Descent Has No Generation Limit, but a Man Who Left Before Military Service Is Refused Until the Year He Turns Forty-One

Korea's ancestry route is a statute of its own, the Act on the Immigration and Legal Status of Overseas Koreans, and the status it creates - F-4 - is the most generous long-term status in the Immigration Act's table while being defined entirely outside it. Article 2(2) of the Act covers a person who once held Korean nationality, including someone who emigrated before the Republic was founded, or their lineal descendant, who has acquired a foreign nationality, as further prescribed by Presidential Decree. Article 3 of that Decree, rewritten on 2 July 2019, narrows it to two cases and neither carries a generation limit: a person who held Korean nationality by birth and acquired a foreign one, and a lineal descendant of such a person who acquired a foreign one. What the status gives is unusual. Article 10(5) says employment and other economic activity are freely permitted to the extent that they do not impair social order or economic stability - no designated workplace, no occupation list, no permission to change employer. Article 10(3) removes the need for a re-entry permit. Article 10(4) deems the domestic residence report to be alien registration under the Immigration Act. Article 11 gives equal rights with Korean nationals over real estate, subject to the ordinary transaction reports; article 12 makes the holder a resident for the purposes of the Foreign Exchange Transactions Act when dealing with a Korean bank; article 14 brings health insurance within reach after 90 days. Against all that stands article 5(2), and it is the heart of this route's reputation. A man who renounced or lost Korean nationality without completing, being enlisted for, or being exempted from military service is refused the status - and the Korean proviso says the Minister of Justice may grant it from 1 January of the year he turns forty-one where he finds it necessary.

At a glance

Generations covered
No limit stated - a person who held Korean nationality by birth, and any lineal descendant of theirs

Article 3 of the Enforcement Decree of the Act on the Immigration and Legal Status of Overseas Koreans, wholly amended on 2 July 2019. The two subparagraphs say 직계비속 - lineal descendant - without a degree.

Maximum period of stay on the status
Up to 3 years

Article 10(1) of the Act. The Enforcement Rules of the Immigration Act give the same figure in their own table, which reads 재외동포(F-4) 3년.

Extension
The Minister of Justice may extend beyond three years, unless a ground under article 5(2) exists

Article 10(2) of the Act. The military-service bar therefore reaches extensions as well as the first grant.

Employment
Freely permitted, to the extent it does not impair social order or economic stability

Article 10(5) of the Act. No designated workplace and no change-of-workplace permission, which are the two restrictions article 18(2) and article 21(1) of the Immigration Act put on employment statuses.

Military-service bar
Refused to a man who renounced or lost Korean nationality without completing, being enlisted for, or being exempted from military service

Article 5(2)1 of the Act, as amended on 31 December 2019.

When the bar can lift
From 1 January of the year he turns 41, and only where the Minister of Justice finds it necessary

The proviso to article 5(2). The Korean is 법무부장관이 필요하다고 인정하는 경우에는 ... 부여할 수 있다 - a discretion, not an automatic expiry.

Re-entry permit
Not required for a holder who has made a domestic residence report

Article 10(3) of the Act, which disapplies article 30 of the Immigration Act.

Alien registration
The domestic residence report counts as it

Article 10(4) of the Act, which also treats a change-of-residence report as the change-of-stay-address report under article 36 of the Immigration Act.

Health insurance
Available after 90 days of stay, under the health insurance legislation

Article 14 of the Act. The six-month qualifying period in the Enforcement Rules of the National Health Insurance Act is what that legislation then says, and the two have to be read together.

Real estate
Equal rights with a Korean national to acquire, hold, use and dispose of it

Article 11(1) of the Act, subject to the reports required by articles 3(1) and 8 of the Act on Report on Real Estate Transactions.

Requirements

  • Korean nationality held by birth and since exchanged for a foreign one, or direct lineal descent from such a person, with a foreign nationality acquired
  • An application to the Minister of Justice, who consults the Minister of Foreign Affairs
  • No ground under article 5(2): the military-service bar for men, and no apprehension of harm to Korea's security, public order, public welfare or diplomatic relations
  • A domestic residence report, if you want the Act's civil-law benefits rather than only the status

In detail

The status is in one statute and everything about it is in another

Item 26 of the Immigration Decree's long-term table says only that F-4 goes to a person falling under article 2(2) of the Overseas Koreans Act. That single cross-reference is the whole of what the immigration instruments say about the route. The qualifying descent, the military-service bar, the three-year period, the freedom to work, the re-entry exemption, the real-estate and banking equality and the health-insurance hook are all in the separate Act and its Decree. A reader who works through the Immigration Act and its Decree looking for the ancestry route will find a pointer and nothing else.

What makes F-4 different from every employment status

An E-7 holder may not work outside the designated workplace and needs the Minister of Justice's permission to change it. An F-4 holder is under article 10(5) instead: employment and other economic activity are freely permitted, bounded only by social order and economic stability. There is no occupation list in the Act, no quota, and no employer tied to the status. The practical difference is not the right to work but the right to stop working for one employer without asking anyone, which is the thing the Immigration Act most carefully withholds from everybody else.

The bar on men, and what the translation does to it

Article 5(2)1 refuses the status to a man who became a foreigner by renouncing or losing Korean nationality without completing military service, being enlisted in the wartime labour service, or being exempted. The proviso in Korean lets the Minister of Justice grant it from 1 January of the year he turns forty-one, and only where the Minister finds it necessary. The official English translation renders the same proviso as the bar simply ceasing to apply from that date. The two readings differ in kind: one is an age at which a discretion becomes available, the other is an age at which a prohibition expires. Anyone planning around the forty-first year on the strength of the English is planning around a sentence the Korean does not contain.

Descent without a stated limit

Article 3 of the Enforcement Decree, as replaced on 2 July 2019, covers a person who held Korean nationality by birth and acquired a foreign one, and that person's lineal descendants who have acquired a foreign nationality. Neither subparagraph names a generation. On its face a great-grandchild of an emigrant is a lineal descendant as much as a child is, and the Act's own definition is explicit that a compatriot who left before the Republic was founded is included. What the provision does require is that the ancestor held Korean nationality by birth - so the chain has to begin with a Korean national, and the descent has to be lineal rather than collateral.

Exceptions by origin

No exceptions recorded

Nothing we have read treats any nationality differently for this topic. The rule above applies to everyone.

Attached tables (별표) are not in the body: /LSW/lsBylContentsInfoR.do?bylSeq=<B>&lsiSeq=<N> returns hanFlSeq and pdfFlSeq, and https://www.law.go.kr/LSW/flDownload.do?flSeq=<pdfFlSeq> is the table as a PDF with a text layer. The site also carries the government's English translations at /LSW/eng/engLsInfoR.do?lsiSeq=<N>, keyed to the English version's own lsiSeq rather than the Korean one.

Standing: Maintains the text in force

Cannot be cited for: **It consolidates; the Official Gazette (관보) promulgates.** What this site serves is the state's working consolidated text, and where it differs from the gazette the gazette is the instrument. The site says as much about its own comparison tool: 국가법령정보센터에서 제공하는 신구법 비교는 시스템으로 자동 생성한 것으로 참고용으로만 이용하시기 바라며, 정확한 개정내용의 확인은 제·개정이유(제·개정문) 또는 관보를 확인해 주세요. **Its English translations carry no legal effect and say so**, on the page: "ㅇ This English translation of the legislation has been provided by the relevant government ministry solely for the purpose of facilitating understanding of Korean laws. It does not have any legal authority or official effect and may not reflect the most recent amendments." It cannot be cited for the English. **It is not a substitute for the ministerial notices (고시) that carry most of the numbers.** Korean immigration, health insurance, driving and marriage-visa law delegate thresholds to notices of a Minister or a Commissioner, and those are published elsewhere; a reading of law.go.kr establishes the rule and not the figure. **The body address is undocumented and could move.** If /LSW/lsInfoR.do stops answering, re-derive it from the iframe src inside https://www.law.go.kr/법령/<name>.
