is no quota or the quota is exhausted does the question of whether the post could be filled from Norway, the EEA or EFTA come back. A separate carve-out in the fifth paragraph removes both the quota and the test for a national of a WTO member employed by an international company.
Country-level policy
Section 6 of the Immigration Act ends a paragraph with the sentence Loven gjelder ikke for Svalbard - the Act does not apply to Svalbard. There is no visa for Svalbard, no residence permit, no work permit and no quota, because the statute that would create them stops at the mainland. Svalbard is also outside Schengen: article 14 of the 1999 agreement associating Norway with the Schengen acquis says the agreement does not apply to Svalbard, and the 1957 Nordic passport agreement printed at the back of the Immigration Act defines a Nordic state as Norway except Svalbard and Jan Mayen. What governs entry instead is a five-section regulation of 1995 on rejection and expulsion, under which the Governor may turn away a person who cannot support themselves or look after themselves, and a 2022 regulation under which a traveller must present a passport valid for entry to Norway when the Governor asks. None of that is a permit, and the Svalbard Treaty gives nationals of the contracting parties an equal right of access and residence subject to local law. What the archipelago does not carry is the rest of the welfare state: the National Insurance Act lets an existing member keep membership on moving there and admits a non-member only through work for a Norwegian employer, and the Patient and User Rights Act has not been extended to Svalbard at all.

- Work, self-employment or service provision, as the basis of the stay
- Registration within three months of entry, for a stay over three months
What the law says
«Etter nærmere regler fastsatt av Kongen i forskrift kan det gis oppholdstillatelse for å utføre arbeid for en arbeidsgiver i riket»Our translation - not official
Under further rules laid down by the King by regulation, a residence permit may be granted to perform work for an employer in the realm when the following conditions are met:

The Ministry of Labour determines, in consultation with the Ministry of Trade and Industry and the Ministry of Finance, an annual quota for skilled workers as mentioned in section 6-1. The Labour and Welfare Directorate sets the quota for seasonal work in agriculture and forestry as mentioned in section 6-3.
The regulation still names the Arbeidsdepartementet and the Nærings- og handelsdepartementet, neither of which exists under those names now.

Forskrift 21. juni 1994 nr. 644, made under section 4 of the Norsk Lovtidend Act, authorises the Ministry to contract with stiftelsen Lovdata for the use of Lovdata's statute and regulation databases, and gives the State a right to take those databases over if the foundation is wound up - so the databases are the foundation's, held under an arrangement with the State. The 1992 circular on publication in Norsk Lovtidend instructs ministries to send material for publication to Norsk Lovtidend, c/o Lovdata. Four kinds of address matter and they are different documents. /dokument/NL/lov/<date>-<nr> and /dokument/SF/forskrift/<date>-<nr> are Lovdata's consolidated texts of Acts and central regulations; appending /* to either serves the whole instrument, and without it the address returns only a table of contents and an editorial blurb. /dokument/<...>/KAPITTEL_n serves one chapter. /LTI/lov/<date>-<nr> is the instrument as published in Norsk Lovtidend, which is the official text. /dokument/NLE/ and /dokument/SFE/ are unofficial English translations. Practical notes
The size of the skilled-worker quota is not in the regulation and was not read. Section 6-12 says the ministry sets it annually; the instrument setting the current one was not traced.
The Directorate of Immigration's own guidelines on what counts as pay, and on which collective agreement applies to which post, were not read for this record. Everything above comes from the Act and the regulation.
Chapter 6 of the regulation runs from section 6-1 to section 6-35 and was read through. The categories outside skilled work are seasonal work, Russian unskilled workers and cross-border commuters, seafarers, posted workers, contractors, self-employment, study, researchers with own funds, trainees, musicians and artists, charity and religious staff, Norec participants, au pairs, working holiday, medical treatment, job-search for graduates and researchers, job-search for visa-free skilled workers, and a residual section covering journalists, crisis work, ships in lay-up and overwintering yachts.

The free-text search at /sok?q= is readable by the extraction service and is the practical way to find an instrument whose number is unknown; /referanse/hjemmel?dokID=NL/lov/<date>-<nr> lists every regulation made under a given Act. The treaty register at /traktat/<date>-<nr>, which Lovdata administers for the Ministry of Foreign Affairs, carries Norwegian texts of treaties with metadata naming the authentic language.
Standing: Maintains the text in force
Cannot be cited for: **The consolidated texts are not the official text.** Norsk Lovtidend is what lov 19. juni 1969 nr. 53 § 1 requires to be published for public account, and section 3 of that Act ties an Act's commencement to the date of the issue of Norsk Lovtidend that announced it. A consolidation under /dokument/NL/ or /dokument/SF/ is the foundation's editorial product: reliable, universally used, and not the enacted words. Where it matters, the as-promulgated text is at the /LTI/ address and should be read instead. **No consolidation carries a sweep date.** The metadata block prints Sist endret with the last amending Act folded in, and a Rettet line recording editorial corrections, and neither is a statement that the text was checked as at a day - so no consolidatedAsOf can honestly be taken from a Lovdata page. **The amendment notes are Lovdata's, not the legislature's**: the small numbered blocks under each section are the foundation's apparatus and must not be quoted as enacted text, though they are the only readable record of what a repealed section used to say. **The consolidation prints provisions not yet in force beside those in force**, marked only by a note saying Endres ved forskrift ... i kraft <date>; section 10-1 of the Driving Licence Regulation carries one for 1 January 2027. **The English translations at /dokument/NLE/ and /dokument/SFE/ are not the instrument and must never be quoted as one**: Lovdata's own page states that the translations are not official, that they are provided for information purposes only, and that in the event of any inconsistency the Norwegian version shall prevail; the translations are produced by ministries rather than by Lovdata. **The bare /dokument/NL/lov/<date>-<nr> address is not the law**: it serves a table of contents and a Kort om loven blurb written by Lovdata, and a reading taken from it contains no section text at all - the Immigration Act at that address is 38,290 characters of navigation, against 431,640 at the same address with /* appended. **It cannot be cited for anything an agency does.** The skilled-worker quota, what counts as pay for a work permit, what counts as sufficient means, the Svalbard tax rates and the student tuition levels are all left by the instruments to a directorate, a ministry or the Storting, and none of those decisions is published here.
