One Permit, One Portal, Fifteen Days - and the Employer Still Has to Fail to Find a Serbian
Until 2024 a foreigner who wanted to work in Serbia needed two things from two bodies: a temporary residence permit from the Ministry of the Interior and a work permit from the National Employment Service. The amendments to the Law on Foreigners and to the Law on the Employment of Foreigners published in Sl. glasnik RS 62/2023 replaced that with a jedinstvena dozvola, a single permit for temporary residence and work, which the Act defines in article 46a and which began to apply on 1 February 2024. The application is made electronically on a single portal, by the foreigner or by the employer on the foreigner's behalf, and the authority has fifteen days from a complete application to decide. Inside those fifteen days it must obtain two assessments, each due within ten days: one from the security service on whether the foreigner is an unacceptable security risk, and one from the employment service on whether the conditions for employment, special cases of employment or self-employment are met. The permit runs for up to three years and is renewable for the same period. The single permit did not abolish the labour market test: the employment service's assessment under article 16 of the Law on the Employment of Foreigners still requires that the employer made no redundancies on the post in the previous 90 days, that it has started a test tržišta rada, and that a draft contract exists.
At a glance
- What the single permit is
- One permit for temporary residence and work, issued on the grounds of employment and of professional specialisation, training and practice
Articles 40(2) and 46a(1) of the Zakon o strancima. The other twelve grounds in article 40(1) get an ordinary temporary residence permit instead.
- When it started
- 1 February 2024
Article 54 of the Zakon o izmenama i dopunama Zakona o strancima, Sl. glasnik RS 62/2023, which defers the listed provisions - including its articles on the single permit - to that date.
- Time to decide
- 15 days from a complete application
Article 46g(1) of the Zakon o strancima.
- Time for the two assessments
- 10 days from the day the application is sent for consideration
Article 46g(3) of the Zakon o strancima, for both the security assessment and the employment service's assessment.
- Report on the labour market test
- Four days from the day the test is started
Article 16a of the Zakon o zapošljavanju stranaca.
- Maximum duration
- Up to three years, renewable for the same period
Article 44(1) of the Zakon o strancima, which applies to temporary residence generally.
- Renewal window
- No earlier than three months before expiry and no later than the day the permit expires
Article 46b(5) of the Zakon o strancima. Article 46b(7) lets the authority consider a late renewal where the gap is under three months and there is an interest of the Republic or force majeure.
- Where the application is made
- Electronically, through the single portal, by the foreigner, by the employer on the foreigner's behalf, or by a person they authorise
Article 46b(1) of the Zakon o strancima.
- Staying while the decision is awaited
- A foreigner who applies in time may stay and work in Serbia until the administrative procedure ends
Article 46b(6) of the Zakon o strancima.
- Who does not need a single permit
- A foreigner who already holds temporary residence or permanent settlement works under the rules on the employment of foreigners without one
Article 46a(3) of the Zakon o strancima.
- Penalty on an employer who skips it
- All monetary claims under the labour rules, with the tax and compulsory social insurance contributions on them; employment is presumed to have lasted at least three months unless the contrary is proved
Article 15 of the Zakon o zapošljavanju stranaca.
- Exemption from the labour market test
- The Government may exempt categories of foreigners in shortage occupations, and named occupations and profiles, by its own act, depending on the state of the labour market
Article 16a of the Zakon o zapošljavanju stranaca. We did not read any act made under that power, so this record does not say which occupations are exempt.
Requirements
- A ground the single permit covers: employment, self-employment, or a special case of employment - and, under the Law on Foreigners, professional specialisation, training or practice
- A valid passport, or an identity card where the holder's nationality may enter Serbia on one, valid for at least three months longer than the permit sought
- Evidence that the application is justified under the rules on the employment of foreigners, filed as an electronic or digitised document
- An address of stay, an address of residence, or a declaration of the intended address where the application is made from abroad
- For the employer: no dismissal for technological, economic or organisational reasons on that post in the 90 days before the application
- For the employer: a labour market test started through the National Employment Service, the request for which forms part of the single-permit application
- A draft employment contract or other contract under which rights arising from work are exercised
- Payment of the prescribed fee
How the process runs
- Step 1
Get into the country lawfully
Article 46b(2) and (4) of the Zakon o strancima
A visa national takes a long-stay visa D on the ground of employment and applies after entering, during its validity. A non-visa national applies during a lawful stay, or from abroad.
- Step 2
Apply electronically
Articles 46b(1) and 46v of the Zakon o strancima
The application goes in on the single portal, by the foreigner or by the employer on the foreigner's behalf, with the passport, the evidence that the application is justified and the address, all as electronic or digitised documents.
- Step 3
The labour market test runs inside the same application
Article 16a of the Zakon o zapošljavanju stranaca
The request for it is part of the single-permit application, and the employment service reports within four days.
- Step 4
Two assessments come back
Article 46g(2) and (3) of the Zakon o strancima
The security service says whether the stay is an unacceptable risk; the employment service says whether the employment conditions are met. Each has ten days.
- Step 5
Decision within fifteen days, collected in person
Article 46g(1), (5) and (6) of the Zakon o strancima
If the conditions are met the permit is issued, and the foreigner collects it personally.
In detail
What the 2023 amendment actually replaced
It is easy to read the single permit as a tidying-up of a two-permit system that had always existed. It is not. An earlier amendment, in Sl. glasnik RS 31/2019, had already inserted an article 41a into the Law on Foreigners headed "Combined application for temporary residence and a work permit" - a joint form in front of the same two bodies, each still issuing its own document. The 2023 amendment deleted that article outright and put the single permit in its place, which is a different thing: one instrument, one decision, one fifteen-day deadline, with the employment service's view arriving as an assessment inside the Interior Ministry's procedure rather than as a permit of its own.
The test the single permit did not abolish
A permit that merges two decisions does not merge the substantive conditions behind them. The employment service's assessment under article 46g(2)(2) of the Law on Foreigners is an assessment of the conditions in the Law on the Employment of Foreigners, and article 16 of that Act still requires a labour market test, still bars an employer who made redundancies on the same post in the previous 90 days, and still requires a draft contract before the application. The test now runs inside the single application and reports in four days, which changes how long it takes and not whether it happens.
Country-level policy
Whatever the ground, a temporary residence application in Serbia carries the same six items under article 43(1) of the Law on Foreigners: a valid passport (or an identity card where that nationality may enter on one), evidence of means of subsistence for the planned stay, a registration of the place of stay or of the address of residence, evidence of health insurance for the planned stay, evidence that the application is justified on the ground relied on, and proof of the administrative fee. The passport must be valid at least three months longer than the residence sought. Two groups are relieved of the means and insurance documents by article 43a: the immediate family of a Serbian citizen, and a foreigner being employed together with that person's immediate family. Behind every decision sits an assessment by the security service of whether the foreigner's presence is an unacceptable security risk, which article 9 defines and which the Act requires on entry, on temporary residence, on the single permit and on permanent settlement. The deadlines differ by route: thirty days for ordinary temporary residence with twenty-five for the assessment, fifteen days for the single permit with ten for its two assessments, and sixty days for permanent settlement with fifty-five for the assessment.
Every citation on these pages goes to the Pravno-informacioni sistem Republike Srbije, and Serbian law says exactly what that is. The Zakon o objavljivanju zakona i drugih propisa i akata establishes the system in article 28 as a collection of data in electronic form containing the electronic form of the Official Gazette, the archive of gazettes, the register and texts of the regulations in force, case law and a link to EU legal acts, published on the internet pages of the public enterprise. Article 26 settles what is authoritative and what is not: the basic and special editions of the Gazette are issued in printed form and in electronic form in PDF and HTML, and it is the printed form and the electronic form in PDF that are the official editions. HTML is produced and is not named among them. Article 29 then describes what the system gives away free to every internet user, and the first item on the list is 'незванично пречишћени текстови прописа' - unofficially consolidated texts of regulations - alongside the original gazettes in PDF carrying the base texts and the gazettes carrying their amendments; for everything else the enterprise charges a price the Government approves. The pages themselves are headed 'Редакцијски пречишћен текст', an editorially consolidated text: a third phrase for the same status. So the consolidated text this corpus quotes is free, current, produced by the state's own publisher, and not the official edition of anything.
Exceptions by origin
No Work Permit at All, by a Serbian Act Rather Than by Any Treaty
Serbia is not a member of the European Union or of the European Economic Area, and no agreement gives their nationals a right to work there. Article 5 of the Law on the Employment of Foreigners gives it anyway: nationals of EU and EEA member states have the right of free access to the Serbian labour market - employment, self-employment and the rights that attach to unemployment - and do not need a work permit within the meaning of that Act. Their family members who are not themselves such nationals are covered where they hold a family-member residence permit or permanent settlement in one of those states. The right survives the end of a job on the terms set out in articles 6 and 7, and the only condition attached to it is that the person must not become an unreasonable burden on Serbia's social protection system. What it does not do is give a right to be in the country: residence still runs through article 40 of the Law on Foreigners.
- Nationality of an EU or EEA member state, proved by that nationality
- For a family member who is not such a national: a family-member residence permit or permanent settlement in one of those states
- Sufficient means, so as not to become an unreasonable burden on Serbia's social protection system
- A ground for temporary residence under article 40(1) of the Law on Foreigners, which this right does not supply
Swiss Nationals Are Inside Serbia's Definition of an EU National
Article 3(4) of the Law on the Employment of Foreigners defines "EU national" for the purposes of that Act as a national of a member state of the European Union, of the European Economic Area or of the Swiss Confederation. Swiss nationals therefore fall inside article 5 exactly as EU and EEA nationals do: free access to the Serbian labour market, no work permit, and the same treatment of family members and of the end of a job. An employer established in Switzerland may also post a non-EU worker into Serbia without a Serbian work permit under article 8. None of this touches the residence side, which runs through article 40 of the Law on Foreigners like anyone else's.
- Swiss nationality, proved as such
- For a family member who is not such a national: a family-member residence permit or permanent settlement in Switzerland, the EU or the EEA
- Sufficient means, so as not to become an unreasonable burden on Serbia's social protection system
- A ground for temporary residence under article 40(1) of the Law on Foreigners

Temporary residence is a residence permit for a foreign national in the Republic of Serbia and may be approved to a foreigner who intends to stay in the Republic of Serbia longer than 90 days in a period of 180 days, longer than the period of stay determined by an international treaty, or longer than the period for which a long-stay visa was issued, on the ground of: 1) employment; 2) schooling or learning the Serbian language; 3) study; 4) participation in programmes of international exchange of pupils or students; 5) professional specialisation, training and practice; 6) scientific research work or other scientific and educational activity; 7) family reunification; 8) performing religious service; 9) treatment or care; 10) ownership of immovable property; 11) humanitarian stay; 12) the status of a presumed victim of trafficking in human beings; 13) the status of a victim of trafficking in human beings; 14) other justified reasons in accordance with the law or an international treaty. (2) In the cases under paragraph 1, points 2) to 4) and 6) to 14) of this article a temporary residence permit is issued, and in the cases under points 1) and 5) a single permit.

Article 29 makes three things free to every internet user: the consolidated texts of regulations, the original gazettes in PDF in which the base texts were published, and the gazettes in which their amendments were published; everything else is charged for at a price the enterprise sets with the Government's consent. An amending act's own ELI resolves to the consolidated text of the act it amended. The end of every consolidated text carries a register block - Основ доношења прописа, Акт којима је пропис основ доношења, Повезани пропис - listing every subordinate instrument by gazette number and page, which is the cheapest index to Serbian secondary legislation we have found.

An employer who has employed a foreigner without a long-stay visa on the ground of employment, a single permit, a consent or a temporary residence permitting the foreigner to work, must pay the foreigner all monetary claims in accordance with the labour regulations, together with payment of the corresponding taxes and contributions for compulsory social insurance. In the case under paragraph 1 of this article there is a presumption that the employment relationship lasted at least three months, unless the contrary is proved.

Practical notes
The single permit covers employment, self-employment and special cases of employment. It does not cover the other twelve grounds for temporary residence in article 40(1), which take an ordinary residence permit and a thirty-day decision under article 42(1).
A person who already holds temporary residence on another ground, or permanent settlement, does not need a single permit to work: article 46a(3) sends them to the employment rules directly.
Article 16a of the Law on the Employment of Foreigners also constrains the use of related companies: an employer who engages a foreigner employed by a related company under a services contract cannot make its own employees on the same work redundant for three months, and the reverse is barred too.
This record rests on the Zakon o strancima and the Zakon o zapošljavanju stranaca. We did not read the Pravilnik o izdavanju jedinstvene dozvole za privremeni boravak i rad stranca (Sl. glasnik RS 6/2024), which sets the form and the closer conditions, nor any Government act exempting occupations from the labour market test.
