A Statutory Right to a Basic Account, for Anyone Lawfully in the EEA

Answer

The general rule applies to you

No exception is recorded for citizens of Portugal on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Portugal to Liechtenstein · Opening a bank account

Liechtenstein gives consumers a right to a bank account, and the right is broader than residence: a consumer lawfully resident anywhere in the European Economic Area may open and use a basic account at a bank in Liechtenstein, irrespective of where they live, provided they can show a genuine interest in it. The right extends to a consumer with no fixed address, to refugees and asylum seekers, and to a person with no right of residence who cannot be removed. A bank may refuse only on one of six listed grounds - no genuine interest, an existing account at a Liechtenstein bank, a criminal case or conviction against the bank or its people, a conflict with due-diligence, sanctions or market-abuse legislation, a framework contract the bank lawfully terminated within the past year, or a refusal to sign the declaration about existing accounts - and must give written reasons and tell the applicant how to challenge the refusal. The account must be opened within ten business days.

  • Proof of a genuine interest in the account
  • A declaration on oath, or written authorisation for the bank to check with other Liechtenstein banks, that no comparable account is already held
  • Compliance checks under the due-diligence and international sanctions legislation, which the Act expressly leaves untouched

In detail

The EEA answer, next door to the Swiss one

Switzerland and Liechtenstein share a currency and a customs area and give opposite answers here. The Switzerland record in this corpus records that Swiss law gives nobody a right to be a bank’s customer, and puts a universal service obligation on the Post instead, discharged by PostFinance. Liechtenstein, being in the EEA, took the payment accounts directive and wrote a right into statute, enforceable against any bank, with an exhaustive list of refusal grounds and a ten-day deadline. The same person, twenty kilometres apart, has a claim in one country and a request in the other.

Country-level policy

The Consolidated Database Is Informative; Only the Gazette Is Authoritative

Everything quoted in Liechtenstein’s records comes from Lilex, the consolidated law database of the government’s legal service at gesetze.li. Lilex says what it is: the consolidated provisions serve information only and have no legal effect. The authoritative text is elsewhere, and the Publication Act says exactly where - only the version of a provision published in the Landesgesetzblatt and electronically signed is massgebend, and for treaties and decisions of international organisations it is the texts designated authentic in them. That is a third answer to a question this corpus has now asked of three neighbours: Switzerland’s consolidations are themselves authoritative, Iceland’s gazette prevails over its code, and Liechtenstein separates the two the way Iceland does while publishing both at the same address.

What applies to you

Nothing changes for a citizen of Portugal

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

What the law says

Text layer - verbatim verifiedZahlungskontengesetz (ZKG) · Art. 21 · consolidated to 2026-01-01

Consumers lawfully resident in the European Economic Area have the right, irrespective of their place of residence, to open and use a basic account at a bank, provided they can show a genuine interest in it. 2) This right also belongs to a consumer without a fixed residence, a refugee, a person in need of protection and an asylum seeker, and to a consumer without a right of residence who cannot be removed for legal or factual reasons. 3) Access to a basic account may not be made conditional by the bank on the acquisition of additional services or of shares, where this is not required of all the bank’s customers. 4) A bank may refuse the application of a consumer entitled under paragraph 1 or 2 to open a basic account only where one of the grounds listed in article 22(1) is present. 5) The bank must open the basic account without delay and at the latest ten business days after receipt of a consumer’s application, or refuse the application. 6) The provisions of this chapter leave untouched the bank’s obligations under the due diligence legislation and the legislation on the enforcement of international sanctions.

Paragraph 6 is the limit on the right: the due-diligence and sanctions obligations are untouched by it.

Practical notes

The right is to a basic account, not to the bank of one’s choice or to the private banking Liechtenstein is known for. The refusal grounds in article 22 include the due-diligence legislation, which is the ground that does the work in practice.

The comparison with Switzerland is taken from the Switzerland record in this corpus, which quotes the Postgesetz and the Postverordnung.

This record rests on the Zahlungskontengesetz. We did not read the Zahlungskontenverordnung or the Sorgfaltspflichtgesetz.
