Jamaican parents or grandparents

Jamaica does not give descendants a residence permit; it gives them citizenship, and it does so automatically. Section 3C of the Constitution says that every person born outside Jamaica becomes a citizen on the date of their birth if at that date their father or mother is a citizen of Jamaica by birth, descent or registration by virtue of marriage. Because descent is itself one of the three qualifying parental modes, the chain does not stop at one generation: a child of a citizen by descent is themselves a citizen by descent, and so on indefinitely. That is the kernel of truth in the widely repeated claim that Jamaican descent is unlimited. What the claim leaves out is the limit that does exist, and it is a real one: a parent who became Jamaican by naturalisation, or by any registration other than one by virtue of marriage, does not transmit under section 3C at all. The question is not how many generations back, but how your parent became Jamaican.

Requirements

  • A parent who was a Jamaican citizen at the date of your birth, by birth, by descent, or by registration by virtue of marriage to a Jamaican
  • Your own birth certificate and your Jamaican parent's birth certificate, citizenship certificate or adoption certificate
  • Your parent's marriage certificate or decree absolute where it applies
  • Two certified passport photographs and valid identification
  • An application to the Agency, or through a Jamaican mission abroad, with the fee

In detail

How far it actually reaches

Section 3C turns on the status your parent held at the moment you were born, and it accepts three kinds of parent: a citizen by birth, a citizen by descent, and a citizen registered by virtue of marriage to a Jamaican. Because the second of those is descent itself, a person who became Jamaican under section 3C can pass it on under section 3C, and their child can do the same. On the face of the text nothing caps that. The cap is of a different kind: if the link in the chain became Jamaican by naturalising, or by registering as a Commonwealth citizen after five years' residence, the chain stops there, because neither of those is one of the three modes section 3C names.

Born before independence

A person born outside Jamaica before 6 August 1962 is dealt with by section 3A rather than section 3C. If they were not already entitled to Jamaican citizenship, and their father or mother became - or but for death would have become - a citizen on 6 August 1962, they became a citizen on 1 March 1993. That provision was added in 1993 and reaches back, so a great many people acquired citizenship on a day they never noticed.

What the Agency grants, and what it calls it

Citizenship by descent is declaratory: you are a citizen already and the certificate records it. Separately the Agency issues an Unconditional Landing stamp under its descent heading, described as being for applicants born overseas with Jamaican parents or grandparents. That stamp is an immigration convenience for someone travelling on a foreign passport, not a different citizenship rule, and the mention of grandparents is the Agency's phrasing rather than a separate constitutional limb.

Practical notes

The Agency's own citizenship pages give two different processing times for the same service: twenty-five working days in the procedure text and ninety working days in the fee table on the same page. Plan on the longer one.

The text quoted here is the Ministry of Legal and Constitutional Affairs edition of the Constitution, which carries amendments up to 2023 in its margins and no page-authorisation notices. The Ministry of Justice edition of Chapter II is frozen at pages authorised in 2001.
