No Treaty Gives Residence - but Serbian Law Hands the EU, the EEA and Switzerland the Labour Market
Serbia belongs to no union that confers a right of residence on the nationals of other member states, and nothing in the Law on Foreigners gives one. What exists instead is a one-way grant in domestic law. Article 5 of the Law on the Employment of Foreigners gives nationals of the European Union, of the European Economic Area and of the Swiss Confederation - and their family members down to a defined list - the right of free access to the Serbian labour market: employment, self-employment and unemployment benefit, with no work permit of any kind. Serbia is a member of none of those three. The right survives the end of a job on stated terms, and an employer established in any of them may post a non-EU worker to Serbia without a Serbian permit. Alongside that sits a second power, in article 16(2) of the Law on Foreigners, which lets the Government admit the nationals of a named country on an identity card instead of a passport; the instance we read is a 2020 decision for nationals of Albania, drafted to lapse when a bilateral travel agreement replaces it. Neither "Open Balkan" nor CEFTA appears anywhere in the instruments read for this country.
At a glance
- Who gets free access to the labour market
- Nationals of the European Union, the European Economic Area and the Swiss Confederation, and their listed family members
Articles 3(4) and 5 of the Zakon o zapošljavanju stranaca. Serbia is not a member of any of the three.
- Does that right include a work permit
- No work permit is needed at all
The last paragraph of article 5 of the Zakon o zapošljavanju stranaca: persons with the right of free access do not need a work permit within the meaning of that Act.
- Does it include residence
- No. The Zakon o zapošljavanju stranaca grants access to the labour market; residence remains governed by article 40 of the Zakon o strancima
Neither article 5 of the Zakon o zapošljavanju stranaca nor article 40 of the Zakon o strancima creates a residence right for EU, EEA or Swiss nationals.
- Keeping access after a job ends
- Six months after employment ends for a fixed-term job that lasted under 12 months, or for an open-ended job lost without fault in the first 12 months of the stay, in each case if registered as unemployed
Article 7 of the Zakon o zapošljavanju stranaca; article 6 preserves access during incapacity for work, after losing a job of at least a year without fault, and during further education and training.
- Posting into Serbia
- A foreign employer established in an EU, EEA or Swiss state may post a non-EU worker to Serbia without a Serbian work permit, on three stated contractual conditions
Article 8 of the Zakon o zapošljavanju stranaca.
- Open Balkan or CEFTA in the statute book
- Neither is named in any instrument read for this country
Searched for "Отворени Балкан" and "ЦЕФТА"/"CEFTA" across the stored texts of the Zakon o strancima, the Zakon o zapošljavanju stranaca, the Zakon o graničnoj kontroli, the Zakon o državljanstvu, the Zakon o porezu na dohodak građana, the Zakon o zdravstvenom osiguranju, the Zakon o zdravstvenoj zaštiti, the Zakon o visokom obrazovanju, the Carinski zakon, the Zakon o platnim uslugama, the Zakon o bezbednosti saobraćaja na putevima, the Zakon o doprinosima za obavezno socijalno osiguranje and the Zakon o prebivalištu i boravištu građana. The only neighbouring state named anywhere in them is Albania, in the register of instruments made under the Zakon o strancima.
- Identity-card travel
- A power of the Government under article 16(2) of the Zakon o strancima, exercised country by country
The decision for nationals of Albania, Sl. glasnik RS 140/2020, is the one instance this record read, and it expires when an amended bilateral travel agreement begins to apply.
Requirements
- For free labour-market access: nationality of an EU member state, of an EEA state or of Switzerland, proved by that nationality
- For a family member who is not such a national: a residence permit for family members or permanent settlement in one of those states, proving the right of free access
- Not becoming an unreasonable burden on Serbia's social protection system, and having sufficient means for oneself and one's family
- For residence itself: the ordinary temporary residence rules in the Law on Foreigners, which the free-access right does not displace
In detail
A one-way grant, and who it is not
The shape here is worth stating plainly because it inverts the usual one. In most of this corpus a regional arrangement is reciprocal and sits in a treaty both sides signed. Serbia's is neither: it is a provision of a Serbian Act, granting the nationals of every European Union, European Economic Area and Swiss state the run of the Serbian labour market, with no corresponding right for Serbian nationals written anywhere in it and no treaty named. Article 5 opens with the words "unless an international treaty binding on the Republic provides otherwise", which is the only place a treaty is mentioned at all, and it is mentioned as something that could take the right away rather than something that gave it.
Where to look for Open Balkan, and what is there instead
The arrangement known as Open Balkan - identity-card travel and labour-market access among Serbia, Albania and North Macedonia - produced no provision in any Serbian instrument this record read. What the statute book contains is a general power: article 16(2) of the Law on Foreigners lets the Government admit the nationals of a named country on an identity card, and the Government exercised it for nationals of Albania in November 2020 by a decision whose whole operative text is one sentence. That decision does not mention Open Balkan either; it names a bilateral agreement on the mutual travel of nationals, and provides that it ceases to apply when an amendment to that agreement does. Labour-market access for nationals of Albania or North Macedonia appears nowhere in the Law on the Employment of Foreigners, whose only named group is the EU, EEA and Switzerland.
Country-level policy
Every citation on these pages goes to the Pravno-informacioni sistem Republike Srbije, and Serbian law says exactly what that is. The Zakon o objavljivanju zakona i drugih propisa i akata establishes the system in article 28 as a collection of data in electronic form containing the electronic form of the Official Gazette, the archive of gazettes, the register and texts of the regulations in force, case law and a link to EU legal acts, published on the internet pages of the public enterprise. Article 26 settles what is authoritative and what is not: the basic and special editions of the Gazette are issued in printed form and in electronic form in PDF and HTML, and it is the printed form and the electronic form in PDF that are the official editions. HTML is produced and is not named among them. Article 29 then describes what the system gives away free to every internet user, and the first item on the list is 'незванично пречишћени текстови прописа' - unofficially consolidated texts of regulations - alongside the original gazettes in PDF carrying the base texts and the gazettes carrying their amendments; for everything else the enterprise charges a price the Government approves. The pages themselves are headed 'Редакцијски пречишћен текст', an editorially consolidated text: a third phrase for the same status. So the consolidated text this corpus quotes is free, current, produced by the state's own publisher, and not the official edition of anything.

The end of every consolidated text carries a register block - Основ доношења прописа, Акт којима је пропис основ доношења, Повезани пропис - listing every subordinate instrument by gazette number and page, which is the cheapest index to Serbian secondary legislation we have found.

Practical notes
Free access to the labour market is not a right to be in the country. An EU, EEA or Swiss national who wants to stay longer than 90 days in 180 still needs a ground under article 40 of the Law on Foreigners, and the permit for employment is the single permit like anyone else's - the difference is that no work permit or labour market test stands behind it.
The bound of the negative finding is stated in the key facts: thirteen instruments were searched by text for Open Balkan and CEFTA. That is not a claim that no Serbian instrument mentions them; it is a claim about the thirteen we read.
We did not read the bilateral agreement between Serbia and Albania on the mutual travel of nationals, which the 2020 decision names and which was to replace it. Whether it has since begun to apply is not something this record can say.
