Slovenia answers the ancestry question twice, with two different reaches. For residence, article 48(7) of ZTuj-2 issues a temporary permit to a foreign national of Slovene descent to the second degree in the direct line, and asks for nothing beyond the conditions every permit shares in article 33(3): a travel document, health insurance and means. No job, no study place, no sponsor. Article 48(8) lets someone already here lawfully apply inside Slovenia, and article 52(3) lets a person of Slovene descent have permanent residence before the five years are up. Article 47(1) lets them bring family immediately, without the year of prior residence other permit holders serve. For citizenship the reach is longer and the conditions are different in a way that matters more than the degree: article 12(1) of ZDRS lets the authority naturalise a Slovene emigrant and their descendant to the fourth degree in the direct line after one year of actually living in Slovenia with regularised status, and the conditions it imports from article 10 deliberately leave out point 2 - release from the existing citizenship. An ordinary applicant has to give up their old nationality. A descendant of an emigrant does not.

In detail

Two degrees for a permit, four for a passport

The two statutes do not use the same reach and they do not use the same word. ZTuj-2 speaks of a foreign national of Slovene descent to the second degree in the direct line; ZDRS speaks of a Slovene emigrant and their descendant to the fourth degree. A great-grandchild of someone who left therefore has no residence route by descent but may have a citizenship route - which only works if they can first get one year of lawful residence on some other basis.

The omission that is the whole point

Article 10(1) point 2 of ZDRS requires an applicant for ordinary naturalisation to hold a release from their existing citizenship or show they will get one. Article 12(1) lists the conditions it imports for a Slovene emigrant and their descendants, and point 2 is not among them. The spouse route in the third paragraph of the same article does import it. Reading the three paragraphs of article 12 side by side is the only way to see this: nothing on the face of the Act announces that descent is the route that lets you keep what you have.

Country-level policy

Three Conditions Sit Under Every Permit in the Act: a Passport Good for Three Months Past the Stay, Emergency Health Cover, and the Basic Amount of Minimum Income

Article 33(3) of ZTuj-2 is the provision that every other residence article points back to. It asks for a travel document whose validity runs at least three months beyond the intended stay; health insurance covering at least emergency services in Slovenia; and means of at least the basic amount of minimum income each month, or that subsistence be otherwise assured. For a permanent residence permit the travel document need only be valid. The same paragraph lists what may be shown as means - earnings, rights from employment or insurance excluding reimbursed expenses, income from property, income from capital and other sources, support from those legally obliged to maintain you, a scholarship, or funds in an account at a bank or savings bank in Slovenia or abroad - and that list is what makes the test satisfiable from abroad. The figure itself is not in ZTuj-2. Article 8(1) of ZSVarPre sets the basic amount of minimum income at 392.75 EUR and provides for it to be adjusted, and the government's decision of 24 February 2026 puts it at 507.43 EUR from 1 March 2026.

Five Years Buys You the Right to Sit an Exam: Permanent Residence Requires Slovene at A2, and the Years Are Not All Counted the Same

Article 52(1) of ZTuj-2 issues a permanent residence permit after five years of continuous lawful residence on a temporary permit, and adds a condition that is easy to miss in the length of the paragraph: command of Slovene at basic level, proved by a certificate of a passed examination at basic level, which the Act itself glosses as A2 of the Common European Framework. The examination has written, oral and listening parts and is run by institutions delivering the publicly recognised programme Slovene as a second and foreign language. The condition is deemed met by admission to a Slovene-language programme of recognised education here, by schooling completed here at any level, by schooling in Slovene in the areas of the autochthonous Slovene minority in neighbouring states, and by being over 60 or under 18. It does not apply at all to anyone who may have permanent residence before the five years - which includes people of Slovene descent. The five years themselves are counted unevenly: study and vocational training count half, seasonal work, posted work, intra-corporate transfer and daily commuting do not count at all, and absences break the period if they run six consecutive months or ten months in total.

The First Temporary Permit Has to Be Got Before You Enter, Unless the Act Says Otherwise - and for Three Routes It Does

Article 34(2) of ZTuj-2 states the default plainly: a foreign national must obtain the first temporary residence permit before entering the country, unless the Act provides otherwise. Article 34(3) lets the application be lodged at a Slovene mission abroad, or at the competent authority in Slovenia where the applicant is already lawfully resident or where the Act so provides. The first permit is issued with a validity of up to two years unless the Act says otherwise, and it is served in person. The exceptions are worth knowing because they are the only ways to turn a visit into a stay: a person of Slovene descent to the second degree may apply inside Slovenia within the ninety days under article 48(8); a digital nomad lawfully present on a passport, another member state's permit or a C or D visa may apply here under article 51.a(2); and a long-term resident of another member state and their family may apply here under article 48(3). In each case a certificate of the lodged application counts as a permit until the decision is final.

The State Pays for the Slovene Course and for One Attempt at the Exam, and the Entitlement Turns on Holding a Permit Valid for a Year

Article 106 of ZTuj-2 makes Slovenia provide free of charge to non-EU nationals: programmes of Slovene language and of learning about Slovene society, the sitting of the Slovene language examination, programmes of mutual acquaintance with Slovene citizens, and information about integration. The entitlement to one free place on the language and society programme belongs to holders of a permanent residence permit, holders of a temporary permit issued with a validity of at least one year, family members of Slovene or Union citizens residing on a family-member permit regardless of how long they have been here, and people on temporary protection. One free attempt at the examination comes with it. It is not open to people who finished schooling in Slovene here at any level, who are in a Slovene-language programme of regular education, or who already hold a certificate at basic level or above - which is to say, to anyone who has already passed the test it exists to prepare them for. The condition that decides most cases is the one-year validity: a permit issued for less than a year carries no entitlement, and the digital nomad permit under article 51.a(4) is issued for at most one year and may be shorter.

Practical notes

Read off ZTuj-2 as officially consolidated on 18 June 2025, and off ZDRS in the state legal information system's unofficial consolidation number 11, which incorporates everything up to ZDRS-E of 21 July 2017. The last official consolidation of ZDRS is ZDRS-UPB2 of 20 March 2007 and predates that amendment.

Neither Act defines Slovene descent or says what evidence proves it. We did not find a definition in ZTuj-2 or in ZDRS, and we did not read any implementing regulation that might carry one.

Article 13 of ZDRS is a different thing again: naturalisation where it benefits the state for scientific, economic, cultural or national reasons, after a year of residence, and for people covered by the Act on relations with Slovenes abroad it waives even that.

    The official gazette of the Republic of Slovenia, where an instrument gains force. Every Act, amending Act, government decree, ministerial rulebook and Constitutional Court decision is published here, and so is the uradno prečiščeno besedilo - the official consolidated text, which the National Assembly confirms by resolution under article 153 of its own rules of procedure and which then appears as a numbered item of a numbered issue. Two address shapes serve the same material and both answer an ordinary request without JavaScript. /glasilo-uradni-list-rs/vsebina/{YYYY}-01-{NNNN} is the item, where the number is the SOP identifier the state legal information system also uses, so an identifier found there resolves straight to the gazette text; a human-readable slug may follow the identifier and is optional. /_pdf/{YYYY}/Ur/u{YYYY}{NNN}.pdf is the whole issue as a PDF. From 1 March 2026 the gazette is published through pisrs.si instead, and single items from the new arrangement are served at https://pisrs.si/api/uradni-list/objava/u{YYYY}{NNNN}.pdf as one-item PDFs with a text layer. Readings for this corpus were taken directly rather than through the extraction service, because the item pages are ordinary HTML and the service adds nothing.

    Standing: Issues the instrument

    Cannot be cited for: **It issues; it does not maintain.** The gazette prints an instrument as it was published on the day and never updates it, so an amending Act and the Act it amends are two separate items and neither tells you what the law now says. The only current text of an Act is an official consolidation, and those are made when the National Assembly decides to make one: for the Aliens Act that is ZTuj-2-UPB15 of 24 June 2025 and current, but for the Citizenship Act it is ZDRS-UPB2 of 20 March 2007 and ten years behind ZDRS-E, for the Income Tax Act it is ZDoh-2-UPB7 of 28 February 2011, for the Health Care and Health Insurance Act ZZVZZ-UPB3 of 11 July 2006, and for the Act on employment of foreign nationals ZZSDT-UPB4 of 7 June 2021 with two amending Acts after it. **Never cite an official consolidation as the law in force without checking the amending Acts published since it**, and never treat the absence of a later consolidation as evidence that nothing changed. The site also prints, on every item page, that what it shows is archival under article 33 of the Act on the Official Gazette and that issues published after 28 February 2026 are on PISRS: "Prikazana vsebina je v skladu s 33. členom ZoUL arhivska. Izdaje uradnega lista, izdane po 28.2.2026, so dostopne na PISRS". It cannot be cited for anything published after that date.

    The Slovene state's legal information system, run by the government's legislation service. It is the only place that keeps the current text of an Act when the National Assembly has not made a recent official consolidation, which is most Acts: it publishes a neuradno prečiščeno besedilo, numbered in sequence, each carrying the list of instruments it incorporates and, usually, a Datum začetka uporabe - the date from which that version applies. pisrs.si is an Angular single-page application, so the text appears only once JavaScript has run and it is readable by the extraction service and not by an ordinary request; the stable human address is https://pisrs.si/pregledPredpisa?id={ZAKOnnnn}, and https://pisrs.si/pregledPredpisa?sop={YYYY-01-NNNN} resolves the same gazette identifier the Uradni list uses. Three file forms of each consolidation are served from https://pisrs.si/api/datoteke/integracije/{id} as HTML, DOCX and PDF, and the identifiers for them are printed in the page itself. There is also a search API that answers an ordinary POST without the proof-of-work the site applies elsewhere: POST https://pisrs.si/api/filter/filter with a body of the shape {"nazivZbirke":["Register predpisov"],"besedilo":{"word1":"\"<title>\"","word1InTitle":true}} returns the ZAKO identifier, the SOP and the dates for every matching instrument, and nazivZbirke "Neuradna prečiščena besedila" lists every consolidation of it with its stNpb.     Standing: Maintains the text in force

    Cannot be cited for: **Its consolidated texts are explicitly not authoritative, and the site says so on every one of them**: "Opozorilo: Neuradno prečiščeno besedilo predpisa predstavlja zgolj informativni delovni pripomoček, glede katerega organ ne jamči odškodninsko ali kako drugače." - an unofficial consolidated text is merely an informative working aid for which the body accepts no liability. It is nevertheless the only current text of most Slovene Acts, because the official consolidations are years behind, so the right handling is to cite it and say what it is rather than to prefer a stale official text. This is the third time this corpus has met the problem, after Belgium's database frozen in 2002 and Czechia's informativní znění. **It cannot be cited for the text as enacted**: for that, go to the Uradni list item the consolidation lists. **It is not reliably readable.** The pages are rendered by the extraction service, and on 10 October 2026 two of them - ?id=ZAKO4697, the Income Tax Act, and ?id=ZAKO6655, the Act on employment of foreign nationals - came back as nothing but a loading spinner on four attempts across two hours, while larger pages on the same site rendered fully. A 223-byte reading from this publisher is a failed render, not a short document.
