Family Reunification Is the Door the Quota Does Not Guard

Answer

The general rule applies to you

No exception is recorded for citizens of Ireland on this topic. That is the answer, not a gap - everything below is the rule you get, unchanged.

195 exceptions recorded across 74 countries · none match Ireland to Liechtenstein · Residency through marriage

A person who already holds a Liechtenstein residence permit may bring their family, and for an EEA or Swiss national the free-movement act says they may do so "at any time" - there is no draw, no waiting list and no quota in the family chapter. The family member who arrives this way may work. Under the aliens act the family route is narrower and slower: it covers only the spouse or registered partner and common unmarried children under eighteen, the sponsor must show a stable job or means guaranteed by a bank established in Liechtenstein and a dwelling with room for everyone, the spouse living abroad must have basic German, and the application has to be made within three years of the permit or of the marriage. A sponsor who themselves came by family reunification must wait four years before bringing anyone.

At a glance

Timing on the EEA and Swiss track
At any time, with no quota and no draw

PFZG article 41(1) uses the word "jederzeit". The family chapter of the Act contains no numerical limit.

Work by a family member
Permitted

PFZG article 42, one sentence long. Under the EEA Agreement a family member who takes work is counted against the quota for the economically active, by section III of the sectoral adaptations to Annex VIII - but the same section forbids refusing the permit because that quota is exhausted.

Who counts as family on the EEA and Swiss track
Spouse or registered partner, descendants under 21 or dependent, and dependent ascendants

PFZG article 4(1)(d). Article 2(1)(c) and (d) extend the Act to de facto partners and to further beneficiaries.

Who counts as family on the third-country track
Spouse or registered partner, and common unmarried children under 18

AuG article 32(2). Dependent parents are not in the list.

Language requirement
Basic German for a spouse living abroad, on the third-country track only

AuG article 33(1)(c). It may be waived under article 33(3) where the sponsor holds a work permit and the family enters with them.

Deadline to apply, third-country track
Three years from the grant of the permit or from the marriage

AuG article 34(1).

Wait where the sponsor arrived by family reunification
Four years of lawful uninterrupted residence

AuG article 34(1a).

Wait after a divorce before bringing a new spouse
Two years from the divorce judgment becoming final

AuG article 34(2).

Permanent residence for a family member of an EEA national
Five years of uninterrupted residence

PFZG article 45(1). For a family member of a Swiss national it is five years holding a residence permit, giving a settlement permit instead (article 45(2)).

Marriage of convenience
Permit refused or revoked where sufficient indications show the marriage was entered into to circumvent the Act, or where a spouse was coerced

PFZG article 43.

Requirements

  • EEA and Swiss track: a permit to take up residence, an official certificate of the relationship, copies of the family members’ travel documents, and comprehensive sickness insurance covering all risks in Liechtenstein
  • EEA and Swiss track, where the sponsor is a student, a tourist or a person without gainful activity: proof of means for the whole family so that no social assistance is drawn
  • Third-country track: a valid residence or settlement permit, both spouses of age under Liechtenstein law, basic German for the spouse living abroad, a suitable dwelling with room for the family, and a secure job or means guaranteed by a bank established in Liechtenstein
  • Third-country track: the application made within three years of the permit or of the marriage

What applies to you

Nothing changes for a citizen of Ireland

We have no rule recorded that treats your citizenship differently here, so the general rule above is the one that applies to you. That is an answer, not a gap.

Practical notes

The family chapter of the free-movement act is where the quota stops applying, and it is the only part of Liechtenstein residence law we read that uses the word "at any time".

This record rests on the PFZG and the AuG. We did not read the Integrationsvereinbarung provisions of the ZAV in detail, which govern the integration agreement a reunified child’s permit renewal can be made to depend on.
