Studying in Jamaica

Jamaica issues no student visa. A student arrives as a visitor and then has the stay extended, and the Agency asks for that to happen within two weeks of arrival rather than when the landing stamp runs out. What is produced is a letter of registration from an institution registered with the Ministry of Education, addressed to the Agency's chief executive, together with a return ticket valid for a year. The alternative, for someone who qualifies for it, is Unconditional Landing, which the Agency describes as letting the holder attend school without a student visa and work without a work permit - it is granted on birth, descent, naturalisation or a Caribbean Community skills certificate, not on enrolment.

Country-level policy

Jamaica still sorts arrivals by the Commonwealth

Two statutes of the mid-1940s still govern who may come and stay, and the dividing line between them is the Commonwealth. The Immigration Restriction (Commonwealth Citizens) Act applies to Commonwealth citizens and gives them a statutory ceiling of twelve months. The Aliens Act applies to everyone else, requires registration, allows a security deposit scaled by which part of the world you come from, and sets no period for a stay at all. The same line runs through the law of citizenship, where a Commonwealth or Irish citizen is registered after five years and everyone else is naturalised on a longer and stricter test; through the work permit statute, which names Commonwealth citizens and foreign nationals as separate defined terms; and through the Agency's fee table, which charges non-Commonwealth nationals to register and charges them re-entry visa fees by nationality. For Caribbean Community purposes it matters because two member states, Haiti and Suriname, are not in the Commonwealth.

The extension power a Commonwealth student's stay rests on. For a non-Commonwealth student the equivalent is the variation of conditions under the Aliens Act, s. 7(1).

Practical notes

Neither immigration Act mentions study. A student's position is built out of the general power to extend leave or vary the conditions attached to it, which is why the requirements are the Agency's rather than a statute's.

A student who also wants to work needs a work permit unless exempt; the Agency's extension page treats study and employment as separate categories with separate documents.

    Jamaica's statute library, publishing the Revised Laws of Jamaica, the revised subsidiary legislation, Acts of Parliament by year and the Jamaica Gazette. Every document is a scan of the printed page with a text layer the publisher produced by recognition. It carries the Constitution, the Immigration Restriction (Commonwealth Citizens) Act, the Aliens Act, the Jamaican Nationality Act, the Foreign Nationals and Commonwealth Citizens (Employment) Act, both Caribbean Community Acts, the Income Tax Act, the Customs Act and the Road Traffic Act.

    Standing: Maintains the text in force

    Cannot be cited for: It must not be cited for what a whole Act looks like today without reading the foot of the page: the Revised Laws are loose-leaf and each page is current only to the Legal Notice that authorised its inclusion, so one Act can hold pages from 1973 and 2012 at once. It publishes almost no commencement instruments, and the Law Revision Act expressly lets the Commissioners omit commencement provisions from the text, so a Chapter will often not say when it started. Its catalogue dates - operational date, last amendment - are not cut-offs and contradict the pages: the Free Movement of Skilled Persons Act is catalogued as last amended in 2004 and its pages were authorised in 2016. It must never be relied on for an absence in the Income Tax Act or the Customs Act: 102 of 295 pages of the first and 46 of 155 of the second carry no text layer at all, and the Second Schedule to the Customs Act is not in the published file. The Free Movement of Skilled Persons Act has no text layer at any page. Its browse index and gazette index are served by an endpoint that redirects an anonymous reader to an administrator login, so neither list returns anything and addresses have to be guessed from the title. Its TLS chain omits the intermediate certificate, so an ordinary client refuses the connection until the missing certificate is supplied.
