Liechtenstein is a full party to the EEA Agreement, and it is the only one of the thirty where a national of another member state has no right simply to move in. The sectoral adaptations to Annexes VIII and V of the Agreement say that nationals of the other EEA states may settle in Liechtenstein only with the authorities’ permission; they have a legal claim to that permission, but only within a yearly number. That number is set as a net increase of at least 1.75 per cent of the stock of permits held on 1 January 1998 for people in work, with a further 0.5 per cent of the same base for people who are not, and half of the increase must be handed out by a procedure that gives every applicant an equal chance. Liechtenstein runs that procedure as a two-stage draw. The derogation is not transitional and never expired: Protocol 15 ran out, the review it required concluded that Liechtenstein’s geographical situation justified keeping conditions, and Joint Committee Decision No 191/1999 wrote them into the Annexes, where they are now reviewed every five years rather than ending on a date.
At a glance
- The instrument that limits free movement
- Sectoral adaptations to Annexes VIII (right of establishment) and V (free movement of workers) of the EEA Agreement
Inserted by EEA Joint Committee Decision No 191/1999 of 17 December 1999, published in Liechtenstein as LGBl. 2000 Nr. 97. Not domestic law: the Personenfreizügigkeitsgesetz implements it and says so in its article 1.
- Yearly increase in permits for EEA nationals in work
- A net increase of at least 1.75% of the stock at 1 January 1998
Annex VIII, sectoral adaptations, section II.1. The Annex states the rate of increase; it does not state a number of permits, and the number is fixed by the government.
- Additional yearly quota for EEA nationals not in work
- A further 0.5% of the same base
Annex VIII, sectoral adaptations, section IV, covering the residence rights of the non-active, of former workers and of students.
- Share of the increase that must go by equal chance
- Half
Annex VIII, sectoral adaptations, section II.2. This is the clause the draw exists to satisfy.
- Permits actually drawn each year for EEA nationals in work
- 28as of 2026-09-01
Stated by the Ausländer- und Passamt on its page about the draw, last updated 1 September 2026. No instrument carries the figure: PFZV article 26 leaves the quota for each draw to the government.
- Draws per year
- Two, in spring and in autumnas of 2026-09-01
Ausländer- und Passamt. PFZG article 39(1) requires at least one draw a calendar year and PFZV article 28(1) sets the application windows at 1-28 February and 1-31 August where there are two.
- Fee to enter the draw
- CHF 100 for the preliminary draw and CHF 500 for the final draw
Ausl-GebV article 11(1). The agency page states the same two amounts.
- Time to take up a permit won in the draw
- Six months from the notification
PFZG article 37(3). The right is personal and cannot be transferred.
- Who may not enter the draw
- Swiss nationals, nationals of the United Kingdom, and anyone already holding a right of permanent residence in Liechtenstein
PFZV article 23(1) excludes those with a right of permanent residence; the Ausländer- und Passamt states the exclusion of Swiss and United Kingdom nationals, which follows from the draw being an EEA arrangement.
- Decision deadline the Agreement imposes
- A written decision before the end of the third month from the application
Annex VIII, sectoral adaptations, section VI, which also gives a right to written reasons for a refusal and the same remedies a Liechtenstein national would have.
- Cross-border workers
- Must return to their state of residence every day
Annex VIII, sectoral adaptations, section VII. The same daily-return rule is in PFZG article 4(1)(b), which defines a Grenzgänger that way.
Requirements
- Nationality of an EEA member state - the arrangement in Annexes VIII and V is addressed to nationals of Iceland, Norway and the EU member states
- Permission from the Liechtenstein authorities before settling: a residence permit is required for any gainful activity whatever its length, and for any stay without gainful activity longer than three months in six
- For an entitlement outside the draw: an employment contract of more than one year with an adequate level of employment, or the trade-law conditions for self-employment, and that commuting is not reasonable
- For a stay without gainful activity: means enough not to need social assistance, and sickness insurance covering every risk in Liechtenstein
- For the draw: EEA nationality, no existing right of permanent residence in Liechtenstein, a complete application inside the window, no multiple applications, and the fees paid on time
In detail
Why Liechtenstein is different from the other twenty-nine
Every other EEA state applies the Citizens’ Rights Directive to EEA nationals as a right that needs no permission and no quota. Liechtenstein applies the same Directive - the Personenfreizügigkeitsgesetz exists to implement it - and then applies, on top of it, a sectoral adaptation that makes settlement subject to a permit and the permits subject to a yearly number. Joint Committee Decision No 158/2007, which brought the Directive into the EEA Agreement, says in its own recitals that doing so leaves the Liechtenstein adaptations untouched. So the two live side by side: the Directive governs who qualifies, the adaptation governs how many of them get in.
What the limit covers and what it does not
The limit is on settlement. Section I of the sectoral adaptations exempts from the permit requirement anyone staying less than three months a year who takes up no employment or permanent gainful activity, and anyone supplying cross-border services. Domestic law tracks that: PFZG article 8 makes a permit necessary for any gainful activity regardless of how long it lasts, and otherwise only for a stay of more than three months in six. Cross-border work is outside the quota entirely - it is notified rather than authorised under PFZG articles 32 and 33 - which is the practical escape hatch, and the reason it is an escape hatch is that Liechtenstein is small enough to commute into from Austria and Switzerland. The price of it is section VII: a cross-border worker must go home every night.
How the draw works
Applications go to the Ausländer- und Passamt in a window fixed by the ordinance. A preliminary draw pulls twice as many names as there are permits; the names drawn are then asked for documents and checked against the substantive conditions, and the final draw is held among those who pass. Both stages are conducted by the Ausländer- und Passamt under the supervision of a judge of the Landgericht, and a record signed by that judge and the head of the office is made of each. Winning the draw gives a right to a permit that is personal, non-transferable, and lapses if it is not used within six months; a winner must tell the office an arrival date within five months.
The derogation was transitional once, and stopped being
Protocol 15 to the EEA Agreement let Liechtenstein keep national rules requiring prior authorisation, and numerical limits on people settling, until 1 January 1998. Article 9(2) required the parties to review the transitional measures at the end of that period, with due regard to Liechtenstein’s geographical situation. The review concluded that keeping conditions was justified, and Decision No 191/1999 put them into Annexes VIII and V - at first until 31 December 2006. The consolidated Annex VIII no longer carries that end date: it says the arrangement is reviewed every five years, the first time before May 2009. A transitional measure became a standing one by a change in a single sentence.
Country-level policy
Everything quoted in Liechtenstein’s records comes from Lilex, the consolidated law database of the government’s legal service at gesetze.li. Lilex says what it is: the consolidated provisions serve information only and have no legal effect. The authoritative text is elsewhere, and the Publication Act says exactly where - only the version of a provision published in the Landesgesetzblatt and electronically signed is massgebend, and for treaties and decisions of international organisations it is the texts designated authentic in them. That is a third answer to a question this corpus has now asked of three neighbours: Switzerland’s consolidations are themselves authoritative, Iceland’s gazette prevails over its code, and Liechtenstein separates the two the way Iceland does while publishing both at the same address.

The sentence that makes the arrangement permanent. It replaced the end date of 31 December 2006 that Decision No 191/1999 originally set.

Cannot be cited for: It is informative only and must never be cited as the authentic text. Its own Rechtshinweis says 'Konsolidierte Rechtsvorschriften dienen ausschliesslich der Information und entfalten keine Rechtswirkung', and article 7(1) of the Kundmachungsgesetz says only the signed electronic version published in the Landesgesetzblatt is massgebend. For a treaty it is the texts designated authentic in the treaty that govern, under article 7(2). It also cannot be cited for Swiss law applied in Liechtenstein: it lists which Swiss instruments apply but publishes none of their text, which lives on fedlex.admin.ch. There is a right to the grant of a residence permit within the meaning of the special solution on the movement of persons for Liechtenstein under Annexes VIII (right of establishment) and V (free movement of workers) of the EEA Agreement and of the treaty arrangements with Switzerland.
Domestic law points back at the Annexes rather than restating them. The permit itself runs up to five years where the intended stay is longer than a year (article 19(1)).

Two groups, drawn separately: people in work, and people settling without work including pensioners.

Practical notes
The quota is defined as a rate of growth, not as a number of permits, so the number of permits is not in any instrument we read. The figure of 28 drawn each year for people in work comes from the Ausländer- und Passamt’s own page; PFZV article 26 leaves the quota for each draw to the government to fix.
The arrangement is reviewed every five years under the opening sentence of the sectoral adaptations. We have not read a review later than the decisions cited here, so the arrangement is recorded as it stands in the consolidated Annexes.
Nationals of the United Kingdom are outside this arrangement because the United Kingdom is outside the EEA; the Ausländer- und Passamt says so on its page about the draw. We have not read any Liechtenstein instrument dealing with them separately.
This record rests on the EEA Agreement as published in Liechtenstein, on the PFZG and PFZV, on the fee ordinance and on two Joint Committee decisions as published in the Landesgesetzblatt. It is not a survey of EEA case law on the adaptations.

About this source
Liechtenstein's official gazette, published by the government in electronic form and held at gesetze.li under /chrono. It is where legislative acts, financial resolutions, treaties and decisions of international organisations - including decisions of the EEA Joint Committee under article 102(1) of the EEA Agreement - are promulgated. The quotable text of an issue is at /chrono/html/<LGBlId>. Article 7(1) of the Kundmachungsgesetz makes the signed electronic version published here the only authoritative text of a Liechtenstein provision.
Standing: Issues the instrument
Cannot be cited for: It publishes instruments as promulgated and does not consolidate them, so an amending Kundmachung states what was inserted rather than what the law now says. The sectoral adaptations inserted into EEA Annex VIII by Decision No 191/1999 are the live example: the 1999 text sets an end date of 31 December 2006 which the consolidated Annex no longer carries. For what a provision says today, read the consolidated text on Lilex and cite this only for the instrument that put it there.

About this source
The portal of the Liechtenstein national administration, including the Ausländer- und Passamt, which administers permits, the residence-permit draw, passports and asylum, and the Steuerverwaltung. Its pages carry the figures no instrument states: the number of residence permits drawn each year for economically active EEA nationals and for non-active ones, the draw cadence, the documents required and the total fee charged on a permit granted by the government. Each page prints its own last-updated date.
Standing: Applies the rule
Cannot be cited for: It is the agency describing the law it applies, not the law. Where a page and an instrument disagree the instrument governs, and a figure on a page that is not in an instrument is recorded as the agency's statement. It also mis-cites: the page on allocation of the B permit gives the Ausländergesetz as LGBl. 2008 Nr. 11 when it is Nr. 311. It is behind a Cloudflare challenge, so a plain fetch gets a 403 'Just a moment' page; Firecrawl passes.
