Twelve Things the Consulate Checks, and Most of Them Are About the Korean Spouse
Marriage migration is status F-6, and Attached Table 1-2 of the Enforcement Decree gives it three limbs: the spouse of a Korean national; a father or mother raising a child born of a marriage - including a de facto marriage - with a Korean national, where the Minister of Justice so recognises; and a person who was living in Korea married to a Korean national and can no longer maintain a normal marriage because of the spouse's death or disappearance or some other cause not their own fault, again where the Minister so recognises. Getting the visa is governed by the Enforcement Rules of the Immigration Act, and they are unusual in how much of the inquiry points at the Korean. Article 9-4 requires the Korean spouse to issue the invitation and makes them the guarantor, and where the Minister's notice applies, to have completed the international marriage guidance programme. Article 9-5 then lets the consulate examine twelve matters, and eight of them are about the inviter: whether they have invited another spouse in the last five years; whether they meet the income requirement, which the Minister of Justice publishes every year by reference to the standard median income under the National Basic Living Security Act; whether they have secured normal housing where a couple can live together, with rooming houses, motels and greenhouse structures excluded by name; whether three years have passed since they themselves naturalised through marriage or obtained permanent residence as a spouse; and four separate criminal-history bars, ten years for domestic violence, sexual offences against children and young people, sexual and violent crime and murder, and five years for a false marriage registration. The applicant's side is the circumstances of the relationship, the validity of the marriage under both countries' law, the mutual exchange of health and criminal-record information, and basic Korean. The Minister may waive some of this where the couple already have a child together.
At a glance
- Status
- F-6, marriage migration
Item 27 of Attached Table 1-2 of the Enforcement Decree of the Immigration Act, with three limbs.
- Maximum period of stay granted at once
- 3 years
Attached Table 1 of the Enforcement Rules of the Immigration Act reads 결혼이민(F-6) 3년.
- Income requirement
- Set every year by the Minister of Justice, by reference to the standard median income
Article 9-5(1)4 of the Enforcement Rules, which points to article 2(11) of the National Basic Living Security Act. No figure is in the Rules; the annual notice was not read.
- Housing
- Normal housing where the couple can live together continuously; rooming houses, motels and greenhouse structures do not count
Article 9-5(1)7 of the Enforcement Rules, which names those three by way of example.
- Korean language
- Basic conversational Korean, to a standard the Minister of Justice publishes
Article 9-5(1)6 of the Enforcement Rules. The standard itself is in a notice that was not read.
- Previous invitation by the same Korean spouse
- Checked over the last five years
Article 9-5(1)3 of the Enforcement Rules.
- Waiting period after the inviter's own marriage naturalisation
- 3 years
Article 9-5(1)8 of the Enforcement Rules, which counts from naturalisation under article 6(2)1 or 2 of the Nationality Act or permanent residence under item 2 of Attached Table 1-3.
- Criminal-history bars on the inviter
- 10 years for domestic violence, sexual offences against children and young people, sexual and violent crime and murder; 5 years for a false marriage registration
Article 9-5(1)9 to 12 of the Enforcement Rules, each measured from the end of the sentence, the finality of a suspended sentence or the finality of a fine.
- Permanent residence as a spouse
- After 2 years of stay as the spouse or minor child of a Korean national or a permanent resident
Item 2 of Attached Table 1-3 of the Enforcement Decree.
- Naturalisation as a spouse
- 2 years of domicile while married, or 3 years of marriage with 1 year of domicile
Article 6(2)1 and 2 of the Nationality Act.
Requirements
- An invitation from the Korean spouse, who becomes your guarantor
- The international marriage guidance programme, where the Minister's notice applies to you
- The inviter's income at or above the figure the Minister of Justice publishes each year
- Housing where a couple can live together on a continuing basis
- Basic Korean, to the standard the Minister of Justice publishes
- A marriage valid under the law of both countries, and health and criminal-record information exchanged between the couple
In detail
The examination looks at the Korean, not the foreigner
Of the twelve matters article 9-5 lets a consulate examine, four concern the couple or the applicant - how they met and whether they intend to marry, whether the marriage is valid under both countries' law, whether health and criminal-record information has been exchanged, and whether the applicant speaks basic Korean. The other eight are about the Korean spouse: income, housing, how recently they invited a different spouse, how long ago they themselves naturalised through marriage, and four categories of criminal record. Read in order the article is less a test of the migrant than a screen on the sponsor, and the ten-year bars attached to domestic violence and to sexual and violent crime say plainly what the screen is for.
The income figure is annual and is not in any instrument
Article 9-5(1)4 pegs the requirement to the standard median income defined by the National Basic Living Security Act and then hands the figure to a notice the Minister of Justice publishes every year. Nothing in the Act, the Decree or the Rules states an amount. That makes this one of the Korean conditions most likely to have moved since any guide was written, and it is the reason no number appears in this record.
Housing is defined by what it is not
Article 9-5(1)7 asks whether normal housing has been secured where the couple can live together on a continuing basis, and then does something instruments rarely do: it names three places that do not count - a rooming house, a motel and a greenhouse. The examples are not decorative. They describe the accommodation the provision was written against, and they tell an applicant more about how the condition is applied than the abstract standard does.
Exceptions by origin
No exceptions recorded
Nothing we have read treats any nationality differently for this topic. The rule above applies to everyone.
What the law says
Our translation - not official
(a) the spouse of a national; (b) a father or mother raising a child born of a marital relationship with a national, including a de facto marital relationship, whom the Minister of Justice recognises; (c) a person who, while staying in Korea married to a spouse who is a national, cannot maintain a normal marital relationship because of that spouse's death or disappearance or any other cause for which that person is not responsible, and whom the Minister of Justice recognises.
The status name and code fall inside the sentence because the table puts them in a narrow left column.

The lsiSeq is version-specific, so an address taken this way is pinned to the consolidation it was read from, which is why every citation of it carries a cut-off. Attached tables (별표) are not in the body: /LSW/lsBylContentsInfoR.do?bylSeq=<B>&lsiSeq=<N> returns hanFlSeq and pdfFlSeq, and https://www.law.go.kr/LSW/flDownload.do?flSeq=<pdfFlSeq> is the table as a PDF with a text layer. Practical notes
The Minister of Justice's annual income notice under article 9-5(1)4, the Korean-language criteria under subparagraph 6 and the notice of cases where the examination may be waived were not located or read.
Article 9-5(1)1 to 3 and 9 to 11 were read and are summarised in the key facts rather than quoted in full.
The international marriage guidance programme is created by article 9-4(2) of the Enforcement Rules and its operation is left to a notice of the Minister of Justice, which was not read.
Item 24(a) of Attached Table 1-2 - the F-2 limb for a minor foreign child of a national, and for the spouse and minor children of a permanent resident - is invited through the same article 9-4 procedure and is recorded here only as the cross-reference the Rules make.
Nothing published by the Korea Immigration Service was read.
