Country-wide policy

The Gazette Is Official in Print and in PDF; Everything Else Is Unofficial and Free

Every citation on these pages goes to the Pravno-informacioni sistem Republike Srbije, and Serbian law says exactly what that is. The Zakon o objavljivanju zakona i drugih propisa i akata establishes the system in article 28 as a collection of data in electronic form containing the electronic form of the Official Gazette, the archive of gazettes, the register and texts of the regulations in force, case law and a link to EU legal acts, published on the internet pages of the public enterprise. Article 26 settles what is authoritative and what is not: the basic and special editions of the Gazette are issued in printed form and in electronic form in PDF and HTML, and it is the printed form and the electronic form in PDF that are the official editions. HTML is produced and is not named among them. Article 29 then describes what the system gives away free to every internet user, and the first item on the list is 'незванично пречишћени текстови прописа' - unofficially consolidated texts of regulations - alongside the original gazettes in PDF carrying the base texts and the gazettes carrying their amendments; for everything else the enterprise charges a price the Government approves. The pages themselves are headed 'Редакцијски пречишћен текст', an editorially consolidated text: a third phrase for the same status. So the consolidated text this corpus quotes is free, current, produced by the state's own publisher, and not the official edition of anything.

Topics it changes

What it requires

  • Treat a PIS consolidated text as the current statement of the law and not as an official edition
  • For the text as enacted or as amended, go to the gazette PDF the page links, which is an official edition under article 26
  • Expect no consolidation cut-off: the masthead lists the gazette numbers incorporated and states no date up to which the text was checked

At a glance

Which editions are official
The printed Gazette and the electronic Gazette in PDF

Article 26 of the Zakon o objavljivanju zakona i drugih propisa i akata. The HTML edition is issued under the same article and is not named among the official ones.

What the consolidated texts are
Unofficially consolidated texts, free to every internet user

Article 29 of the Zakon o objavljivanju zakona i drugih propisa i akata uses the words "незванично пречишћени текстови прописа".

What else is free
The original gazettes in PDF in which the base texts of regulations were published, and the gazettes in which their amendments were published

Article 29 of the Zakon o objavljivanju zakona i drugih propisa i akata.

What is charged for
Everything else the system contains, at a price set by an act of the public enterprise with the Government's consent

Article 29 of the Zakon o objavljivanju zakona i drugih propisa i akata.

Who runs it
The public enterprise, as an activity of general interest, with every state body obliged to supply the data and documentation needed

Article 30 of the Zakon o objavljivanju zakona i drugih propisa i akata.

Printed and electronic dates
The day of issue is the date marked on both forms, which must carry the same date and be consistent in content

Article 27 of the Zakon o objavljivanju zakona i drugih propisa i akata.

Consolidation cut-off
None stated on any consolidated text read for this country

The masthead of each text lists the gazette numbers incorporated - for the Zakon o strancima, 24/2018, 31/2019 and 62/2023 - and gives no date up to which the text was swept, so no consolidation cut-off is recorded on any citation here.

Three phrases, one status

A reader meets the same fact in three different wordings and may take them for three different things. The Act's article 29 calls the free texts 'unofficially consolidated texts'. The page itself is headed 'editorially consolidated text'. And article 26 reaches the point from the other side by naming the official editions and leaving HTML out of the list. All three say that the text this corpus quotes is the state publisher's working version of the statute, not an edition the law treats as authentic. The authentic one is a PDF of the gazette, which is also free, and which carries the law one amendment at a time rather than as it now stands.

Why that is not a reason to quote something else

The unofficial text is the only place a Serbian statute exists as a single current document. The gazette PDFs that are official are issue-by-issue: the Law on Foreigners as it now stands is spread across three of them, and the Law on Personal Income Tax across twenty-nine. Quoting the official editions would mean quoting the 2018 text and three amending Acts separately and assembling them by hand, which is what the publisher has already done. So this corpus cites the unofficial consolidation and says what it is, which is the same answer the records for Slovenia and Czechia reached about their own publishers.

Practical notes

No consolidated text read for Serbia states a sweep date, so no citation here carries a consolidation cut-off. What each text states is the list of gazette numbers incorporated, which says what has been taken in and not what has been looked for.

The free tier is defined by article 29 and is wide enough for this work: consolidated texts and the gazette PDFs for base texts and amendments. The charged tier - case law and the rest - was not used here.

This policy rests on the Zakon o objavljivanju zakona i drugih propisa i akata alone. We did not read the Government regulation on establishing and maintaining the Legal Information System, which article 32 requires.
