A non-EU family member of a Spanish national does not use the ordinary family reunification chapter. Chapter VII of the Reglamento gives them their own authorisation, and the definition is deliberately wide: the relationship counts whatever the place and moment it was created, provided it is maintained and the person accompanies, joins or reunites with the Spaniard in Spain. The list of who qualifies covers the spouse, a registered partner, an unmarried partner with twelve continuous months of life together - waived where there are children in common - and children under twenty-six, or older if dependent or disabled. Only one spouse may ever hold this authorisation, whatever the personal law of the applicant allows.

«Se encontrará en situación de residencia temporal la persona extranjera que, obteniendo una autorización conforme a lo previsto en este capítulo, no posea la nacionalidad de uno de los Estados miembros de la Unión Europea, ni de otro Estado parte del Acuerdo sobre el Espacio Económico Europeo ni de Suiza y tenga con una persona de nacionalidad española una relación familiar de las que se incluyen en este capítulo, independientemente del lugar y el momento en que se cree el vínculo, siempre que se mantenga y le acompañen, se unan o se reúnan con él en territorio nacional, salvo en el caso previsto en el artículo 94.1 h) del presente reglamento en cuyo caso podrán hacerlo en cualquier circunstancia.»

«El cónyuge mayor de dieciocho años, siempre y cuando no haya recaído acuerdo o declaración de nulidad del vínculo matrimonial o divorcio y no se haya celebrado en fraude de ley. En ningún caso podrá acceder a esta autorización más de un cónyuge, independientemente de que la ley personal de la persona extranjera admita esta modalidad matrimonial. En cuanto a la persona de nacionalidad española residente que esté casada en segundas o posteriores nupcias, sólo podrá acceder a esta autorización el nuevo cónyuge y sus familiares relacionados en este artículo si acreditan que la disolución de sus anteriores matrimonios ha tenido lugar tras un procedimiento que fije la situación del cónyuge previo y sus familiares con relación a la vivienda común, las eventuales pensiones al cónyuge y a los hijos menores o mayores dependientes.»

«La pareja extranjera no casada mayor de dieciocho años que mantenga con la persona de nacionalidad española una relación estable debidamente probada. En todo caso, se entenderá por pareja estable debidamente probada aquella que acredite suficientemente una relación de convivencia análoga a la conyugal, dentro o fuera de España, de, al menos, doce meses continuados. No será exigible el periodo de convivencia previa si la pareja cuenta con descendencia común siempre que se mantenga el vínculo.»

Practical notes

This chapter is for family of a Spanish national. A non-EU family member of an EU citizen living in Spain is under a different instrument, Real Decreto 240/2007, which this record does not reach.

The requirements for the authorisation - means, housing, insurance - are later in the chapter. Articles 93 and 94 define who may apply, and that is what is quoted here.
