One Sentence Defines the Student Status, and Working While You Study Needs a Separate Permission

Item 5 of Attached Table 1-2 of the Enforcement Decree of the Immigration Act defines the study status D-2 in a single sentence: a person who intends to receive education in a regular course, or to carry out a specific piece of research, at an educational institution of junior-college level or above or at an academic research institution. There is no tuition threshold, no funds requirement and no language condition in the Decree; article 9-2 of the Enforcement Rules applies the general visa criteria, the last of which sends everything else to standards the Minister of Justice sets separately for each status. The general training status D-4, item 7 of the same table, sits beside it for education or training at an institution or company meeting conditions the Minister sets, and excludes anyone receiving remuneration beyond living costs from the training body as well as anyone who qualifies for D-2 or for the technical training status D-3. The period is two years at a time for both D-2 and D-4, the same as for cultural and artistic activity D-1. What the Decree does not give a student is any right to work: article 18(1) of the Immigration Act requires a status that permits employment activity, and study is not one, so a part-time job needs a permission for activities outside the status under article 20. After graduation the job-seeking status D-10 covers a person who intends to train or look for work in a field within E-1 to E-7, for one year at a time.

Status
D-2, study

Item 5 of Attached Table 1-2 of the Enforcement Decree of the Immigration Act.

Level of institution
Junior college or above, or an academic research institution

Item 5 of Attached Table 1-2. School-level study is not within D-2.

Maximum period of stay granted at once
2 years

Attached Table 1 of the Enforcement Rules of the Immigration Act reads 유학(D-2) 2년.

Working while studying
Needs a permission for activities outside the status

Article 20 of the Immigration Act. Article 18(1) requires a status that permits employment activity, and D-2 is not one.

Funds or tuition threshold in the Decree
None in Attached Table 1-2 or in article 9-2 of the Enforcement Rules

Article 9-2(6) of the Enforcement Rules sends the remaining conditions to standards the Minister of Justice sets separately for each status, and those were not read.

After graduation
D-10, job-seeking, for one year at a time

Item 13 of Attached Table 1-2 covers training or job-seeking in a field within E-1 to E-7, excluding entertainment venues the Minister designates within E-6; the one-year figure is from Attached Table 1 of the Enforcement Rules, which reads 구직(D-10) 1년.

Health insurance
Study and general training statuses the Minister of Health and Welfare designates skip the six-month waiting period

Article 61-2(1)4 of the Enforcement Rules of the National Health Insurance Act. Which ones are designated is in a notice that was not read.

Requirements

  • Admission to a regular course at an educational institution of junior-college level or above, or to a specific research project at an academic research institution
  • A valid passport, no entry ban, and an entry purpose matching the status
  • Whatever the Minister of Justice separately prescribes for D-2, which the Rules leave outside themselves
  • A permission for activities outside the status, under article 20 of the Immigration Act, before taking any job

In detail

The conditions a student cares about are not in the instruments

Attached Table 1-2 says who D-2 is for and nothing more. Article 9-2 of the Enforcement Rules adds the generic visa checks - passport, no entry ban, matching purpose, likelihood of return - and then its sixth subparagraph hands everything else to criteria the Minister of Justice sets separately for each status. Financial evidence, language level, which institutions may sponsor and how many students they may take are all on the far side of that delegation. A reader who wants to know what a Korean student visa actually requires will not find it in the Act, the Decree or the Rules.

Study is not a work status, and the Act is explicit about it

Article 18(1) of the Immigration Act makes employment conditional on holding a status that permits employment activity. D-2 is defined by education and research, so a student who takes a job is doing something their status does not cover, and article 20 requires the Minister of Justice's prior permission for activities outside a status. Working without it is not a breach of a condition attached to the visa; it is activity outside the status, with the enforcement consequences the Act attaches to that.

5. Study (D-2): a person who intends to receive education in a regular course, or to conduct specific research, at an educational institution of junior college level or above or at an academic research institution.

The status code falls inside the sentence because the table puts the name and code in a narrow left column.

Practical notes

The standards the Minister of Justice sets under article 9-2(6) of the Enforcement Rules for D-2 and D-4 were not located or read. No figure for required funds appears anywhere in this record because none appears in the instruments read for it.

The conditions attached to a permission for activities outside the status - how many hours a student may work and in what - are not in article 20 of the Act and were not found in the Enforcement Decree or the Enforcement Rules as read.

Nothing published by the Korea Immigration Service, the Ministry of Education or any university was read.
